WF�REAS, United States Supreme Court Justice Harry Blaclanun died on March 4, 1999 in Arlington, Virginia at the
age of 90; and
3 WFIEREAS, Jusrice Blaclanun moved to the City of Saint Paul in 1910 at the age of 2, grew up in the Dayton's Bluff
4 neighborhood, attended Van Buren Elementary School and graduated from Mechanic Arts High School, class of 1925;
5 and
6 WHEREAS, Jusrice Blaclanun left the City of Saint Paul to attend Harvazd College where he received a A.B. degee,
7 summa cum laude, in 1929 and a law degree in 1932; and
8 WHEREAS, he returned to Minnesota to practiced law at the firm Dorsey, Coleman , Bazker, Scott, and Bazber for over
9 18 yeazs and taught law at the Saint Paul College of Law (now William Mitchell College of Law) and at the University of
10 Minnesota; and
11 WHEREAS, he served as general counsel to the Mayo Clinic and Mayo Association in Rochester, Minnesota from 1950-
12 1959, and was subsequently appointed to the United States Court of Appeals, Eighth Circuit in 1959 by President
13 Eisenhower at the recommendafion of Senator Hubert H. Humphrey; and
14 WHEREAS, he served on the U.S. Court of Appeals with distinction writing over 200 opinions for the appeals court,
15 later ciring as his favorite a case called Jackson v. Bishop, which banned the use of whips for punishing prisoners in the
16 Arkansas prison system; and
17 WHEREAS, Justice Blackmun was appointed as Associate Justice of the U.S. Supreme Court in 1970 by President
1 S Richard Nixon and served on the Court from 1970-1994 and during which rime he was the author of numerous landmark
19 majority decisions of this narion's highest coiut which include: Roe v. Wade, which established a women's constiturional
20 right to abortion; Flood v. Kuhn, which upheld Major League Baseball's anti-trust exemption; County ofAllegheny v.
21 ACLU, which ruled religious symbols could not stand alone outside govemment buildings; and Lehman v. City of Shaker
22 Heights which allowed cities to regulate certain forms of outdoor advertising; and
23 WIIEREAS, he was one of only three Minnesotans to serve on the U.S. Supreme Court; and
24 WHEREAS, the Minnesota Aouse of Representarives failed to approve the placement of a bust honoring Justice
25 Blaclrniun at the entrance to the Minnesota Supreme Court chamber, opposite a bust of his colleague, fellow Minnesotan
26 and boyhood friend, U.S. Supreme Court Chief Jusrice Warren Burger; and
27 WFIEREAS, the creafion of the bust would take place under the supervision of the Minnesota Historical Society and the
28 funds for the project would be raised from private donarior.s; now therefare be it

29 RESOLVED, that the City of Saint Paul and the Ramsey County Board of Commissioners strongly support the effort to
30 rightfully honor Justice Blaclanun with a bust in the Minnesota State Capitol; and be it further
31 RESOLVED, that in the event the Minnesota Legislature fails to authorize the placement of a bust of Jusrice Blacl�un
32 in the State Capitol, the City of Saint Paul the Ramsey County Board of Comxnissioners extend an offer to the Minnesota
33 Aistorical Society and other interested parties to place such a bust, to be held in mist for the citizens of Minnesota, in the
34 Saint Paul City HalURamsey County Courthouse Building until such time it can be received at the Minnesota State
35 Capitol and placed outside the State Supreme Court Chambers.
