WHEREAS, a utility easement running in favor of the Department of Public Works was retained in
vacated Arch Street per Council File #86-1737 and,
WHEREAS, the State of Minnesota wishes a release of said easement described as follows:
That portion of the 30 foot urility easement retained in vacated Arch Street per Council File # 86-
1737 dated December 30, 1986, lying within Lots 2 and 3, Block 2, Empire Builder Industrial
Park..
�o WHEREAS, based upon a utility easement Certificate of Intended Non-Use filed voluntarily on behalf
� i of the Department of Public Works, and made a part hereof by this reference and filed in the office of the
�z City Clerk of Saint Paul, the City for itself and on behalf of the Department of Public Works, waives the
ts right to utility easements in the area as described in the certificate incorporated herein.

is NOW, THEREFORE, BE IT RESOLVED, pursuant to Section 130.06 of the Saint Pau] Leg}slative
i6 Code and on behalf of the City of Saint Paul and those persons for whom the City has reserved

vacated Arch Street per Council File #86-1737 and,
WHEREAS, the State of Minnesota wishes a release of said easement described as follows:
That portion of the 30 foot urility easement retained in vacated Arch Street per Council File # 86-
1737 dated December 30, 1986, lying within Lots 2 and 3, Block 2, Empire Builder Industrial
Park..
�o WHEREAS, based upon a utility easement Certificate of Intended Non-Use filed voluntarily on behalf
� i of the Department of Public Works, and made a part hereof by this reference and filed in the office of the
�z City Clerk of Saint Paul, the City for itself and on behalf of the Department of Public Works, waives the
ts right to utility easements in the area as described in the certificate incorporated herein.

WHEREAS, the State of Minnesota wishes a release of said easement described as follows:
That portion of the 30 foot urility easement retained in vacated Arch Street per Council File # 86-
1737 dated December 30, 1986, lying within Lots 2 and 3, Block 2, Empire Builder Industrial
Park..
�o WHEREAS, based upon a utility easement Certificate of Intended Non-Use filed voluntarily on behalf
� i of the Department of Public Works, and made a part hereof by this reference and filed in the office of the
�z City Clerk of Saint Paul, the City for itself and on behalf of the Department of Public Works, waives the
ts right to utility easements in the area as described in the certificate incorporated herein.
