� Chairman Glassman asked for a progress report from Alice Bijjani concerning
E Case Vo. 70- 82-H, 711 Sherburne , Appellant Alan Luymes , heard at the Nov-
f ember meeting, when P,is . Bijjani indicated the need for a further inspe�tion .
Following this , rir. Luymes and the housing code office were to try to
� reach agreement on a solution to the prohlem of a laundry tub which had
been reported after the initial city inspection to be improperly vented
and drained.
I�is . Bijjani stated that a plumbing inspector had looked at the laundry
`' - tub and confirmed the appellant' s description of the drain connec�ion and
that there was no problem tiaith sewer gas . She was concerned, however , that
the arrangement should not be sanctioned with a nermanent variance , since
a subsequent o�aner might be tempted to make a permanent drain connection
which might lead to a safety hazard. At present , the connection was only
a temporary one , and the appellant had been given an estimate of $500 to
make repairs by his plumber. She recommended granting a temnorary variance
effective until the next renewal period or the one following.
BOARD ACTION : rir. Knutson moved that a temporary variance be granted to
permit continued use of laundry tub in its present location until the time
of the next Certificate of Occuparicy renewal inspection. Mrs . Collins

because of financial hardship and practical difficulty .

PROCEEDINGS : Attorney Tina Isaac, representing the appellants , said that
er clients had owned the property since 195�. titThen nurchased, it was
being operated as a seven-unit building, but the Beelers later reduced
it to five units . The owners live in a first floor apartment . Apt . #1
� is also on the first floor, and the occupant has sole use of a bathroom
across the hall. The owners obtained a bid of $6 , 800 to incornorate a
bathroom tivithin tlie unit. Apt . #2 , on the second floor, is a 12 X 15 ft .
furnished room with its own bathroom, but there is no kitchen sink. It
would be difficult to install one because the plumbing wall is on the far
wall of the bathroom. Two plumbing contractors have advised the owners
that it would mean extensive remodeling. - N1s . Isaac said that I�Zr. Beeler
is in deteriorating health at age 78 , and the couple are dependent on
social security and the net rental income of $1 ,500 to $2 ,000 (annual
basis) for their livelihood. The Beelers asked that they be allowect to
continue to operate their building as it presently exists for as long as
they otan the property.
Ms . Bijjani said there iaas a problem in getting the owners to understand
what the city was rec{uiring, but the building was well-kept and the v'iola-
tions list was short . She noted a zoning problem, which could probably
fi�e easily resolved if the otaners would provide a letter stating they had
purchased the property prior to 1956 as . a seven-unit building.
D4s . Isaac said she would see that such a letter would be sent .
Ms . Bijjani suggested that , if the board should consider granting the
owners ' request for a variance , that it be limited to the period of the
Beelers ' oi,mership , since both Apt . #1 and Apt. #2 were substandard units
and it would not be advisable to permit the situation to exist in perpetuity.
BOARD ACTION: Mr. Gausman moved that variances of Section 34. 11 be granted,
to permit continued use of Apt . #1 where the bathroom is located outside
its walls , and to permit continued use of Apt . #2 where a kitchen sink
is lacking, effective only for the period of the nresent appellants '
ownership . Mrs . Bostrom seconded. MOTION CARRIED.

PROCEEDINGS : P.1r. Massey, Sr. , said he lives in one unit , one is used
y a son, and the third is also used by a son who is gone much of the time .
Ms . Bijjani explained that the arrangement of the units was poor, typical
of an illegal conversion. It is also in violation of zoning regulations
as it is approved for only two units . There is one unit on the first floor;
another is the remaining part of the first £loor and part of the second
floor; and the third unit is all on the second floor. The third floor
had been used in the past , also, but use had been discontinued. The units
are not separated f rom one another in a standard manner, although this is
not a code violation. Two of the units share use of one bathroom on the
second floor.

BOA�D ACTION : Mr. Knutson moved to grant a variance of Section 34. 11
to permit occupants of two apartments to share use of one b athroom, with
a limit of two persons in �ccupancy of Unit #2 , for the duration of
Fred Massey, Sr. ' s ownership , on condition that a11 remaining violations
listed in the city` s letter of Z/8/82 be corrected. Mr. Gausman seconded.
AZOTION CARRIED.
THE VOTE : Ayes - 5 Nays - 0 Abstentions - 0
Ms . Bijjani pointed out that all the work was to have been completed by
August 1982 , but there had been some difficulty in communicating with
Mr. Massey, who did not seem to understand what was required. Smoke
detectors shauld be put in without delay , and there were openings in the
chimney in the basement that should be sealed.
Fred Massey, Jr. , said the smoke detectors were being put in at this time ,
and he would see to the sealing of chimney openings .
BOARD ACTION: Mrs . Bostrom moved that an extension of time to May 14,
1 83, e granted to complete all corrections of violations listed in
the city' s letter, except for the shared bath item on which a variance
has been granted, and except for the reQuirement of smake detectors
an d the sealing of openings in the chimney in the b asement , which must
be taken care of lvithin 30 days as a condition for granting the six
month extension on remaining items . Mr. Knutson seconded. MOTION

PROCEEDINGS : Mr. Rabeschke explained that this building �aas similar to
the one in the previous appeal and operated under the same ownership. In
addition to the same type of code violations on this property , the otJners
were also appealing for a variance on the requirements for escape winc�ocvs
in sleeping rooms of two basement apartments , because the cost of instal-
ling larger windows to bring the sill height down to 48 inches from the
floor would be prohibitive .
BOARD ACTION: Mr. Gausman moved that an extension of time to June 1 , 1983,
e grante or completion of interior surface repairs as listed in the
city' s letter of 10/19/82 . Mrs . Bostrom seconded. MOTION CARRIED.

BOARD ACTION: Mr. Gausman moved that a variance of Section 13. 03, ner-
taining to self-closing devices and smoke doors within stair enclosures ,
be denied, but that a time extension of 90 days be granted for comnliance .

Mr. Rabeschke stated that the foundation walls were 18 inches thick, and
to install new windows would be very expensive .
Ms . Bijjani reported that these windows were very close to sill height
specifications for escape windows . Her office has recently been advising
owners , where the discrepancy is not too great , that some type of perinanent
installation of a step below the windotia to facilitate escape is satisfac-
tory , rather than tearing out walls . She requested that , if the board
considers granting the variance , it should include the proviso that the
escape window shall meet code requirements in all other respects .
A discussion of the proper size of �aindow opening for escape window�
ensued. Ms . Bijjani said the dimensions were listed in the violations
letter received by the owners . She emphasized that the size o£ the openable
area was important . A double-hung window' s open area would be half of
the size of the entire window. In some situations , replacement of a
double-hung window with a casement-type permits adeauate openable area.
BOARD ACTION: Mrs . Bostrom moved that a variance of Section 34. 13 be
granted, on condition that a permanent step be installed below the escape
windows of two basement sleeping rooms of sufficient height to bring them
no more than 48 inches from step-ton to the lower edge of the window in
each case by January 19 , 1983, and, in addition , i.f it is necessary to
replace the existing windows , a time extension to June 1 , 1983, shall be
granted. The foregoing motion shall be granted on condition that in aIl
other respects the escape windows meet code specifications . Mr. Knutson
seconded. MOTION CARRIED.

SUBJECT: Request variance of Section 33. 07, pertaining to fencing, to
perm t installation of three strands of b arbed wire at top of chain link
fence (height of 10 ft. already approved by city) , to deter vandalism.
APPEARANCE : Earl Breuer
PROCEEDINGS : Mr. Bre uer explained th at the school had experienced security
problems at their student parking lot and it was felt that placing three
strands of barbed wire at the top of the 10 ft. chain link fence would
discourage this type of activity. The school property occupied the entire
block, so there were no close neighbors to object. Adjoining blocks are
mainly commercial.
Jerry Kern sai-d it would be best .if the barbed wire would be placed so� it is
not touchable from the outside.
Mr. Breuer said the arms of the fence are alre ady placed up and out and
it would be difficult to change , but the fence is set back 15 ft . from the
surrounding sidewalk to prevent accidental contact by passersby. The
athletic field already has this type of fencing with barbed wire- -�his
tieing permissible and the only exception to the regulation against use of barbe
wire in the city code.
BOARD ACTION : Mr. Gausman moved that a variance of Section 33. 07 , per-
taining to encing, be granted, to permit installation of three strands
of barbed ivire at the top of a chain link fence around the student parking
lot . Mrs . Bostrom seconded. MOTION CARRIED.

PROCEEDINGS: P�Ir. Loose provided a sketch showing the layout of the base-
ment apartment with the bathroom located outside the unit. He had deter-
mined that the sewer line ran directly under the cement floor of the
apartment , so if reQuired to install a bath within the unit it would
mean digging up the floor. 'The existing. bathroom was kept locked by the
tenant , so it could not be used by unauthorized persons . The inspector
had noted that there was no window in the bathroom nor any means of
ventilation , arid had questioned whether the sink was vented. I�4r. Loose
said he did not object to correcting these deficiencies if a variance
would be granted.
Ms . Bijjani stated that the inspector had not signified any narticular
problems with the arrangement. -
BOARD ACTION : Mrs . Bostrom moved that a variance of Section 34. 11 be
granted to permit continued use of basement apartment where the bathroom
was located outside the unit . Mrs . Collins seconded. MOTION CARRIED.
