WHITE - CITV CLERK /�}.A��{�`�}�{� PINK - FINANCE GITY OF SAINT PAUL COUIICII r�i °' / m EANARV'- DEPARTMENT ��� / �,/ BLUE - MAVOR File NO. � � , � � uncil Resolution Presented By Referred To Committee: Date Out of Committee By Date WHEREAS, Limmie Wiggins, d/b/a Master Shoe Shine Parlor, is the holder of a Class D-Original Container License for the premises at 175 North Milton Street in St. Paul; and WHEREAS, the licensee' s neighbors requested a public hear- ing before the City Council of the City of St. Paul to present evidence that the ma.nner in which the licensee conducted his business caused it to become a nuisance and to recommend that the City Council revoke the licensee' s Class D-Original Container License; and WHEREAS, the above ground and recommendation were communi- cated to the licensee by letter dated September 14, 1982; and WHEREAS, the licensee, through his attorney, Jerome J. Holma.y, notified the License Inspector, Joseph Carchedi, by letter of September 23, 1982 that the licensee neither contested revocation of his license nor intended to be present at the September 30, 1982 hearing; and 4JHEREAS, a public hearing was held on September 30, 1982 at 7:30 p.m. at which many neighbors of the licensee testified; and WEIEREAS, the evidence established: l. That the neighborhood environment had clearly degenerated since the opening of the Ma.ster Shoe Shine Parlor; 2. That such drug sales and gambling draw large numbers of persons into the area surrounding the licensed premises; and � 4. That these same persons have engaged in the following acts to the reasonable annoyance, detriment and fright of the licensee' s neighbors: fighting and brawling, shootings, drug sales, gambling, disorderly conduct in the nature of obscene and abusive language and noisy and boisterous conduct, causing sidewalk and traffic congestion, urinating in public, and littering; and WHEREAS, the City Council considered the type and nature of the evidence submitted and based its determination on the overall weight of the evidence; and WHEREAS, the City Council determined that the licensee has created a substantial public nuisance and thereby violated St. Pau1 Legislative Code Section 310.06, Subd. 2(7) in that the activities of the licensee in the licensed activity have created a serious danger to the public health, safety or welfare, which is a basis for license suspension or revocation; and WHEREAS, the City Council voted 7 - 0 to revoke the licensee' s Class D-Original Container License; and WHEREAS, a copy of this resolution has been ma,iled to the attorney for the licensee prior to the date it was considered by the full Council with a letter advising as to the date on which it would be considered; no��, therefore, be it RESOLVED, that the Class D-Original Container License for the premises at 175 North Milton Street in St. Paul held by Limmie Wiggins, d/b/a Master Shoe Shine Parlor is hereby revoked; and, be it FURTHER RESOLVED, that such resolution is effective upon publication of this resolution; and, be it WHITE — CITV CLERK � /����j PINK — FINANCE �7 COUIICII g s �ANAI�V� DEPARTMENT GITY OF SAINT �Al1L File NO. e�uE — n�a.voR Council Resolution Presented By Referred To Committee: Date Out of Committee By Date Page 3.
