WHEREAS, the Council of the City of Saint Paul , by Council Resolu-
tion C.F. 279748, adopted January 25, 1983 , did vacate a section of a
public alley in the City of Saint Paul, as specifically indicated in
said resolution; and
WHEREAS, said resolution imposed certain conditions and reserva-
tions as provided therein; and
WHEREAS, condition #2, as contained therein, is in need of being
amended.
NOTn1 THEREFORE BE IT RESOLVED that condition #2 in Council Resolu-
tion C.F. 279748 is hereby deleted and voided in its entirety and the
following is substituted therefore:
2. That no change in grade or surfacin�, nor buildings,
structures, trees , temporary structures, material
storage, fixtures or other objects that will affect
the natural drainage existing in this alley will be
permitted without written permission by the Sewer
Engineer of the Department of Public Works .
BE IT FURTHER RESOLVED, that in all other respects Council Resolu-
tion C.F. 279748 shall remain in full force and effect.

Subject: Petition of Housing and Redevelopment Authority, et al,
for the vacation of certain public alley
Public Hearing -- December 28, 1982
Public Hearing Rescheduled -- January 25, 1983
The Petitioners, the Housing and Redevelopment Authority of City of Saint Paul,
Minnesota (HRA) and Wallace W. Orfield, Sr. and Wallace Orfield, Jr. , respect-
fully state and allege they are the fee owners of record of the real estate
abutting that certain part of an alley described as follows, to wit:
That part of the North-South alley in Cochrane's Subdivision
of and addition to Block 11 Woodland Park addieion to the City
of Saint Paul, lying between the extentions across it or the
North and South lines of Lot one (1) of said Subdivision,
including any easements for slopes, cuts and fills, and any
rights to remove lateral support in said alley.
The total area to be vacated is 1,800 square feet and is zoned B-2 (Com�unity
Business District).
The Prime Petitfoner, HRA, pursuant to the provisions of the City-Wide Re-
development Plan, adopted and approved by the Council of the City of Saint
Paul on October 28, 1981, Council File No. 277600, states the proposed alley
vacation is required for development and rehabilitation of the Angus Hotel.
The Co-petitioners, Wallace Orfield, Sr. and Wallace Orfield, Jr. join with
said HRA to vacate that portion of the above described public alley in order
to achieve the objectives of the said Redevelopment Plan. The petitioner re-
quests no assessment of comp�nsation for the vacation because the value of the
accruals has been taken into account in the proposed selling price.
The Department of Public Works has no objections to the proposed vacation
subject to a surface drainage easement be retained over the proposed vacated
area for the drainage of this alley to Selby Avenue and subject to the certain
conditions stated later in this report.
Northwestern Bell Telephone Company has a main underground conduit system in
this alley comprising of six (6) ducts with six (6) cables rangin� up to
1200 pair. Some of these are trunk cables to Minneapolis as well as local
subscriber cables. This is an important underground facility to the telephone

company. They request that their easement rights in this vacation be
protected.
There were no objections, recommendations or restrictions received from any
other City department or utility comparLy.
In view of the foregoing, I recommend that the vacation be approved, subject
to the follvwing terms and conditions :
l. Th�.t the description of the portion of said alle�r to be
vacated be described as foll�rs:

draina.ge existing in this alley wil� be permi�ted without
written permission by the Sewer Engi�eer of the Departmen,t

� of Nortlzwestern Bell Telephone Compar�% w:.thin the vacated
alley area.
5. That there is no compensation to the City for this vacation
because the prime �etiti�ner, the Housing and Redevelo_pment
Authority, considered the value of the accruals in the sellin�
price of the adjacent lands.

6. That the petitioners shall file with the City a written covenenat
in such form as may be approved by the City Attorney, conditioned
to indemnify and hold the City harmless from any and all damages,
claims for damages, costs, charges and expenses of every kind
and nature arising or growing out of the vacation of said alley
described in this resolution.
