RESOLVED� that upon execution and delivery of a release
in full to the City of Saint Paul, the proper City officers
are hereby authorized and directed to pay out of the Tort
Liability Fund 09070-511-000 to D. Patrick McCullough the sum
of $1,000.00 in full settlement of his claim for damages sustained
to his property at 905 Parkway Drive as a result of a sewer backup
on June 21, 1979.

RE: Claim against the City of St. Paul b�y
D. Patrick McCullough
Plaintiff 's basement was flooded and received water damage when
the sewer backed up. The building is served by a Ma.plewood sewer
w hich is connected to a St. Paul pumping station. The backup
was caused by a burned out wire in our pumping station. When
the wire was fixed, the water receded.
The City of St. Paul and the City of Ma.plewood are each contributing
50% towards plaintiff 's damages.
