BE IT RESOLVED, That the Council of the City of Saint Paul hereby
certifies and approves the action of the City of Saint Paul Board of
Appeals and Review pertaining to the following listed property and as
shown by the Excerpted Minutes of said Board of Appeals and Review,
dated February 8, 1983, and marked EXHIBIT A, and attached hereto and
made a part hereof by reference:

SUBJECT: Request variance of Section 35 . 03, pertaining to means of egress ,
to permit continued use of fire escape that ends at second floor level
rather tfian ground level, becakse: "tenants and owners prefer to keep it
that way."

PROCEEDINGS : Mr. Reynolds said there were two vacant buildings next to
his property that were frequently broken into and lived in illegally by
transients . His own property had been broken into four times recently, and
he felt there would be an even more serious security problem if the exter-
ior fire escape extended to ground level. He had several business rentals
� on the upper floors that would then be more accessible to breakins as well.
He said there was a spiral staircase , in addition to the interior main
stairway and the exterior fire escape , but it did not satisfy code require-
ments .
City building inspector, Don Wagner, stated that he could recommend that
the requested variance be granted if certain measures were taken to improve
fire safety for the tenants . The fire separation doors between the second
_ and third floors need a more adequate self-closing device ; the fire escape
was somewhat deteriorated and should be repaired; and the window leading
tp the fire eseape should be replaced with a hinge-type windo�a to improve
accessibility.
BOARD ACTION: Mr. Gausman moved to grant a variance of Section 35 . 03 to
�ermit continued use of fire escape ending at second floor level,
on condition that the fire senaration doors between second and third
�loors are equipped with U. L.-approved self closers , that the fire escape
i;s put in good repair, and that the double-hung window leading to the fire
escape is replaced with a hinge-type window. Mrs . Rostrom seconded.
MOTION CARRIED.

SUBJECT : Request variance of Section 34. 11 , pertaining to basic facili-
ties, to permit single occupants of two first floor dwelling units to
share use of one b athroom until appellant either moves in or sells the
property.
APPEARANCE : Leola M. Michels
PROCEEDINGS : Ms . Michels said there is a complete apartment on second
floor, but the £irst floor contains two small units , occupied by a single
tenant in each, who share a bathroom. She planned to move into the lower
floor herself at some time in the future , combining the two units into
one . If she decided against this plan for some reason and put it up
for sale instead, it could also revert to a duplex. All she asked

was a variance to permit the shared bathroom for as long as she owned
the property. For the present , she said her tenants �aere two young women
in their t��renties taho worked part-timeand attended law school at night,
and she did not want to evict either of them.
BOARD ACTION : Mr. Knutson moved that a variance of Section 34. 11 be
grante , to permit continued use of t�ao first floor dwelling units whose
tenants share use of one bathroom, on condition that no more than one
person occupy each unit , effective only for the period during which
it is owned by the appellant . P�Ir. Tilton seconded. MOTION CARRIED.
