Subject: Petition of Arthur Werthauser, et al, for the
vacation of portion of East Street.
Public Heaxing - Maxch 9, 1982
The pri.me petitioner, Arthur Werthauser, who owns the abutting property
to the Sauth, proposes to combine the South 1�2 of the vacated street
with his property to create a new plat and develop single fama.ly homes.
The North 1�2 of the va.ca�ed street will be used by the remaining property
dwners for personal use. The area petitioned. to be va.cated measures 66 feet
in width and 655 feet in length, containing an area of �+3,230 square feet
and is zoned R-l. The praposed vacation area, although platted as a street,
has not been improved or utilized for street purposes. The prime petitioner
will dedicate a new street to replace Ea.st Street. The ne�r street will
conform to the District 1 street plan and the requisements of the Department
of Public Works.
The Department of Public Works has no objections to the pro�posed va.cation.
They request, however, tY�.t the petitioner dedicate ar�y necessary turn-
around areas in the new platting. �
The staff of the Department of P.l�anning and Econamic Development has reviewed
the subject petition and, finds no ob�ection to the va.cation as proposed.
There were no objections or reco�nendations from any other public or private
a�encies involved.
In view of the fore�oir�g, I recoa.unend. the vacation be approved, subject to
the following terms and conditions:
l. That the description of the street to be vacated read
as follows;
All that part of East Street 7�ying west of
the West right-of way line oP McI4�ight Road
as widened and east of East right-of-way line
of-Springside Drive.
�� That the va.cation be sub�ect to all the terms and
conditions of Chapter 130 of the St. Pa.ul Legisla.tive
Code.

� ,,�: Tha.t the prime petitioner agree by acceptan of this
vacation to replat his adjacent property. d plat to
include the dedication of a permanent street in con-
formance with the approved street plan for the area and
acceptable to the Depa.rtment of Public Works of the City
of Saint Pa.ul. That if said plat is not approved by
Janua.ry l, 1985, this va.cation will become null and void.
3-�: Tha.t there be no requirement for compensation in view of
the required replatting and dedication of a new street.
�e5! Tha.t the prime petitioner agree by acceptance of this va-
cation to obta.in a written report from the Ramsey County
Soil and Water Conservation District, as to the suit-
ability of and requirements for building on the north�west
portion of his property. That the prime petitioner will
abide in all respects by any requirements set by the Ramsey
County Soil and Water Conservation District, so as to elimi-
nate a�y possible runoff damage to abuttin� properties
f�onting on Springside Drive.
�� TY�t the petitioner f�arnish the City with a bond in the
amount of $5,000.00, and by acceptance of the terms and
conditions of this vacation, agrees to indemnify, defend
and save ha.rmless the City of Saint Pa.ul, its officers and
employees from a11 suits, actions, or claims of ar�y character,
including, but not limited to, a claim brought because of
ar�y injuries, or 3amages received or sustained by arLy person,
persons or property, on account of this vacation; or because
of ar�y act or omission, neglect or misconduct of said petition-
ers; or because of aru claim or liability arising from or
based on any violation of ar�y law or regulation made in ac-
corda.nce with the law, whether by the petitioners or any of
their agents or employees.
