ACTION REQUESTED: p,pproval of Council Resolution to pay settlement � -
of two lawsuits arising out of "Discover St. Paul - 125th Bixthday
Celebration" in October of 1979 .
PURPOSE AND �2ATIONALE FOR THIS ACTION: These are the last of the claims
arising out of the Birthday celebration, which originated with the City
and involved the Historical Society and members of the community. The
cases were set for trial but were settled when plaintiffs_. agreed to
take less than their total bills. The services by Wood and Wilson
appear x�roper and should be paid by someone. The Historical Society
has contributed $1500 toward settlement. Originally, we thought we
could get Richard Taylor, the director of the celebration to be held
liable on the basis of unauthorized contracting. However., he has filed
bankruptcy. Also, he testified at his deposition that he told plaintiffs
that the City and/or the Historical Society would pay the contracts. We
did nothing to take away Taylor's authority. Therefore, the City should
pay these settlements.
FI?�T.ANCIAL IMPACT: The Community Services Department has $6,500 for this
purpose and ,the , remainder can be paid from the City Attorney's Office
Judgment and Comvromise fund. The City Council previously anproved _
payment of other birthday celebration bills in CF 775573 . At that �ime,
we were unaware of the Wood bill and did not know if the �lilson cl�im
was valid. �

WHEREAS, the Council of the City of St. Paul in CF 273657
did declare that it was in the public interest to memorialize
and celebrate the 125th anniversary of the City of St. Paul' s
incorporation; and
WHEREAS, the expenses incurred in such celebration exceeded
the revenue and there are no more funds in the Birthday Party
Committee; and
WHEREAS, Ray `�ood and Richard Wilson have sued the City of
St. Paul, the Ramsey County Historical Society and Richard Taylor,
director of the celebration, for expenses incurred in the produc-
tion of a television commercial and a song and records in connec-
tion with the St. Paul birthday celebration in October of 1979;
and
WHEREAS, Richard Taylor has filed bankruptcy; and
WHEREAS, the City Attorney's Office has investigated the
lawsuits and is of the opinion that services were actually
performed by Ray Wood and Richard Wilson and has negotiated a
settlement of those lawsuits; and
WHEREAS, pursuant to the settlement, Ray Wood and his attorney
Robert Healey have agreed to accept the amount of $2,200 in settle-
ment of their claim and Richard Wilson and his attorney Thomas Wurst
have agreed to accept the amount of $6,650 in settlement of their
claim; and
WHEREA5, the Ramsey County Historical Society has agreed to
contribute $1,000 to Richard Wilson and $500 to Ray Wood towards
