WHEREAS, Northern States Power Company has advanced certain
sums on behalf of the City of St. Paul to settle various claims
arising out of the explosion and fire at the Commodore Hotel
on February 15, 1978; now, therefore, be it
RESOLVED, that upon execution and delivery of releases
in full to the City of St. Paul, the proper City officers are
hereby authorized and directed to pay out of the Tort Liability
Fund, 09070-511-328, to Northern States Power Company, the sum
of $3,823.32 in full settlement of the following claims:

RE: Commodore Hotel Fire & Explosion Cases
A number of claims arising out of the fire and explosion at
the Commodore Hotel on February 15, 1978 have been settled.
You will recall that the Court found the City of St. Paul
responsible for 10% of the damage which resulted.
The largest claim is brought by Terrance 0'Brien whose first
floor apartment was totally destroyed. He had recently re-
modeled the apartment and also had an extensive collection
of valuable books, records and other personal property. His
claim was settled for $23,000 and the City' s share is
$2,300. '
Wausa Insurance Company was the workers' compensation carrier
for the Summit Manor Nursing Home. An employee, Debra Drain,
received some lacerations when a window pane fell on her left
leg and arm. The insurance company paid $54.55 for medical
care received by Ms. Drain and the City' s share is $5.46.
Tower Insurance Company is the subrogee of Dr. Wallace Fritz
who owned the apartment building at 381-395 Laurel Avenue
in St. Paul. The explosion caused extensive glass breaka.ge
and some minor plaster damage to the building. The claim was
settled for $3,500 and the City' s share is $350.00.

Iowa Mutual Insurance Company is the subrogee of Henry Pol
whose 1971 Saab automobile was destroyed in the explosion.
The claim was settled for $1, 235 and the City' s share is
$123.50.
State Farm Fire and Casualty Company insured the home of
Paul Johnson at 79 Virginia Avenue. Glass damage from the
explosion totalled $515.78 and the City' s share is $51.58.
Allstate Insurance Company is the auto insurer of Allen
Andrews whose 1976 Audi was damaged by the explosion. The
claim was settled for $1,701.06 and the City' s share is
$170. 10.
Tracy Moos was a resident in the hotel. She lost some personal
property, was required to have other personal property repaired
or cleaned and incurred expenses in relocating. Her claim was
settled for $1,500 and the City' s share is $150.00.
Michael King was injured by flying debris from the explosion.
He sustained a laceration to his head and was treated at
St. Paul-Ramsey Medical Center where he incurred medical expenses
of $130. 25. The Claim was eventually settled for $2,000 and the
City' s share is $200.00.
Elizabeth 0'Brien was an instructor at St. Paul Academy and was
playing squash at the hotel when the f ire broke out. She
suffered an injury to the lateral aspect of the right ankle
where some flying glass fragments caused a laceration. She has
a scar on her right ankle. She missed approxima.tely one month
from work. Her claim was settled for $4,000. The City' s
contribution is only 8%, or $320, because we claimed immunity
since her injury was work related.
Firemen' s Fund Insurance Company is the auto insurer of Dr.
Arnold Schwyzer whose 1972 Chrysler was totally damaged by the
explosion. His claim was settled for $1,526.75 and the City' s
share is $152.67.
Our office recommends approval of these settlements. Al1 settle-
ments were negotiated with the assistance of Northern States
Power Company who advanced money on our behalf to resolve these
claims. The draft for the total amount sho,uld be ma.de payable to
Northern States Power Company.
