WHEREAS, the Division of Housing and Building Code Enforcement has
requested the City Council to hold a public hearing to consider the
advisability and necessity of the correction or wrecking and removal of
the following described building, said structure having been report.ed
to constitute a public hazard:
429-39 Bidwell Lot 10, Block 157, Robertson' s Multiple unit
Addition to West St. Paul block construction
Blocks 100 thru 199 row house
WHEREAS, it appears that as of March 30, 1982 the last record owner
and other parties of interest of said building are as follows: Fee owner
is Robert G. Heig, 4412 Washburn Ave . S. , Minneapolis, MN 55410. The
Board of Water Commissioners has a lien in the amount of $294 .06 as of
3-11-82. There are no other liens or mortgages of record.
WHEREAS, the Division of Housing and Building Code Enforcement, on
behalf of the City Council did notify by mail the above noted parties of
interest at their last known addresses;
T�IHEREAS, a public hearing was held by and before the Council of the
City of Saint Paul, in the Council Chambers of the Court House in said
city at 10 :00 a.m. on Thursday, April 22, 1982 to consider the advisability
and necessity of ordering the correction or wrecking and removal of said
structure on the above described property inasmuch as said structure is
reported to constitute a hazard to public health, safety and welfare.
WHEREAS, upon the facts presented at the said hearing, consisting
of photographs, inspection reports and the recommendation of the Building
Department, it is further determined that the above building constitutes
a hazardous building within the definition of Minnesota Statutes 463.15
for the following reasons:
l. The subject property has not been boardedup by the owner/city;

2 . This building had a fire and was badly damaged;
3. There are fallen walls;
4 . There are missing roof sections;
5. This building is in extremely hazardous condition;
6 . The conditions outlined above constitute a public hazard;
7. The owner has made no attempt to satisfactorily repair the
damage;
8 . The continued vacant and unboarded condition contributes a
blighting influence on the neighborhood;
now, therefore, be it,
RE50LVED,That in accordance with Minnesota Statutes Sections
463.I5 through 463. 25, and based upon the foregoing findings of the
City Council, the Council of the City of Saint Paul does hereby make
the following Order:
ORDER
1. The owners of the above described building shall make the
same safe and not detrimental to the public peace, health, safety and
welfare by having the said building razed and the materials there-
from removed from the premises within thirty (30) days from the date
of the service of this Order;
2. Unless such corrective action is taken to comply with this
Order or an Answer served upon the City of Saint Paul and filed in the
Office of the Clerk of District Court of Ramsey County, Minnesota
Hzithin twenty (20) days from the date of the service of this Order, a
Motion for Summary Enforcement of this Order to raze and remove the
said building will be made to the Ramsey County District Court;
3. In the event that the building is to be razed by the City of
Saint Paul pursuant to judgemnt of th� District Court, all personal
property or fixtures of any kind which may unreasonably interfere with
the razing and removal of this building shall be removed within ten
(10) day from the entry of judgment; and if not so removed, the City

action herein, all nece�sary costs e�pended by the City will be

incorporated Order herein be served upon the last record owners of the
above described property in the manner provided by law.

The Division of Housing atid Building Code Enforcement is hereby submitting its
report on the condition of the structure at the location referred to above.
The owner of record is: Robert Heigh, 4412 Wasliburn Ave. So. , Mpls, MIV. 55410.
The legal description of the property is Lot 101, Blocic 57, Robertsons Addition,
Blocks 100-199. (06-63510-100-57) .
The buildin� is a iKultiple Lmit,Block Construction, Row house.
The subject property has not been boarded up by the owner/city.
This building had a fire and wa.s badly damaged. There are fallen wa11s, missing
roof sections, and it is in an extremely hazardous condition.
Inasmuch as the conditions outlined above constitute a public hazard and the
owner has made no attempt to satisfactorily repair the damage despite our warn-
ings, and the continued vacant and boarded up condition contributes a blighting
influence on the neighborhood, it is the recommendation of this Division that
this ma.tter be referred to the City Attorney's office for razing and removal
through District Court proceedings.

An Ordinance amending the Saint Paul
Legislative Code establishing regulations
pertaining to noise.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the Saint Paul Legislative Code be amended so as to add
the following thereto:
293.01 . Noisy Assembly.
Subd. l. Definition. A noisy assembly under this
section means any gathering of r^��_� than one person
in a private residence which creates excessive noise. .
Any such gathering between the hours of 11: 00 P.P�.
and 7 : 00 A.M. in such a manner as to be plainly
audible at the property line of a structure or
building in which it is located or in the hallway
or apart�nent adjacent shall 'oe prima facie evidence
that the noise is excessive.
Subd. 2 . No person shall knowingly remain at a
noisy assembly.
Subd. 3. No person shall permit real estate under
his control to be used for a noisy assembly.
293.02 . �Iotor Vehicles. No person shall operate a motor
vehicle in the city in violation of the Motor Vehicle
Noise Limits of the Minnesota Pollution Control Agency.
