AN ORDINANCE AMENDING CHP,PTER 60 OF
THE ZONING CODE.
WHEREAS, the District 6 Land Use Plan contained in the
City' s Comprehensive Plan as adopted by the City Council on
September 10, 1981, recommends the initiation of a 40-Acre
Study of the Sycamore-Acker area, the boundaries of which are
Rice Street on the West, Sycamore and Granite on the North,
I-35E on the East and the Burlington Northern Railroad tracks
on the South, the area of survey being in excess of 40 acres;
and
WHEREAS, consistent with the said District 6 Land Use
Plan, the City Council, by its Resolution C.F. 277467, adopted
September 22, 1981, requested tha.t the Planning Commission
survey this Sycamore-Acker area under the provisions of the
40 acre statute, Minnesota Statutes Section 462.357, Subd. 5,
and report back to the City Council its findings and recommenda-
tions; and
WHEREAS, the Planning Commission, having conducted a public
hearing on November 20, 1981 on the proposed Zoning Code amendments
and having found and determined that the proposed amendments are
in keeping with existing uses and to a plan for future land use
in the area consistent with the Comprehensive Plan, the Planning
Commission has recommended its approval to the proposed rezoning;
and
WHEREAS, the City Council, having considered the report and
recommendation of the Planning Commission and having conducted
`� public hearings on the proposed Zoning Code amendments, does hereby

Dear Council Members :
On November 20, 1981 , the Plannin� Commission on a vote of 14 to 5
approved a resolution recommending a number of zoning changes in the
Sycamore-Acker area.
The proposed zoning code amendments are in response to the recommendation
in the District 6 Land Use Plan adopted by the City Council on
September 10, 1981 , that a 40 acre study of the Sycamore-Acker area be
initiated. The City Council initiated the 40 acre study September 22, 1981 .
The proposed rezonings have been reviewed by affected neighborhood residents,
the District 6 Land Use Task Force, and the District 6 Planning Council .
A public hearing was held before the Zoning Committee of the Planning Commission.
I am transmitting these zoning code amendments at the request of the
Planning Commission with my recommendation for your review and approval .

INTRODUCTION The District 6 Land Use Plan, adopted by the City Council
on September 10, 1981 , recommends the initiation of a
40 Acre Study of the Sycamore-Acker area under the

minimize land use conflict, to better reflect existing
land use, to define the direction of future commercial
and residential improvements in the area, and to create
greater confidence in the stability of the area in order
to encourage those improvements.

A. PuRPOSE: Zoning changes to minimize land use conflict, to better reflect existing land
use, to define the direction of future commercial and residential improvements in the
Sycamore-Acker area, and to create greater confidence in the stability of the area in
order to encourage those improvements.
B. STUDY INITIATION: The District 6 Land Use Plan, adopted by the Gity Council on
September 10, 1981 , recommends the initiation of a 4C Acre Study of the Sycamore-Acker
area under the Frovisions of the Minnesota Planning Statutes. The City Council initiated
the 40 Acre Study by Resolution No. 277467 on September 22, 1981 .
C. 40 ACRE STUDY: Section 462.357 of the Minnesota Planninq Statutes requires the Planning
Commission, to make the followina findings subsequent to a public hearinq before
recommending approval of any rezonings under a "40 Acre Study" to the City Council :
1 . That a survey in excess of 40 acres has been made.
2. That the number of real estate descriptions affected by such chan�es renders the
. obtaining of written consent impractical .
3. That the amendments are related to the overall needs of the community, to existina
land use, or to a plan for future land use.
4. That proper notice and hearing have been given pursuant to the state statutes.
D. FINDINGS: Regarding the above required findings:
1 . The survey area is in excess of 40 acres. The boundaries of the study area are

Zoning Committee of the Planning Commission was published on October 29, November 5,
and November 12, 1981 . In addition to the legally required notice, hearing notices
were sent to owners of property identified as , and property adjacent to, property

8. The proposed rezonings are the result of concensus in a workinq committee
formed by the District 6 Land Use Task Force, and made up of 2 area residents,
2 area businessmen, and a District 6 Council member from outside the Sycamore-
Acker area. After an imformational presentation, the District 6 Land Use
Committee and affected neighborhood residents supported the proposed rezonings
on a vote of 28 to 2.
On September 29th the District 6 Planning Council held a public hearin4 and
unanimously recommended approval of the proposed rezonings except that they
recommended the six lots immediately east of Dairy Queen and Fort Meyer & Lange
Printing Company be rezoned from T-1 to B-3. After reviewing the merits of
the District Council 's recommendation, planning staff amended the study to
concur with the District's recommendation.
E. RECOMMENDATION: Based on findings 1 through 8 above, staff recommends rezonings in
seven 7 distinct sub areas. The following presents the a) Location, b) Site/Area
. Conditions , c) Staff Findings , and d) Staff Recommendation for each area. The
general map key for this section is the same as that used on the public hearing
notices.
AREA 1 �
a. Location: Southeast corner Sycamore and Rice.
Le al Descri tion: Lots 2, 3, 4, 5, 6, 7, 16, 17, 18, 19, 20, 21 , Block 1 ,
Green s ddition.
b. Site/Area Conditions : Occupied by Dairy Queen and a printinq shop.
c. Staff Findings :
1 . The site was previously zoned light industry under the 1922 Zoninq Code.
2. The existing uses are permitted in a B-3 zone.
3. B-3 zoning provides a transition (buffer) zone between industrial and
residential land uses, and is beneficial to the surrounding community.
d. Staff Recommendation: Rezone from T-1 to B-3.
AREA 2
a. Location: South side Sycamore between Rice and Sylvan.
Legal Description: Lots 1 , 2, 12, 13, 14, 15, Block 1 , Lots 1 , 2, 3, 12, 13,
14, 15, Block 2, Jilson's Subdivision,
b. Site/Area Conditions: Occupied by single family homes and vacant lots. Many
of t e houses immediately across Sycamore from this area are on narrow lots.
c. Staff Findings :
1 . The site was previously zoned "6" Residence under the 1922 zoning code.
2. The Housing Policy Plan supports the modification of zoning to encourage
the construction of alternative housing types , and supports moderate density
as long as it conforms to the existing character of the neighborhood. The
. townhouse type development permitted under RT-2 zoning would be in harmony
with the density and character of this area of Sycamore.
3. A townhouse type residential development in this area would provide greater
buffering and separation between the adjacent industrial uses and Sycamore.
4. Upzoning to RT-2 would promote residential development on the vacant parcels ,
help to stabilize residential land use along Sycamore, and anchor the
residential link from the west to the east side of Oakland Cemetrary in
accordance with the recommendations of the District 6 Planning Council .
5. The proposed rezoning would be beneficial to the surrounding community.
d. Staff Recommendation: Rezone from RT-1 to RT-2.

On PJovember 20, 1981 , the Planning Commission on a vote of 14 to 5
approved a resolution recommending a number of zoning changes in the
Sycamore-Acker area.
The proposed zoning code amendments are in response to the recorr�nendation
in the District 6 Land Use Plan adopted by the City Council on
. September 10, 1981 , that a 40 acre study of the Sycamore-Acker area be
initiated. The City Council initiated the 40 acre study September 22, 1981 .
The proposed rezonings have been reviewed by affected neighborhood residents,
the District 6 Land Use Task Force, and the District 6 Planning Council .
A public hearing was held before the Zoning Committee of the Planning Commission.

INTRODUCTION The District 6 Land Use Plan, adopted by the City Council
on September 10, 1981 , recommends the initiation of a

b. Site/Area Conditions: Occupied by single family homes and vacant lots. Many
of the houses immediately across Sycamore from this area are on narrow lots.
c. Staff Findings:
1 . The site was previously zoned "B" Residence under the 1922 zoning code.
2. The Housing Policy Plan supports the modification of zoning to encourage
the construction of alternative housing types , and supports moderate density
as long as it conforms to the existing character of the neighborhood. The
� townhouse type develo�ment permitted under RT-2 zoning would be in harmony
with the density and character of this area of Sycamore.
3. A townhouse type residential development in this area would provide greater
buffering and separation between the adjacent industrial uses and Sycamore.
4. Upzoning to RT-2 would promote residential development on the vacant parcels,
help to stabilize residential land use along Sycamore, and anchor the
residential link from the west to the east side of Oakland Cemetrary in
accordance with the recommendations of the District 6 Planning Council . �
5. The proposed rezoning would be beneficial to the surrounding community.
d. Staff Recommendation: Rezone from RT-1 to RT-2.

Duties and responsibilities:
Under direction, to supervise, assign, and perform the work of installing,
maintaining and repairing electrical wiring and fixtures, police and
fire alarm apparatus, cables, traffic signals and controls, street;
lighting equipment, and similar equipment; and to perform related work
as assigned.
Examples of work performed: �
To supervise the work of electricians and other employees engaged in
installing and repairing either underground or overhead wires and
cables. �
To supervise the work involved in the installation, maintenance and repair
of traffic signals and controls and street lighting.
To see that all police and fire alarm boxes are kept in order and in good
repair.
To oversee .the installation of police and fire alarm boxes.
To repair high tension cables.
To be in charge in the absence of the General Foreman.
To supervise, assign and perform the work involved in instaZling main- .
taining, and repairing generators, motors, switchboards, control boards,
cut-outs, wall, floor, and ceiling receptacles, conduits, meters, fuse
boxes, lights, fans, heaters, bell and buzzer systems, fire aZarm systems,
signal systems, and all other electrical equipment and appliances.
To supervise and perfor� the work involved in the installation and repair
of electrical equipment.
To see that adequate electrical power is available.
To estimate quantities of materials needed.
To make reports and recommendations.
To keep records of materials, supplies, employees, and work performed.
l�iinimum qualifications:
Three years` experience as an Electrician or equivalent. Must possess a
Class A journeyman electrician license, or a maintenance electrician
license, issued by the State of Minnesota. In addition to Lhe above,
applicants for a vacancy in Independent School District No. 625 must
possess a master electrician license issued by the State of Minnesota
within six monLhs of appointment.

within six months of appointment.
