Lais at 409 Midwest Federal Building, an attorney representing Mr. and Mrs. Benshoof, Mr. and Mrs. Tomhave and Mr. Merth, who oppose the improvement of Simms Street. We wish to give you a brief history of the events preceding this hearing and then of the position of each of the opponents to this improve- � ment. The land in question was platted many years ago into relatively small lots, approximately 30 'x 110 ' . Simms Street was made a part of the plat without regard to the topography of the area which seems to preclude the extension of Simms Street because of a deep gully on the easterly end. A large portion of the land on the east end of the proposed improvement is owned by Mr. Cammish, who has owned the land for some time and has been allowing piece- meal development of properties on York and Case Streets so as to land lock the property except for Simms Street. There was a petition submitted for the improvement of Simms by the Shepherds who live on Case and have property on either side of Simms and by Lewis Sauers and Kenneth Tschida. From the beginning of the petition some time around the first of 1982, the people I represent have been approached by various parties, inclu- ding Mr. Sauer and Mr. Tschida representing that they owned the project and wished to develop the� street and various requests and offers for sale of land were made by their representations including Mr. Robert Hennen, who at one time made an offer to Mr. Tomhave. Al1 of these offers were verbal and, it .is my under- standing, until approximately a month ago, at which time the Public Works Department included Hazelwood as an aTternative for addi- tional improvement in the area since Simms would have been developed without an improved access to Simms. Following this, there were numerous offers by Mr.' Sauers and Mr: Tschida to purchase land from Mr. Tomhave and to compensate the Benshoofs. , � 7 � � � � St. Paul Council Members March 23, 1982 Page Two As recently as Tuesday, March 16, 1982, we were advised that Mr. Tschida was no longer associated with the project and was completely out of it and we were dealing with Mr. Sauers and Mr. Hennen. Offers were discussed at that time which were sub- stantially reduced from the offers made by Sauers and Tschida. At least they were different. Then I was advised that there was a falling out between Sauers and Hennen and now Mr. Hennen now has control of all of the Cammish property and, to my knowledge, is attempting to gain control of all other properties along Simms Street for possible development. On Friday, Mr. Hennen made an offer, copies of which offer I believe he has presented to the Council for the purchase of land from all of these parties. The offer to Mr. Merth is to pay the assessments that would be levied against him and his property in exchange for Mr. Merth deeding the westerly 50 ' of his 104 ' or 50� of his real estate in exchange for paying the assessments the City would levy against his property. Merth' s house presently has sewer and water through an easement running to York Street and access off unimproved Hazel- wood. It is apparent to me that there is no improvement in market value to the building site occupied by his house and that he now has sewer and water and access. I think the cases regarding such improvements clearly identify these factors as nonassessable. It is debateable as to whether or not the street, curb and gutter would improve market value in front of his house because of the house to the street right-of-way. In addition, Mr. Merth is retired and on a pension and is put in an untenable position by his inability to pay any assessments together with such a patently confiscatory offer on the part of Mr. Hennen. Mr. Tomhave owns a rather larger piece of lotsabutting Simms that are a part of his homesite on which he has a rather substantial valuable house. Because of the utilization of the homesite, he would diminish the value of the homesite should he sell off the southerly 4 lots. We believe that the value of the homesite would be diminished at least by the amount of the offer that Mr. Hennen has made and, in the meantime, he would also be absent the actual land contained within those 4 lots should he accept that offer. To levy an assessment against Mr. Tomhave for the Simms Street improve- ments would be unconscionable in my opinion as here again we believe that the amount. of the proposed assessment would exceed any market value improvement on the proposed lots or site. ,I I i � I � i i � . St. Paul Council Members March 23 , 1982 Page Three Both Tomhave and Merth join in the Petition presented to you opposing the improvement of Hazelwood substantially because of unwarranted assessments that would be levied against them and their inability to pay. It should be pointed out that Mr. Tomhave is a retired former City employee and he feels that he has been harassed by these offers and has been unable to leave town because of a constant need to appear at meetings and deal with this problem during the winter months. The Benshoofs have two lots abutting Simms. They have built a 1800 square foot home with super thick walls and insulation so as to make it very energy efficient and so placed it on the lot that they need and intend to use the southern two lots as a part of the whole building site. The ultimate improvement of Simms Avenue, they sincerely believe to depreciate the value of their property since it will destroy their privacy on the south and, since there are large substantial oak trees on the south lots it would substantially interfer with the construction of a home or require their removal. • ; Under the present proposal by Mr. Hennen, which is to purchase + the southerly 90 feet of this site for the sum of $6,000, the � Benshoofs find the proposal totally unacceptable as it would destroy the beauty and livability of the entire building site � by having an additional house constructed on the southerly two ' lots. In view of the problems posed for the other two objectors � and the Benshoofs, they join in objecting strenuously to the improvement of Simms Street and find that the offers as presented by IKr. Hennen are nothing but cruel hoaxes and posture himself ± as being fair in his effor to pursuade the Council to order the improvements. We would suggest that if he truly meant to be fair he would . simply agree to pay all or most of the proposed assessments so as � to enable him to make his profit on the development of the property he now has options on. Lais at 409 Midwest Federal Building, an attorney representing Mr. and Mrs. Benshoof, Mr. and Mrs. Tomhave and Mr. Merth, who oppose the improvement of Simms Street. We wish to give you a brief history of the events preceding this hearing and then of the position of each of the opponents to this improve- ment. The land in question was platted many years ago into relatively small lots, approximately 30 'x 110 ' . Simms Street was made a part of the plat without regard to the topography of the area which seems to preclude the extension of 5imms Street because of a deep gully on the easterly end. A large portion of the land on the east end of the proposed improvement is owned by Mr. Cammish, who has owned the land for some time and has been allowing piece- meal development of properties on York and Case Streets so as to land lock the property except for Simms Street. There was a petition submitted for the improvement of Simms by the Shepherds who live on Case and have property on either side of Simms and by Lewis Sauers and Kenneth Tschida. From the beginning of the petition some time around the first of 1982, the people I represent have been approached by various parties, inclu- ding Mr. Sauer and Mr. Tschida representing that they owned the project and wished to develop the street and various requests and offers for sale of land were made by their representations including Mr. Robert Hennen, who at one time made an offer to Mr. Tomhave. Al1 of these offers were verbal and, it is my under- standing, until approximately a month ago, at which time the Public Works Department included Hazelwood as an alternative for addi- tional improvement in the area since Simms would have been developed without an improved access to Simms. Following this , there were numerous offers by Mr. Sauers and Mr. Tschida to purchase land from Mr. Tomhave and to compensate the Benshoofs. _ � . �l ��c�V St. Paul Council Members March 23, 1982 . Page Two As recently as Tuesday, March 16, 1982, we were advised that Mr. Tschida was no longer associated with the project and was completely out of it and we were dealing with Mr. Sauers and Mr. Hennen. Offers were discussed at that time which were sub- stantially reduced from the offers made by Sauers and Tschida. At least they were different. Then I was advised that there was a falling out between Sauers and Hennen and now Mr. Hennen now has control of all of the Cammish property and, to my knowledge, is attempting to gain control of all other properties along Simms Street for possible development. On Friday, Mr. Hennen made an offer, copies of which offer I believe he has presented to the Council for the purchase of land from all of these parties. The offer to Mr. Merth is to pay the assessments that would be levied against him and his property in exchange for Mr. Merth deeding the westerly 50 ' of his 104 ' or 50% of his real estate in exchange for paying the assessments the City would levy against his property. Merth' s house presently has sewer and water through an easement running ta York Street and access off unimproved Hazel- wood. It is apparent to me that there is no improvement in market value to the building site occupied by his house and that he now has sewer and water and access. I think the cases regarding such improvements clearly identify these factors as nonassessable. It is debateable as to whether or not the street, curb and gutter would improve market value in front of his house because of the house to the street right-of-way. In addition, Mr. Merth is retired and on a pension and is put in an untenable position by his inability to pay any assessments together with such a patently confiscatory offer on the part of Mr. Hennen. Mr. Tomhave owns a rather larger piece of lots abutting Simms that are a part of his homesite on which he has a rather substantial valuable house. Because of the utilization of the homesite, he would diminish the value of the homesite should he sell off the southerly 4 lots. We believe that the value of the homesite would be diminished at least by the amount of the offer that Mr. Hennen has made and, in the meantime, he would also be absent the actual land contained within those 4 lots should he accept that offer. To levy an assessment against Mr. Tomhave for the Simms Street improve- ments would be unconscionable in my opinion as here again we believe that the amount of the proposed assessment would exceed any market value improvement on the proposed lots or site. . t • • • ,. � ! */ �i C.! • � St. Paul Council Members March 23, 1982 Page Three Both Tomhave and Merth join in the Petition presented to you opposing the improvement of Hazelwood substantially because of unwarranted assessments that would be levied against them and their inability to pay. It shpuld be pointed out that Mr. Tomhave is a retired former City employee and he feels that he has been harassed by these offers and has been unable to leave town because of a constant need to appear at meetings and deal with this problem during the winter months. The Benshoofs have two lots abutting Simms. They have built a 1800 square foot home with super thick walls and insulation so as to make it very energy efficient and so placed it on the lot that they need and intend to use the southern two lots as a part of the whole building site. The ultimate improvement of Simms Avenue, they sincerely believe to depreciate the value of their property since it will destroy their privacy on the south and, since there are large substantial oak trees on the south lots it would substantially interfer with the construction of a home or require their removal. Under the present proposal by Mr. Hennen, which is to purchase the southerly 90 feet of this site for the sum of $6 ,000, the Benshoofs find the proposal totally unacceptable as it would destroy the beauty and livability of the entire building site by having an additional house constructed on the southerly two lots. In view of the problems posed for the other two objectors and the Benshoofs, they join in objecting strenuously to the improvement of Simms Street and find that the offers as presented by IKr. Hennen are nothing but cruel hoaxes and posture himself as being fair in his effor to pursuade the Council to order the improvements. We would suggest that if he truly meant to be fair he would simply agree to pay all or most of the proposed assessments so as to enable him to make his profit on the development of the property he now has options on.
