RESOLVED, That the Council of the City of Saint Paul does hereby
approve the Agreement between the City, Independent School District
4�625, and the Randolph Heights School PTA to provide grant funds of
50% of the equipment costs, not to exceed $5,000, for purchase and
installation of playground equipment at Randolph Heights School
Playground, and be it
FURTHER RESOLVED, That the proper City officials are authorized
to execute the Agreement on behalf of the City of Saint Paul and a
copy of said Agreement shall be kept on file in the offices of the
Director of Finance and Management Services.

AGREEMENT �

, THIS AGREEMENT, Made and entered into this • day of ;
1982, by and between the CITY OF SAINT PAUL, a municipal corporation of the '
State of Minnesota (hereinafter referred to as "City") , and INDEPENDENT
SCHOOL DISTRICT N0. 625, a Minnesota Public School District, (hereinafter i
referred to as "School District") , and the RANDOLPH HEIGHTS PTS, an unincor-
porated non-profit association, (hereinafter referred to as "PTA") . �
In consideration of the mutual promises and benefits to be derived by ,
the inhabitants of the city of St. Paul, the City, School District, and PTA
agree as follows:
1. The School District shall approve the proposed installation of
playground equipment for the Randolph Heights School Playground, School
District shall maintain the playground equipment after it is insta�led.
2. The PTA and City shall each contribute 50% of the cost for the
purchase of the playground equipment for the Randolph Heights School Playground.
• The PTA shall submit an invoice to the City for costs of the equipme�t and
installation. Upon receipt of the invoice and approval thereof by School
District, the City shall pay one-half of the cost of such equipment not to
exceed the sum of $5,000; payment by the City shall be made to the PTA.
3. School District shall operate and maintain the playground equipment
for the en3oyment and benefit of the inhabitants and children of St. Paul,
and the City shall assume no responsibility nor liability for the operation
or maintenance of said equipment.
4. School District shall hold harmless, protect, indemnify and defend
the City of Saint Paul, its agents and employees from any and all claims
arising out of the existence, use, operation, or maintenance of the said
playground equipment to be lcoated and installed at the Randolph Heights
School Playground.
