The basis for this recommendation is as follows: On December 2,1999 the Saint Paul police conducted a follow- up liquor compliance check at Kamp's, located at 1059 Wesfern Avenue North. Two individuals, one 18 years old and the other 20 years old, entered Kamp's and purchased a 12- pack of Miller Genuine Draft, went to the register and paid for it. The clerk did not ask either party for identification. It is a violation of Minn. Stat. §340A.503, subd.2 to sell or furnish alcohol to a person under the age of 21, and Saint Paul Legislative Code § 410.04(a)(1) prohibits a licensee or agent or employee thereof from delivering intosicating or nonintoxicating malt liquor to any person under the age of 21. Since this is considered a first violation, the licensing office will recommend a�500.00 fine, pursuant to St. Paul Legislative Code §404.26. At this time you have three options on how to proceed: Pa�e 2 Kamp's December ld, 1999 00 -33 If you do not dispute the above facts and do not �vish to have a public hearin„ you will need to pay the recotnmended fine for this violation. If this is your choice, you should make payment directly to the Office of License Inspections and Environmental Protection, Room 300 Lowry Professional Building, 350 Saint Peter Street, Saint Paul, Minnesota 5> 102. The letter should be directed to Ms. Christine Rozek. Payment of the fine will be considered to be a waiver of the hearing to ��hich you aze entitled. Alternatively, if you do not dispute the above facts, but wish to have a public hearing before the Saint Paul City Council, you will need to send me a letter with a statzment admitting the violation and requesting a hearinQ by Monday, December 20, 1999. The matter will then be scheduled before the City Council for a public hearing to determine what penalty, if any, to impose. You will have an opportunity to appear before the Council and make a statement on your own behalf as to the penaity to be imposed. 3. If you do dispute the above facts, a hearing will be scheduled before an Administrative Law Judge. At that hearing both you and the Ciry wili be able to appear and present witnesses, evidence, and cross-examine the other's witnesses. The St. Paul Cin� Council will ultimately decide the case. The reason for this Ietter is on December 2, 1999 one of my cashiers sold alcohol to a minor, a young lady who at the time was 20 years and 10 months old. Now, I understand, that anybody under 21 is illegal, I believe some circumstances led to my cashier's indiscretion. We were assisting the St, Paul Police Department at that time by notifying our customers about a level 3 rapist, Greg Welsh, who had moved into our neighborhood. In fact we were told that he had openly refused any treatrnent while in prison and had openly stated that he woutd commit these crimes again upon his release. We were giving handouts to ow customers and we had the notice posted in our store. The contact person, Sergeant Chris Nelson, of the St. Paut Police Dept. has contacted Mr. Reiter in reference to this matter as well. I also will tell you that Mr. Welsh is back in prison, where he should be thanks to Sergeant Nelson's persistence and hatd work. Approximately %s hour prioz to the compliance check Mr. Welsh came into our store and upan seeing his picture posted began screaming at Dawn Ellis, our cashier. He stated that "he would get her" along with many other derogatary comments. Ms. Ellis is a 60+-year-old woman who does not drive and is well known throughout our neighborhood because she walks from hear house on Westem ta Rice St. and also to the Como Lake area regulazly. The basis for this recommendation is as follows: On December 2,1999 the Saint Paul police conducted a follow- up liquor compliance check at Kamp's, located at 1059 Wesfern Avenue North. Two individuals, one 18 years old and the other 20 years old, entered Kamp's and purchased a 12- pack of Miller Genuine Draft, went to the register and paid for it. The clerk did not ask either party for identification. It is a violation of Minn. Stat. §340A.503, subd.2 to sell or furnish alcohol to a person under the age of 21, and Saint Paul Legislative Code § 410.04(a)(1) prohibits a licensee or agent or employee thereof from delivering intosicating or nonintoxicating malt liquor to any person under the age of 21. Since this is considered a first violation, the licensing office will recommend a�500.00 fine, pursuant to St. Paul Legislative Code §404.26. My family has been in tYie grocery business here in St. Paul since the turn of the century. We take great pride in the Iong history and integxity in which we have done husiness for nearly 100 years. The reason for this Ietter is on December 2, 1999 one of my cashiers sold alcohol to a minor, a young lady who at the time was 20 years and 10 months old. Now, I understand, that anybody under 21 is illegal, I believe some circumstances led to my cashier's indiscretion. We were assisting the St, Paul Police Department at that time by notifying our customers about a level 3 rapist, Greg Welsh, who had moved into our neighborhood. In fact we were told that he had openly refused any treatrnent while in prison and had openly stated that he woutd commit these crimes again upon his release. We were giving handouts to ow customers and we had the notice posted in our store. The contact person, Sergeant Chris Nelson, of the St. Paut Police Dept. has contacted Mr. Reiter in reference to this matter as well. I also will tell you that Mr. Welsh is back in prison, where he should be thanks to Sergeant Nelson's persistence and hatd work. Approximately %s hour prioz to the compliance check Mr. Welsh came into our store and upan seeing his picture posted began screaming at Dawn Ellis, our cashier. He stated that "he would get her" along with many other derogatary comments. Ms. Ellis is a 60+-year-old woman who does not drive and is well known throughout our neighborhood because she walks from hear house on Westem ta Rice St. and also to the Como Lake area regulazly. She was not able to either take a break or just go home for the evening to rel�. I say adamantly that Ms. Ellis is the best cashier that I've seen in my years in. the grocery business and even a better person. To be honest, we sell very little beer at our store and have considered eliminating it totally. If the council sees fit to either reduce or suspend the $500 suggested fine I would not object to eliminating it from my store if you deemed necessary. 'We have had a tough couple af months including a break-in, in which cartons of cigarettes were stolen and an armed robbery as well. My family has been in the grocery business here in St. Paul since the turn of the century. We talce great pride in the long history ar�d integrity in which we have done business for nearly 100 yeazs. The reason foz this Ietter is on December 2, 1999 one af my cashiers sold alcohol to a minor, a young lady who at the time was 20 years and 10 months old. Now, I understand, that anybody twder 21 is illegal, I believe some circumstances led to my cashier's indiscretion. We were assisting the St. Paul Police Department at that time by notifying our customers about a level 3 rapist, Greg Welsh, who had moved into our neighborhood. In fact we were told that he had openly refused any treatment while in prison and had openly stated that he woutd commit these crimes again upon his release. We were giving handonts to ow customers and we had the notice posted in our store. The contact person, Sergeant Chris Nelson, af the St. Paul Police Dept. has contacted Mr. Reiter in reference to this matter as well. I also will tell you that Mr. Welsh is back in prison, where he should be thanks to Sergeant Nelson's persistence and hard work. Approximately %z hour prior to the compliance check Mr. Welsh came into our store and upon seeing his picture posted began screaming at Dawn Ellis, our cashier. He stated that "he would get her" along with many other derogatory comnnents. Ms. Ellis is a 60+-year-old woman who does not drive and is well known throughout owr neighborhood because she walks from her house on Western to Rice St, and alsa to the Como Lake area regularly. She was not able to either take a break ar just go home for the evening to relax.l say adamautly that Ms. Ellis is the best cashier that I've seen in my years in the g�'ocezY business and even a better person. She takes great pride in her wozk and has a reputation as "The lady that "cards" (or checks the ID} of everyone". To be honest, we sell very little beer at aur store and have considered eliminating it totally. If the council sees fit to either reduce or suspend the $500 suggested fine I would not object to eliminating it from my store if you deeraed necessary. We have had a tough couple af months including a bre�k-in., in which oartons of cigarettes were stolen and an armed robbery as well. I planned on presenting this myself today, but the passing of my mather this week made it too tough time- wise. I appreciate the consideration and wish you all well. The basis for this recommendation is as follows: On December 2,1999 the Saint Paul police conducted a follow- up liquor compliance check at Kamp's, located at 1059 Wesfern Avenue North. Two individuals, one 18 years old and the other 20 years old, entered Kamp's and purchased a 12- pack of Miller Genuine Draft, went to the register and paid for it. The clerk did not ask either party for identification. It is a violation of Minn. Stat. §340A.503, subd.2 to sell or furnish alcohol to a person under the age of 21, and Saint Paul Legislative Code § 410.04(a)(1) prohibits a licensee or agent or employee thereof from delivering intosicating or nonintoxicating malt liquor to any person under the age of 21. Since this is considered a first violation, the licensing office will recommend a�500.00 fine, pursuant to St. Paul Legislative Code §404.26. The reason for this Ietter is on December 2, 1999 one of my cashiers sold alcohol to a minor, a young lady who at the time was 20 years and 10 months old. Now, I understand, that anybody under 21 is illegal, I believe some circumstances led to my cashier's indiscretion. We were assisting the St, Paul Police Department at that time by notifying our customers about a level 3 rapist, Greg Welsh, who had moved into our neighborhood. In fact we were told that he had openly refused any treatrnent while in prison and had openly stated that he woutd commit these crimes again upon his release. We were giving handouts to ow customers and we had the notice posted in our store. The contact person, Sergeant Chris Nelson, of the St. Paut Police Dept. has contacted Mr. Reiter in reference to this matter as well. I also will tell you that Mr. Welsh is back in prison, where he should be thanks to Sergeant Nelson's persistence and hatd work. Approximately %s hour prioz to the compliance check Mr. Welsh came into our store and upan seeing his picture posted began screaming at Dawn Ellis, our cashier. He stated that "he would get her" along with many other derogatary comments. Ms. Ellis is a 60+-year-old woman who does not drive and is well known throughout our neighborhood because she walks from hear house on Westem ta Rice St. and also to the Como Lake area regulazly. To be honest, we sell very little beer at our store and have considered eliminating it totally.
