RESOLVED, That the Council of the City of Saint Paul does
hereby grant the appeal of Father Fred Mertz on behalf of
Assumption Church, 51 West Ninth Street, Saint Paul, Minnesota,
from the decision of the Heritage Preservation Commission denying
a building permit for the chimney removal at Assumption School at
68 Exchange Street, the City Council having concluded that the
removal of the said chimney will not adversely affect the appli-
cable Heritage Preservation Program for this Heritage Preservation
site and the City Clerk shall file a copy of this resolution with
the Building official, secretary of the Heritage Preservation
Commission, and Father Fred Mertz.

I am Father Fred Mertz of Assumption Church in downtown St, Paul.
In late November or early December, I appealed to the Heritage Preser- --
vation Commission to petition that we be allowed to remove two danger-
ous chimneys from the "old school." This is a safety measure. The
chimneys are non-functional. We would be happy to replace the chim-
neys in accordance with the criteria of the Preservation Commission
when we ge� the monies for this purpose. We have demonstrated our good _
faith by other things we have done in this building.
I would like to appeal their refusal to the City Council.
