RESOLVED, That the proper City officials are hereby authorized
and directed to execute on behalf of the City a Lease Agreement
between the City and Payne-Minnehaha Community Council, approved
by the City Attorney, allowing the erection and maintenance of a
sign on city owned property described as follows :
"Subject to Street, and that part lying north of
Collins Street (Tedesco) , Lot 1, Block 11,
Warren and Winslow' s Addition to the town of
St. Paul" .

This letter is in response to your office' s request for comment
on the question of the Payne-Minnehaha Community Council's
original proposal about the possibility of acquiring the tri-
angular lot in Railroad Island bounded by Tedesco-DeSoto-Otsego
Streets. Members of PMCC met with the Land Use Committee of
the District Council recently and explained their reasons for
n (� (� the acquisition request for the purposes of maintaining the
��� ��� shrubbery and erecting a Railroad Island sign. They also in-
dicated that, upon further investigation, the group had decided
� that the best option for acquiring this land is to make a
lease arrangement with the City . The Land Use Committee saw
Q no problem with this request and upon their recommendation,
the District 5 Planning Council approved the request at their
board meeting on November 16, 1982 .

LEASE AGREEMENT
THIS LEASE AGREEMENT is made this day of 1982
by and between the City of Saint Paul, a municipal corporation, here-
inafter referred to as "City" and Payne-Minnehaha Community Council,
a neighborhood organization, hereinafter referred to as "Payne-
Minnehaha; "
WITNESSETH
The City, for One Dollar and other good and valuable consideration
and the covenants and agreement contained hereinafter, does hereby
demise and lease to Payne-Minnehaha premises owned by the City which
is legally described as follows, to-wit:
"Subject to Street, and the part lying north of Collins
Street (Tedesco) , Lot 1, Block 11, Warren and Winslow' s
Addition to the town of St. Paul" hereinafter referred
to as "Premises. "
To have and to hold same for and during the period of one (1)
year commencing December , 1982 and expiring on December ,
1983 inclusive, unless sooner terminated upon ninety (90) days written
notice by either party to the other, subject to the following covenants
and agreements:
I.
That the Premises shall be used by Payne-Minnehaha solely for the
purpose of erecting and maintaining a sign expressing the self-pride
of the Railroad Island neighborhood.
II.
That the nature of the sign, its placement and the manner in
which it must be maintained by Payne-Minnehaha must be submitted to
and approved in writing by the Director of the Department of Public

Works prior to any such sign being erected.
III.
That Payne-Minnehaha shall obtain all required permits for the
erection and maintenance of such a sign if permits are required.
IV.
That Payne-Minnehaha shall maintain th� erected sign and the
Premises in a clean and orderly manner in conformity with all local,
county, state or federal laws.
V.
That Payne-Minnehaha shall perform all such work at its own
cost and expense to the satisfaction of the Director of the Department
of Public Works.
VI.
That Payne-Minnehaha shall furnish and maintain during the term
of this lease separate certificate of public liability insurance in the
amount of $300, 000 for personal injuries and $300,000 for property
damage wherein the City shall be designated as a co-insured. Said
public liability insurance certificate shall be subject to the approval
of the City Attorney.
VII .
That Payne-Minnehaha shall not assign nor sublease its righ.ts.
and obligations under this lease without proper authorization from the
City Council for the City.
VIII.
That Payne--Minnehaha agrees that it will protect and defend,

save and keep the City forever harmless and indemnified against and
from any and all loss, cost, damage or expense arising out of or
from any accident or other occurrence on or about the premises caus-
ing injury to any person or property whether caused by the negligence
or acts of Payne-Minnehaha, the City or any other party or thing.
IX.
Upon termination or expiration of this lease Payne-Minnehaha shall
remove all improvements or objects from the Premises and shall peace-
fully surrender said Premises to the City in the same condition as
existed prior to the leasing of the Premises to Payne-Minnehaha, and
that Payne-Minnehaha thereafter shall have no claim or right to the
premises.
WITNESS, the parties hereto have approved the terms and conditions
of this lease as of the date first written above.
