' ��{�� , . . i AGREEMENT � i , THIS AGREEMENT, Made and entered into this • day of ; 1982, by and between the CITY OF SAINT PAUL, a municipal corporation of the ' State of Minnesota (hereinafter referred to as "City") , and INDEPENDENT SCHOOL DISTRICT N0. 625, a Minnesota Public School District, (hereinafter i referred to as "School District") , and the RANDOLPH HEIGHTS PTS, an unincor- porated non-profit association, (hereinafter referred to as "PTA") . � In consideration of the mutual promises and benefits to be derived by , the inhabitants of the city of St. Paul, the City, School District, and PTA agree as follows: 1. The School District shall approve the proposed installation of playground equipment for the Randolph Heights School Playground, School District shall maintain the playground equipment after it is insta�led. 2. The PTA and City shall each contribute 50% of the cost for the purchase of the playground equipment for the Randolph Heights School Playground. • The PTA shall submit an invoice to the City for costs of the equipme�t and installation. Upon receipt of the invoice and approval thereof by School District, the City shall pay one-half of the cost of such equipment not to exceed the sum of $5,000; payment by the City shall be made to the PTA. 3. School District shall operate and maintain the playground equipment for the en3oyment and benefit of the inhabitants and children of St. Paul, and the City shall assume no responsibility nor liability for the operation or maintenance of said equipment. 4. School District shall hold harmless, protect, indemnify and defend the City of Saint Paul, its agents and employees from any and all claims arising out of the existence, use, operation, or maintenance of the said playground equipment to be lcoated and installed at the Randolph Heights School Playground.
