Stephenson )f� Assistant City Attorney�_��..� DATE: October 15, 1982 RE: Claim against the City of Saint Paul by Shirley A. Shaw The plaintiff, Shirley A. Sha.w, was injured on June 19, 1980 while participating in a softball game at Highland Park Soft�all Diamond No. 1. That field is owned by the School District, but is used and maintained by the City during the summer and is used by softball league teams during that period. Ms . Shaw was injured when she slid into base and received a large gash on her leg, just below her knee. The gash was caused by a nail or spike in the area of the base. There was a dispute in the witnesses testimony as to whether the spike was holding the base down and perhaps rose ciuring the course of play, ha.d been left over from a previous game or was simply debris unrelated to the playing of any ballgame. T'he laceration that the plaintiff suffered left her with a scar approximately 32 to 4 inches long and 1/4 to 1/3 inch wide. The experts differed as to the costs of surgical revision of the scar and the necessary time of convalesance following the surgery. Taking into account the cause of the injury, the resulting scar, past and future medical expenses , loss of time from work, plus pain and suffering, including periodic flareups and increased sensitivity in the area of the scar, this off ice approves settlement of this lawsuit in the amount of $10,000.
