STARR, CITY ATTORNEY •... 647 City Hall, Saint Paul, Minnesota 55102 612-298-5121 GEORGE LATIMER MAYOR M E M 0 R A N D U M T0: Members of the Cit Council FROM: Beryl A. Nord Assistant City Attorney DATE: Ma.rch 10, 1982 RE: Resolution requesting payment to Leonar d Gasparre on behalf of Michael Gasparre This lawsuit arises out of an accident at Highland Swimming Pool. Michael Gasparre, a twelve-year old boy was cut in the head when ' exiting the swinning pool. Apparently, his head hit one of the starting blocks which had been set up for competitive swimming. He had twenty stitches because of the injury and has a two to three inch scar on his forehead. Suit was brought in District Court seeking thousands of dollars due to scarring and disfigurement. Although the negligence of city employees is questionable, this office recommends payment of $500 since the verdict at trial would undoubtedly be much higher if the plaintiff prevailed.
