RESOLVED, That the proper City officials axe hereby authorized and
directed to execute an agreement with the County of Ramsey, providing for the
sale of asphalt by the City to the County, sub�ect to the terms and conditions
as set forth in said agreement, a copy of which is to be kept on file and on
record in the office of the Department of Finance and Management Services.

PURPOSE AND RATIONALE FOR THIS ACTION:
That the proper City Of'f'icials be authorized to execute an Agreement wi�th
the County of Ramsey to provide for the City's sale to the County of City
produced asphalt.

AGREEMENT
THIS AGREEMENT, Made and entered into this day of
, 1982, by and between the CITY OF SAINT PAUL, Minnesota,
hcreinafter referred to as "Saint Paul" and THE COUNTY
U1�' RAMSEY , hereinafter referred to as "THE COUNTY" ; �
WITNESSETH:
WHEREAS, Saint Paul is authorized and empowered to operate and
maintain an asphalt plant pursuant to Minnesota Statutes, Section
160.11, Subdivision 2; and
� WEiEREAS, Saint Paul and �'HE COUNTY
are road authorities as defined in Minnesota Statutes, Section 160.02,
Subdivision 9; now, therefore,
IT IS MUTUALLY AGREED BY AND BETWEEN SAINT PAUL AND THE COUNTY OF
�M�'� AS FOLLOWS:
1. That this agreement shall commence April 1, 1982, and terminate
March 31, 1983.
2. That at the discretion of Saint Paul exercised in supplying its
own needs for asphalt, Saint Paul will sell to THE COUNTY
asphalt as available of the type and at the prices noted as follows:

to THE COUNTY to increase the price per ton to a maximum
of Fifty Cents ($0.50) .

4. The books, records, documents, and accounting practices of Saint Paul
relevant to this agreement shall be subject at all reasonable times to inspection,
review or audit by personnel of the County, personnel authorized by the County,
and either the legislative auditor or the state auditor as appropriate.
5. That this agreement may be terminated by either party upon thirty (30)
days' written notice.
IN WITNESS HEREOF, The parties have set their hands the date first written
