An Ordinance amending Chapter 60 of the
� Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning �naps thereof.
WHEREAS, Pursuant to Minnesota Statutes §462. 357 and �64. 210
of the Legislative Code, �Ioward Bream, Bream Built, Inc. , duly
petitioned to rezone Lots 33, 34, 35, Block 2, Rosedale Park,
located on the north side of Grand between Prior and Cleveland,
fro�n 8-2 to Rl`-2-2 to permit construction of a 30-unit condominium,
the petition having been certified by the Department of Finance
and Management Services on rTove�nber 9, 1982 as having been con-
sented to by at least 67% of the owners of the area of the property
to be rezoned, and further having been consented to by at least
two-thirds of the owners of the property situated within 100 feet
of the total contiguous descriptions of real estate held by the
same owner or any party purchasing any such contiguous property
within one year preceding the date of the petition; and
WHEREAS, The current Zoning Committee on January 6, 1982
conducted a public hearing for the purpose of considering the
rezoning petition, and pursuant to Section 107. 03 of the Ad�nini-
strative Code, submitted its recommendation to the Planning Com-
mission that the petition be granted; and
Wh'EREAS, The Planning Conunission considered the rezoning
�etition at its �neeting held on January 14, 1983 and recommenc?ed
that the City Council approve the petition; and
WHEREAS, Notice of. a public hearing before the City Council
on the said rezoning petition was duly published in the official

WHEREAS, A public hearing before the City Council, having
been conducted on February 3, 1983 where all interested persons
were heard, and the Council having considered all the facts and
recommendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 17,
as incorporated by reference in Section 60. 301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located on the north side of Grand
Avenue between Prior and Cleveland, being more
particularly described as Lots 33, 34, 35, Block

Section 2.
This ordinance shall take effect and be in force thirty (30)

On December 2, 1982, the Zoning Committee of the Planning Commission held a
public hearing on this proposed rezoning. The applicant requested a 2-week
layover, and District 14 requested a one-month layover. The Committee
voted to lay the matter for one month, until January 6.
On January 6 the hearing was reopened. A letter in support was received
from District 14. At the close of the hearing, the Zoning Committee voted
5 to 0 to approve the rezoninq.
On January 14, 1983 the Planning Commission upheld the Zoning Committee's
recommendation on a vote of 14 to 0.
This rezoning is scheduled •to be heard by the City Council on February 3,
1983. Please notify me by February 2 if any member of the City Council
wishes to have slides of the site presented at the public hearing.

The meeting was chaired by James Bryan, Chairman.
BREAM BUILT, INC. (#9289) : Rezone from B-2 to RM-2 to permit construction
of a 30-unit condominium at 2013-2027 Grand Avenue.
The applicant was not present. There was opposition present at the hearinq.
Ms. James showed slides of the site and reviewed the staff report with a
recommendation for approval . A letter was received from Paul Esch of Bream
Built, Inc. requesting the matter be laid over to December 16, 1982. One
letter was received ,in support.
Ralph Davies , 2014 Grand Avenue, testified in opposition because of the
insufficient number of parking spaces proposed and the existing congestion
on Grand Avenue.
Kathy Tarnowski , representing District 14, stated that the District Council
would hold their monthly meeting on Decemher 16 and could not res�ond to
tl�e proposal if it were laid over to Decemder 16.
Hearing no further testimony, Mr. Bryan closed the public hearing portion of
the meeting.
Ms. Summers moved to lay the matter over to January 6, 1982, to allow time
for District 14 to review. Ms. Karns seconded the motion, which passed on
a unanimous voice vote.

D. EXISTING LAND USE: Site used for parking, with 2 garages, paved parking lot, and small
corr�nercial structure.

East: Low & medium density residential (RM-2)
South: Low & medium density residential (RM-2)

F. ZONING HISTORY:
1 . Prior to 1975 the area was zoned commercial .
2. In September 1967, a permit for an 8-car parking lot on Lots 33 and 34 was approved.
3. In 1975 the site was zoned B-2.
4. In October 1977, the City Attorney determined that a "short form" petition to rezone
to RM-2 was unacceptable, and that consent signatures were needed. The rezoning
was dropped.
5. In 1978, th.e Wisconsin Province of the Society of Jesus requested a Determination
of Similar Use for the construction of a college building. The matter was laid
over indefinitely. �
G. FINDINGS:
1 . Petitioner proposes combining Lots 33-35 with Lot 36, which is already zoned RM-2,
and constructing a 30-unit condominium. The units will be 1- and 2-bedrooms.
2. The 4 lots will permit 53 rooms at RM-2 density. Applicant proposes 30 units and
underground parking of 36 spaces. This, permits a density bonus of 300 sq. ft. per
dwelling unit, or 15 additional rooms, for a total of 68 rooms. A total of 34
one bedroom units or 22' two bedroom units would be permitted on the site by the
. Zoning Code.
3. The District 14 Housing Development Plan recommends 6-7 two bedroom condominium,
units for these lots.
4. The District 14 Plan recommends a mix of housing types while retaining the
residential quality of the district.
5. A preliminary recommendation of the Grand Avenue West Task Force is to rezone these
lots to RM-2. .
6. The Housing Policy Plan recommends alternatives to single family detached housing
(Policy 1-1 ); the construction of smaller 1-3 bedroom ownership units (Policy 1 -2) ;
and medium density housing adjacent to neighborhood commercial areas (Policy 1 -5) .

Dear Mr. Bryan,
This is to advise you of the unanimous support of the District 14
Community Council for the re-zoning of the three lots at 2013-2027
Grand Avenue so that Bream Homes can build a 30 unit condominium on
the lots at 2009 to 2027 Grand. This support was based on the
following:
1. A majority of neighbors attending a meeting of the Housing and
Land Use Committee of the council on the proposed development
were in support of multiple housing on these lots rather than
a commercial use.
2. The District 14 Housing Development Plan supports high density
housing on Grand which is a bus route and collector street,
providing that adequate off-street parking is provided. The
Bream proposal of 36 underground parking spaces and 16 off-street
parking spaces was considered adequate for 30 units.
3. The District 14 Housing Development Plan recommends that two
of these lots (which are considered "under-utilized"), 2013 to 2019,
be used for owner occupied multiple unit housing rather than
commercial uses. It also suggests that those sites would be
good ones for elderly housing (which is needed in the district).
4. The draft of the recommendations of the Grand Avenue West Task
Force recommends re-zoning these lots for use as medium density

5. The city's Housing Policy Plan recommends encouragement of
alternatives to single family, detached housing; construction
of new smaller 1 to 3 bedroom ownership units in the city; and
medium density housing ad�acent to neighborhood commercial areas.
The popularity of the Wilder townhsouses was an indication
' of the need in our area for such housing.
6. With the present B-2 zoning, a three story apartment building
could be constructed on the site as long as there is commercial
use on the first floor.
