1 BE IT RESOLVED, that, upon the petition of Kevin Lam, as documented in Finance Deparhnent File
2 Number 25-1499, public properties hereinafter described aze hereby vacated and discontinued as public
3 property; and, subject to the herein stated exceptions, the easements within those public properties are
4 hereby released.

6 The property to be vacated is described as follows:

8 That part of the east-west alley in Block 2, Mackubin and Marshall's Addition to Saint Paul,
9 lying easterly of the southerly extension of the east line of I.ot 10, said Block 2.

11 This vacation shall be subject to the terms and condition of Chapter 130, codified Mazch 1, 1981, of the
12 Saint Paul Legislative Code as amended, and to the following conditions:

That the petitioners, their successors and assigns> shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 6� days of the effecuve date of this resolution.
That a permanent uuliry easement shall be retained on over, under and across the vacated area
from the west line of Arundel Street to 30 feet westerly, on behalf of the City of Saint Paul,
Department of Public Works to reserve the right of the City to maintain and operate any lighting
facility, in or upon said easement and to enter upon said easement or any portion thereof at any
time and from time to time, for the purposes of future construction, reconstruction, inspecung
maintaining or repairing the same or any part thereof. Said uulity easement shall be subject to
the following conditions:
a. No buildings structures, trees or any temporary structure, material storage, fixture, or any
other objects that will prohibit normal access to utility facilities for maintenance purposes
will be permitted within the easement uea.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be allowed by obtaining written permission from the
Deparlment of Public Works with the understanding that, in the event the City exercises
its reserved easement rights, the restoration and costs of such improvements shall be the
sole responsibility of the petiuoner, its successors and assigns.

5 any action or negligence of the peutioner, its employees, agents, or business invitees.

That the petitioners, their successors and assigns agree to indemnify, defend and save harmless the
City of Saint Paul, its officers and employees from all suits, actions or claims of any character
brought as a result of injuries or damages receaved or sustained by any person, persons or property
on account of this vacauon or petifioners' use of this property, including but not limited to, a
claim brought because of any act of omission, neglect, or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or regulauon made in
accordance with the law, whether by the peuuoners or any of their agents or employees.
24 7. That the petiUoners, their successors and assigns shall, within 60 days of the effective date of this
25 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution

I am requesting a date of Apri15, 2000 for a Public Hearing to approve the attached
Council Resolution. The purpose of the resolution is to vacate part of an alley in Block
2, Mackubin and Marshall's Addition, allowing the petitioners to fence off the access
and increase the privacy and security of the properties abutring the alley.
The utilities and usual City offices with rights to the area being vacated have all
responded to our inquiries regarding the proposed vacation. Their responses are with the
resolution as it is being routed for signatures.
I have attached a copy of the green sheet, the Council Resolution, and a map of the area
to be vacated. Please let me know if there is anything else you might need for this.

in the office of the City Clerk of Saint Paul, Minnesota, will be
heard and considered by the Saint Paul City Council at a meeting to
be held in the Council Chambers on the 3rd floor of City Hall and

We, the undersigned, respectful4y submit this petition to the Councii of the City of St.
Paul, to vacate its interest in that portion of a pubiic alley described as follows:
"That part of the east-west aNey in Bfock 2, Mackubin and Marshail's Addition, laying
easterly of the southerly extension of the east line of lot 10 of said Block 2."
7he reasons for this petition are as follows:
1. This ailey is a blind ailey with no exit , also cailed a dead-end alley. It is not being
used by the abutting property owners. There is no trash hau4er traffic.
2. That neariy half of this dead-end aliey was vacated as per Resolution No. 98-115,
dated February 14, 1998, and is fenced of4 by the owners.
3. That the remaining part of this dead-end ailey is constantly being used as a
dumping area for trash, glass bottfes and cans, broken furniture, bags af garbage.
4. That there is continuous day and night access to the ailey by individuals who use
the secluded areas to defecate/urinate and other ilficit activities.
5, That the Ramsey County Sheriff's Department has recommended the fencino af the
entire dead-end a11ey.
6. If the petition is granted, it is our intent to restrict access by means of a high woven
wire fence and gate, with a padiock, for use by authorized individuals and agencies.

The Department of Public Wor�CS has completed a review of the above referenced proposai. The
west end of the alley abuttina Lots 10 through i5, Block 2, Mackuhin and Mazshali's Addiaon was
vacated in February 1998. Now the neighbors are petitioning to vacate the remainder of the alley, the
east end abutting Lots 1 through 9 in said Block 2. Theze is cuzxendy a power pole in the alley about
20 feet west of the west line of Arundel Street. Access needs to be maintained to this pole for our City
lightin� feed. Theze£oze, the Department of Puhlic W orks has no objections to the vacation request,
subject to the following:
That a full width permanent utility easement shall be retained fxom the west 2ine of Arunde] Street to 30
feet westerly on, ovet, under and across the vacated portion of the above-refcrenced ailey, on behalf of
the Czty of Saint Paul Deparunent of Publie Works to reserve the right of the City [o maintain and
operate any liohdng facility, in or upon said easement and to enter upon said easement from ame to
time, for the purposes of future consuuction, reconstzucdon, inspecting, maintainin� or repairin� the
same or any part thereof.

1 BE IT RESOLVED, that, upon the petition of Kevin Lam, as documented in Finance Deparhnent File
2 Number 25-1499, public properties hereinafter described aze hereby vacated and discontinued as public
3 property; and, subject to the herein stated exceptions, the easements within those public properties are
4 hereby released.

8 That part of the east-west alley in Block 2, Mackubin and Marshall's Addition to Saint Paul,
9 lying easterly of the southerly extension of the east line of I.ot 10, said Block 2.

11 This vacation shall be subject to the terms and condition of Chapter 130, codified Mazch 1, 1981, of the
12 Saint Paul Legislative Code as amended, and to the following conditions:

That the petitioners, their successors and assigns> shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 6� days of the effecuve date of this resolution.
That a permanent uuliry easement shall be retained on over, under and across the vacated area
from the west line of Arundel Street to 30 feet westerly, on behalf of the City of Saint Paul,
Department of Public Works to reserve the right of the City to maintain and operate any lighting
facility, in or upon said easement and to enter upon said easement or any portion thereof at any
time and from time to time, for the purposes of future construction, reconstruction, inspecung
maintaining or repairing the same or any part thereof. Said uulity easement shall be subject to
the following conditions:
a. No buildings structures, trees or any temporary structure, material storage, fixture, or any
other objects that will prohibit normal access to utility facilities for maintenance purposes
will be permitted within the easement uea.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be allowed by obtaining written permission from the
Deparlment of Public Works with the understanding that, in the event the City exercises
its reserved easement rights, the restoration and costs of such improvements shall be the
sole responsibility of the petiuoner, its successors and assigns.

I am requesting a date of Apri15, 2000 for a Public Hearing to approve the attached
Council Resolution. The purpose of the resolution is to vacate part of an alley in Block
2, Mackubin and Marshall's Addition, allowing the petitioners to fence off the access
and increase the privacy and security of the properties abutring the alley.
The utilities and usual City offices with rights to the area being vacated have all
responded to our inquiries regarding the proposed vacation. Their responses are with the
resolution as it is being routed for signatures.
I have attached a copy of the green sheet, the Council Resolution, and a map of the area
to be vacated. Please let me know if there is anything else you might need for this.

We, the undersigned, respectful4y submit this petition to the Councii of the City of St.
Paul, to vacate its interest in that portion of a pubiic alley described as follows:
"That part of the east-west aNey in Bfock 2, Mackubin and Marshail's Addition, laying
easterly of the southerly extension of the east line of lot 10 of said Block 2."
7he reasons for this petition are as follows:
1. This ailey is a blind ailey with no exit , also cailed a dead-end alley. It is not being
used by the abutting property owners. There is no trash hau4er traffic.
2. That neariy half of this dead-end aliey was vacated as per Resolution No. 98-115,
dated February 14, 1998, and is fenced of4 by the owners.
3. That the remaining part of this dead-end ailey is constantly being used as a
dumping area for trash, glass bottfes and cans, broken furniture, bags af garbage.
4. That there is continuous day and night access to the ailey by individuals who use
the secluded areas to defecate/urinate and other ilficit activities.
5, That the Ramsey County Sheriff's Department has recommended the fencino af the
entire dead-end a11ey.
6. If the petition is granted, it is our intent to restrict access by means of a high woven
wire fence and gate, with a padiock, for use by authorized individuals and agencies.

The Department of Public Wor�CS has completed a review of the above referenced proposai. The
west end of the alley abuttina Lots 10 through i5, Block 2, Mackuhin and Mazshali's Addiaon was
vacated in February 1998. Now the neighbors are petitioning to vacate the remainder of the alley, the
east end abutting Lots 1 through 9 in said Block 2. Theze is cuzxendy a power pole in the alley about
20 feet west of the west line of Arundel Street. Access needs to be maintained to this pole for our City
lightin� feed. Theze£oze, the Department of Puhlic W orks has no objections to the vacation request,
subject to the following:
That a full width permanent utility easement shall be retained fxom the west 2ine of Arunde] Street to 30
feet westerly on, ovet, under and across the vacated portion of the above-refcrenced ailey, on behalf of
the Czty of Saint Paul Deparunent of Publie Works to reserve the right of the City [o maintain and
operate any liohdng facility, in or upon said easement and to enter upon said easement from ame to
time, for the purposes of future consuuction, reconstzucdon, inspecting, maintainin� or repairin� the
same or any part thereof.

1 BE IT RESOLVED, that, upon the petition of Kevin Lam, as documented in Finance Deparhnent File
2 Number 25-1499, public properties hereinafter described aze hereby vacated and discontinued as public
3 property; and, subject to the herein stated exceptions, the easements within those public properties are
4 hereby released.

8 That part of the east-west alley in Block 2, Mackubin and Marshall's Addition to Saint Paul,
9 lying easterly of the southerly extension of the east line of I.ot 10, said Block 2.

11 This vacation shall be subject to the terms and condition of Chapter 130, codified Mazch 1, 1981, of the
12 Saint Paul Legislative Code as amended, and to the following conditions:

That the petitioners, their successors and assigns> shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 6� days of the effecuve date of this resolution.
That a permanent uuliry easement shall be retained on over, under and across the vacated area
from the west line of Arundel Street to 30 feet westerly, on behalf of the City of Saint Paul,
Department of Public Works to reserve the right of the City to maintain and operate any lighting
facility, in or upon said easement and to enter upon said easement or any portion thereof at any
time and from time to time, for the purposes of future construction, reconstruction, inspecung
maintaining or repairing the same or any part thereof. Said uulity easement shall be subject to
the following conditions:
a. No buildings structures, trees or any temporary structure, material storage, fixture, or any
other objects that will prohibit normal access to utility facilities for maintenance purposes
will be permitted within the easement uea.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be allowed by obtaining written permission from the
Deparlment of Public Works with the understanding that, in the event the City exercises
its reserved easement rights, the restoration and costs of such improvements shall be the
sole responsibility of the petiuoner, its successors and assigns.

I am requesting a date of Apri15, 2000 for a Public Hearing to approve the attached
Council Resolution. The purpose of the resolution is to vacate part of an alley in Block
2, Mackubin and Marshall's Addition, allowing the petitioners to fence off the access
and increase the privacy and security of the properties abutring the alley.
The utilities and usual City offices with rights to the area being vacated have all
responded to our inquiries regarding the proposed vacation. Their responses are with the
resolution as it is being routed for signatures.
I have attached a copy of the green sheet, the Council Resolution, and a map of the area
to be vacated. Please let me know if there is anything else you might need for this.

We, the undersigned, respectful4y submit this petition to the Councii of the City of St.
Paul, to vacate its interest in that portion of a pubiic alley described as follows:
"That part of the east-west aNey in Bfock 2, Mackubin and Marshail's Addition, laying
easterly of the southerly extension of the east line of lot 10 of said Block 2."
7he reasons for this petition are as follows:
1. This ailey is a blind ailey with no exit , also cailed a dead-end alley. It is not being
used by the abutting property owners. There is no trash hau4er traffic.
2. That neariy half of this dead-end aliey was vacated as per Resolution No. 98-115,
dated February 14, 1998, and is fenced of4 by the owners.
3. That the remaining part of this dead-end ailey is constantly being used as a
dumping area for trash, glass bottfes and cans, broken furniture, bags af garbage.
4. That there is continuous day and night access to the ailey by individuals who use
the secluded areas to defecate/urinate and other ilficit activities.
5, That the Ramsey County Sheriff's Department has recommended the fencino af the
entire dead-end a11ey.
6. If the petition is granted, it is our intent to restrict access by means of a high woven
wire fence and gate, with a padiock, for use by authorized individuals and agencies.

The Department of Public Wor�CS has completed a review of the above referenced proposai. The
west end of the alley abuttina Lots 10 through i5, Block 2, Mackuhin and Mazshali's Addiaon was
vacated in February 1998. Now the neighbors are petitioning to vacate the remainder of the alley, the
east end abutting Lots 1 through 9 in said Block 2. Theze is cuzxendy a power pole in the alley about
20 feet west of the west line of Arundel Street. Access needs to be maintained to this pole for our City
lightin� feed. Theze£oze, the Department of Puhlic W orks has no objections to the vacation request,
subject to the following:
That a full width permanent utility easement shall be retained fxom the west 2ine of Arunde] Street to 30
feet westerly on, ovet, under and across the vacated portion of the above-refcrenced ailey, on behalf of
the Czty of Saint Paul Deparunent of Publie Works to reserve the right of the City [o maintain and
operate any liohdng facility, in or upon said easement and to enter upon said easement from ame to
time, for the purposes of future consuuction, reconstzucdon, inspecting, maintainin� or repairin� the
same or any part thereof.
