1 WFIEREAS, an amendment to Section 135.12 of Council File No. 00-268, relating to
2 regulations for the protection of the public right of way was adopted on April 12, 2000; and
4 WI the amendment requires the denial of permits "... to any person who has
5 outstanding debt owed to the city"; and

WHEREAS, the amendment was not intended to apply to permit applicants, such as
District Energy, which have bonded indebtedness to the City which is being paid as and to the
extent required; and
WHEREAS, it is the intent of the Council that the language should be read and
interpreted by the appropriate administrative officials as reading "... to any person who has
outstanding debt owed to the Ciry in arrears, due, owing and unpaid' ; now, therefare, be it
RESOLVED, that the Council requests that the appropriate administrarion officials not
apply the above amendment to permit applicants, such as District Energy, which have bonded
indebtedness which is being paid as and to the extent required; and, be it
FURTHER RESOLVED, that such officials are requested to prepare and submit, within
30 days of the date of adoption of this resolution, corrective or housekeeping amendments to
Council File No. 00-268 for Council consideration and aciion, which amendments may use but
are not limited to the language in the last Whereas clause of this resolution.
