An Ordinance amending Chapter 60 of the
Saint Pau1 Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes §462. 357 and §64 . 210
of the Legislative Code, Lloyd Flackey duly petitioned to rezone
Lot 2, Block 18, Beaver Lake Addition, located on the south side
of Stillwater between Hazel and Algonquin, fro�n B-2 to B-3 for
the purpose of expanding an auto body shop, the petition having
been certified by the Department of Finance and Management Services
on October 6, 1982 as having been consented to by at least 67g of
the owners of the area of the property to be rezoned, and further
having been consented to by at least two-thirds of the owners of
the property situated within 100 feet of the total contiguous
descriptions of real estate held by the same owner or any party
purchasing any such contiguous property within one year preceding
the date of the petition; and
WHEREAS, The current Zoning Committee on November 4, 1982
conducted a public hearing for the purpose of considering the
rezoning petition, and pursuant to Section 107 . 03 af the Admini-
strative Code, submitted its recommendation to the Planning Co�n-
�nission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on Nove�nber 5, 1982 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning p�tition was duly published in the official

WHEREAS, A public hearing before the City Council, having
been conducted on December 9 , 1982 where all interested persons
were heard, and the Council having considered all the facts and
recommendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the zoning map of the City of Saint Paul, Sheet No. 16 ,
as incorporated by reference in Section 60. 301 of the Saint Paul
Legislative Code, as a�nended, is hereby further amended as follows:
That property located on the south side of
Stillwater between Hazel and �lgonquin, being
more particularly described as Lot 2, Block 18,
Beaver Lake Addition,. be and is hereby rezoned
from B-2 to B-3.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Sir:
On November 4, 1982, the Zoning Committee of the Planning Commission held
a public hearing on this rezoning. The petitioner was present to answer
questions. Cathy Flackey testified that the proposed expansion of the
auto body shop would create two additional jobs. There was no opposing
testimony. A letter from one person who opposed the rezoning stated that the
proposed expansT�n would not be an improvement to the neighborhood. At the
close of the hearing, the Zoning Committee voted 7 to 0 to approve the rezoning.
On November 5, 1982, the Planning Commission considered the Zoning Committee's
recommendation and approved the rezoning by a vote of 17 to 0.
The rezoning is scheduled to be heard by the City Council on December 2, 1982.
Because the notice was not published in the newspaper in time to meet the
10-day public notice requirement, the staff is recommendinq that this rezoning
be laid over until the City Council meeting on December 9. Please notify me
if any member of the City Council wishes to have slides of the site presented
at the public hearing.

On J�2�, 1�59 a permit for an oversized driveway in conjunction with a fiiling station
was granted.
G. FINDINGS:
1 . Petitioner states that he has had his auto repair station at this location for
13 years. His use is therefore legally nonconforming.
2. Pe'�itioner presently has four stalls in his shop and wishes to add two more, thereby
necessitating this rezoning. �
3. Intended location of the B-3 district is along major traffic arteries or adjacent
to Cammunity Business (6-2) Districts.
4. Hazel and Stillwater are designated as collector streets in the Street and Highway
. Plan, not as major arteries.
5. The site would be adjacent to other B-2 property. �
6. The site is located in an isolated retail center. The Land Use Plan discourages
the expansion of these centers and encourages businesses to locate in appropriate
commercial clusters.
7. The Land Use Plan encourages the buffering ar removal of uses that conflict with
surrounding residential uses.
� 8. Tre Disatrict 2 Plan supports commercial development that is in harmony with
surrounding residential neighborhoods and not a detriment. .
9. Other uses permitted in the B-3 district are: funeral homes , business sales and.�
service, con+ractor's shops , printing, and publishing; and with permits : used car
lats , fast food restaurants , and car washes.
h. STAFF At�ALYSIS: This site is in a basically residential area. B-3 zoning and its
�ossible uses seem to create a more intense levei of activity than is warranted in
this location.

An Ordinance amending Chapter 60 of the

'� WHEREAS, Pursuant to Minnesota Statutes §462. 357 and §64 . 210
of the Legislative Code, Lloyd Flackey duly petitioned to rezone
Lot 2, Block 18 , Beaver Lake Addition, located on the south side
of Stillwater between Hazel and Algonquin, from B-2 to B-3 for
the purpose of expanding an auto body shop, the petition having
been certified by the Department of Finance and Management Services
on October 6, 1982 as having been consented to by at least 67$ of
the owners of the area of the property to be rezoned, and further
having been consented to by at least two-thirds of the owners of
tYie property situated within 100 feet of the total contiguous
descriptions of real estate held by the same owner or any party
purchasing any such contiguous property within one year preceding
the date of the petition; and
WHEREAS, The current Zoning Committee on November 4, 1982
conducted a public hearing for the purpose of considering the
rezoning petition, and pursuant to Section 107 . 03 of the Admini-
strative Code, submitted its recommendation to the Planning Com-
mission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on November 5, 1982 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

been certified by the Department of Pinance aad Management Services
on October 6, 1982 as having been consented to by at least 67� of
