RESOLVED, that upon execution and delivery of a release
in full to the City of Saint Paul, the proper City officers
are hereby authorized and directed to pay out of the Tort
Liability Fund, 09070-511-000, to Farmers Insurance Group
and Kent E. Charpentier, its attorney, the sum of $6, 250.00
in full settlement of its claim for dama.ges sustained on
April 25, 1975, as more particularly set out in a communication
to the City Council.

The claim of Farmers Insurance Company arises out of the activities
of former St. Paul police officer A1 Gorz which occurred on April
25, 1975. Some members of the Council may recall that the City
settled some issues arising out of this lawsuit in November, 1978.
It was the claim of Gorz that while he was sitting on his front
steps that a car went by and fired several shots into his home.
He pursued the car and eventually arrived at the Little Dipper
Bar. He claimed that he had reason to believe that the perpe-
trators of the act or persons knowing their identity would be
inside the bar. He entered the bar with his service revolver
and during a scuffle several people were shot and injured. The
City of St. Paul initially denied liability claiming that Gorz
was acting outside of his authority as a police officer and/or
his conduct was so wanton and reckless that the City of St. Paul
was not obligated to defend him. The 1978 settlements reflected
a compromise between the City, Gorz personal insurance carrier
and the owners of the bar. Left unresolved was the issue whether
the City of St. Paul was required to indemnify Gorz.
Farmers Insurance Group paid the full limits of its policy,
$25,000, in settlement of the injury claims. In addition,
almost $5,000 in attorney' s fees were generated. We have
reached a settlement with Farmers Insurance Group for the sum
of $6, 250. Our office recommends approval of this settlement.
