RESOLVED� that upon execution and delivery of a release
in full to the City of Saint Paul, the proper City officers
are hereby authorized and directed to pay out of the Tort
Liability Fund 09070-511-000 to Judith M. Hildman the sum of
$10,500.00 in full settlement of her claim for damages and injuries
sustained August 1, 1978 , as a result of an accident with a
city squad car at or near Fairview and University.

RE: Resolution requesting payment to Judith M. Hildman
This lawsuit arises out of an automobile accident between a
car driven by Judith Hildman and a squad car driven by a St.
Paul police officer. Mrs. Hildman was traveling north on Fairview
and entered the intersection of Fairview and University on the
green light. Officer Groh was traveling west on University with
his red lights on, using his opticom, but without his siren.
The opticom changed the light on University from red to green
just before the squad car entered. Neither driver saw the other
until just before the collision. There is no evidence of excessive
speed on the part of the plaintiff and there are buildings ob-
structing view at this intersection.
Mrs . Hildman dislocated the patella of her knee in the accident
and was given a ten percent permanency rating at the Ma.yo Clinic.
Her medical bills were approximately $900 and lost wages were
$500.
This office believes that the City would be found liable in this
case and recommends payment of $10,500 in settlement of the case.
