WHEREAS, because of the extraordinarily heavy snowfall
occurring on December 28, 1982, traffic in the City was paralyzed
with the attendant disruption entirely of all �nodes of public
transportation for many hours; and
WHEREAS, as a result of the said unusually heavy snowfall
many businesses were forced to close down and there were numerous
public service announcements over television and other news media
indicating that City offices �nay be inaccessible and were going
to be closed; now, therefore, be it
RESOLVED, that because of the disruption and confusion caused
by the heavy snowfall of December 28, 1982, during which some
employees reported for work and others did not, thinking that the
offices would be closed, and in an effort to treat all City em-
ployees in a fair manner, the Council of the City of Saint Paul
hereby declares that a floating holiday be granted to all City
employees for the specif_ic date of December 28, 1982; and, be it
scheduled o work�
FURTHER RESOLVED, that City e�np�oyee� �uho did not appear
for work on December 28, 1982 must use the floating holiday
�` December 28, 1982, and that those employees who did report for
work and remained at work for their full shift on Dece�nber 28,
1982, may use this floating holiday at some other date, provided
such date is approved by their supervisor.

Attached is Council File 280059, adopted by Council March 22, 1983,
which action i veto. I believe that the adverse weather policy
presently in place is both sound and fair. It provides
opportunities for employees to apply to adverse �aeather situations
various types of leave to which they are already entitled under
bargaining unit contracts. Because employees are granted leave
und�r provisions of their bargaining unit contracts, any changes to
these provisions should be addressed at the bargaininq table.
In takinc� this position, I wish to recount the recent history of the
matter. It came up initially in November of 1981, when adverse
weather caused a problem similar to that experienced on Decem�er 28,
1982. Between November and April, 1981 policy was drafted and
reviewed by department and office directors at my direction. �n
April 22, I signed an Executive Order implementing the policy. The
policy was distributed in June, 1982 to department and office
directors and to bargaining unit representatives, and again on
December 13, 1982 to department and office directors. They were
ir.structed, in turn, to disseminate the information once again to
i:heir employees.
During this period of policy develo�nent and implementation, there
was no arbitration regarding management's right to establish such a
policy, nor was there directian from Council on the matter .
So, to recapitulate: The establishment of new leave provisions is a
matter f or the bargaining process; moreover, to retroactively grant
additional holiday leave amounts to a gratuity, which the City
Attorney advises is illegal under Minnesota Statute. If the Council
as a body disagrees with this managemen� policy, certainly it may
consider putting new policy in place to cover adverse weather

possibility of a new policy with the Council and will, of course,
faithfully execute the policy finally adop�ed and approved. �

Attached please find a Council Resolution prepared by this office
which would establish a floating holiday to be used in regard to
the blizzard of December 28, 1982. I trust that the Resolution
has been constructed in the manner in which you desired. If not,
please contact me and I will be happy to revise it any way that
you think necessary.
You will note that the Resolution is not signed by a member of
the office of the City Attorney. We have reviewed this matter
rather extensively and it would appear to us that such a resolution
would be illegal inasmuch as there is no consideration on behalf
of the employees and therefore the granting of such a floating
holiday would in fact be a gift. However, as you know, resolutions
need not be signed by a City Attorney in order to be effective.
