WHEREAS, Michael Palmer applied to the Board of Zoning Appeals
for a variance from the strict application of the provisions of
Section 62 .106 (4) and 62 .104 (11) of the Saint Paul Legislative
Code requiring that accessory buildings not exceed the ground floor
area of the main building for his property at 1236 Hubbard, located
on the south side of Hubbard between Syndicate and Griggs Avenue
for the purpose of constructing a 1s440 sq. ft. accessory building;
and
WHEREAS, Following a public hearing with notice to affected
property owners, the Board of Zoning Appeals by its Resolution No.
9194 adopted August 10, 1982, varied the provisions of the Zoning
Code so as to allow a 1,440 sq. ft. accessory building having a
floar area in excess of the main structure, the main structure
having 726 sq. ft. ; and
WHEREAS, Pursuant to the provisions of Section 64 .205, Thomas
Murphy and Susan Taufert duly filed with the City Clerk their appeal
from this determination made by the Board of Zoning Appeals, re-
questing that a hearing be held before the City Council for the
purpose of considering the actions taken by the said Board; and
WHEREAS, Acting pursuant to Sections 64 .205 through 64 .208,
and upon notice to appellants and other affected property owners,
a public hearing was duly conducted by the City Council on
September 30, 1982 where all interested parties were given an
opportunity to be heard; and

RESOLVE, That the Council of the City of Saint Paul does
hereby reverse the decision of the Board of Zoning Appeals in
this matter and does hereby deny the request for variances made
by Michael Palmer for the property located at 1236 Hubbard Avenue
for the following reasons:
(1) The property possesses no exceptional physical charac-
teristic upon to which to base a variance as required by the
Zoning Code because the site is a large� flat parcel and its
topography and shape are normal .
(2) It appears that the applicant for the variance has
created his own hardship by proposing a second accessary structure
that is 356 sq. ft. larger than the main structure and proposing
to build on a property line splitting Lots 6 and 7, Block 9,
Hersey-Woolsey Addition. A more appropriate building could be
designed for this site or a second main structure built on the
adjacent lot.
(3) The variance cannot be granted without substantial
detriment to the community or to the intent of the Zoning Code.
The intent of the Zoning Code is that accessory structures be
less in area and massing than are the main structures .
(4) The variance cannot be granted without substantial
detriment to the neighbors ' supply of light, air, health� safety
or property values . Overcrowding of structures and land will
negatively affect the character of the site and could adversely
affect property values in the area;

WHEREAS, MICHAEL PALMER has applied for a variance from the strict application
of the provisions of Section 62. 106(4) of the Saint Paul Legislative Code
pertaining to the maximum percent of lot coverage cf accessory structure (not
to exceed floor area of main structure) in an R-4 zoning district; and
k'HEREAS, the Saint Paul Board of Zoning Appeals conducted a public hearing on
July 27, 1982, pursuant to said appeal in accordance with the requirements of
Section 64.204 of the Legislative Code; and
I�'HEREAS, the Saint Paul Board of Zoning Appeals based upon evidence presented
at the public hearing, as substantially reflected in the minutes attached
. hereto, made the following findings of fact: ,
1 . ?he request for variance is based on the exceptional physical condition of
the property. The site is an exceptionally large parcel of land.
2. Strict application of the code regulations will result in exceptional
practical difficulty as distinguished from mere- inconvenience. IJithout the
variance, the applicant would not be able to build an accessory building
before constructing a single family structure.
3. The request for variance can be granted without substantial detriment- to
the community or intent of the code only if conditions are attached.
Section 62. 104(11 ) requires a 4' side yard setback from any side lot line.
The proposed building, as indicated on the site p1Gn , 'does not provide
this required side yard.
The applicant could at�ach Lots 6 and 7 in�o one parcel to meet code
