The Partnership of Daco�a.h Investments, the prime pecitioner, requests the
referenced vaca�ion in order ;;o consolida�e �heir awnerships on bo-th sides of
the alley. They state tha� the vacation would facilitate 3eliveries and provide
for better control over current parking and access problems and also facilita.te
more comprehensive and flexible planning for the future of the block. They also
� feel that vacation of the alley wauld solve the existing problem of maintaining
Lheir steam, electrical and air conditioning lines running undernea.th and over
�he alley connecting their buildings.
This improved alley�ich opens onto Cedar Street is 12 feet wide by 150 feet
long, coritainin� 1,800 square feet. The abutting property is zoned B-�+.
The Department of public Works reviewed this proposed vacation and ha.s no ob-
� �ections subject to a condi�ion that the prime petiti.oner, Dacota.h Investment,
accepts ownership and responsibility for the existing underground sandrock storm
sewer between elevations 30 and 50 City Datum and the existing catch basin at
the east end of the propose3 vacation. The prime petitioner must buLk-head the
referenced sewer a� the Cedar Street outiet at his cost and expense, at such
time as the alley is no longer needed to carry storm drainage, all to the satis-
faction of tihe Sewer Engineer of the Department of Public Works.
The Department of Public Works also requests a condi�ion requiring that a11.ey
access not be denied to the remaining abutting property owners (Northwest
Publications Spector pa,rking and the YWCA) without their written approval.
The Department of Fire and. Safety Services initial�y objected to this vacation, ..
due to lack of access to the interior of the block for fire emer�ency. They have
withdrawn their ob�ections, hcrwever, with the rea.lization that existing sta.ir-
ways and appurtenances on the Dacotah Investments buildings into the alley,
prevent a fire vehicle from entering the alley. They ha.ve also withdrawn their
objections with the assurance that the existing �'f�TCA fire door will continue to
provide a safe exit from the YWCA building in the event of fire or other emer�ency.
The condition requested by the Department of Public Works requiring written
approval for removing access to the alley will also f�lfill the concerns of the
Depa.rtment of Fire and Safety Services.

Northwestern Bell Telephone Compa.ny reports tha.t they have a tunnel urbder this
alley extending from Cedar Street east to the end of the alley, 35 feet belar
the alley grade. In this tunnel, they have cables that rise up at the east
end and are attached to the va.rious building walls an�l provide telephone service
to the entixe block bounded by Ceda.r, Minnesota, Fourt�i and Kellogg Blvd. They
need access to this alley in order to attend to these c�bles at their above
ground locations. The petitioner is aware of this service and will work with
Northwestern Bell in any f�ture development.
The Department of Planning and Economic Development has .reviewed the above
cagtioned matter and finds no objection to the vacation as proposed.
There were no other objections or recommendations from any other public or private
agencies involved. In view of the foregoing, I recommend that the vacation be
approved, sub�ect to the following terms and conditions:
1. TY�t the description of the alley to be va.cated read as
foll�+rs:
All the East-West alley in Block 2�+, St. F�.ul
Proper lega.11y described as the Souther�y 12
feet of Lots 4, 5 and 6, Block 24, St. Pau1 Proper,
taken for alley purposes including ar�y slope ease-
ments and.the City's right to remova.l of lateral
support.
/ l�: That the vacation be sub3ect to all the terms and conditions
of Chapter 130 of the St. Paul Legislative Code, as amended,
including the retention of all pnblic utilities ea.sements.
� ,Z i3: That a specific easement be reta.ined to protect the interests
of Northwestern Bell Telephone Compar�y.
3 � That the prime petitioner, Da.cotah Investments, its successors
or assigns, by acceptance of this va.cation, also accepts re-
sponsibility for the existing underground sandrock storm sewer
between elevation 30 and 50 City Datum and the existing catch
basin at the easterly end of said alley.

on ar�y violation of ar�y law or regulation made in accordance
with the law, whether by the petitioner or ar�y of its agents

to convey to Dacotah Investments, by Quit Claim Deed, said alley, legally
described as follaws;

WHEREAS, That upon the petition of Dacotah Investments, that �
section of public alley hereinafter described, was vacated and
discontinued as public area in Council File No. 279981 adopted by
the Saint Paul City Council on March 15, 1983:
All the �ast-West alley in Block 24, St. Paul
Proper legally described as the Southerly 12
feet of Lots 4, 5 and 6, Block 24, St. Paul
Proper, taken for alley purposes including any
slope easements and the City's right to removal
of lateral support.
WHEREAS, Prior �o the cornpletion of the terms and conditions
of the above referenced vacation, Dacotah Investments transferred
ownership of the adjaining parcels, with John R. Rupp and Northwest
Publications, Inc. being the new owners of the adjoininy parcels;
NOW THEREFORE BE IT RESOLVED the original vacation resolution,
Council File No. 279981 shall be amended by striking the existing
paragraph 8 and adding a new paragraph No. 8 which reads as follows:
-- 8 . - That upon acceptance and compliance with the terms of this
vacation and subject to said terms and conditions, the proper City
officials are hereby authorized and directed to convey by Quit
Claim Deed those portions of alley as legally describ�d herein to the
parties as indicated:
To: John R. Rupp - The Southerly 12 feet of Lots 4, 5 and
6, Block 24, St. Paul proper, except the Easterly
44. 48 feet thereof.
To: Northwest Publications, Inc. , a Delaware corp. -
The Easterly 44.48 feet of the Southerly 12 feet
of Lots 4, 5 and 6, Block 24, St. Paul proper.
