Preservation, and they were listed as number one priority on
District 6 Planning Council ' s list of priorities as of April 8,
1983 , and
WHEREAS , the owners of the property agree not to appeal the
amount of appraisal ,
BE IT RESOLVED, that the Council hereby orders an appraisal
of said properties, the descr.iption of the properties being as
follows :
Lots 4 through 13 , Bernardine Addition, and that
part of Lot 29 , Cottage Home Addition lying north
of the Northesn Pacific Railroad right-of-way,
except the west 30 feet , and also except the north
250 feet thereof.

Dear Council Members:
Attached is C.F. 280997, dated October 6 , 1983, which resolution
I veto.
The attached resolution orders appraisal of certain parcels.
The resolution gives as the reason for ordering the appraisal
the possible acquisition of the parcels for bluff preser-
vation. The issue of acquiring the subject parcels has been
reviewed extensively over the last seve.ral years. The
responsible departments, Comr.iunity Services (Division of
Parks and Recreation) and Planning and Economic Development
(Planning Division) , do not find that it would be in the
public interest to acquire the subject properties. Based on
their analysis and recommendation, therefore, I have not
presented to the City Council a request for acquisition nor
have I authorized the Department of Finance and Management
Services (Valuations and Enqineering Division) to undertake
an appraisal for purposes of acquisition.
The subject properties are not on the Wheelock Pkwy, bluff
and are not needed for scenic view preservation, From my
perspective, then, there is no public interest served by
providing the owners of the property an appraisal of the
barcels at public expense .

August 24th the Land Use Task Force (subcomr.littee of the D6PC)
again reviewed the proposed redevelopment oz property located
to the east and west of the plotted street of Cohansey. Said
property owner�s are Mr. Bies and T�'Ir. Ostrand. '
The committee reiterated "they are not opposed to potential re- • �
development". � However, a need exists to carefully investigate
the feasioility of new construction on various sections of the
Wheelock Bluffs or sloped areas.
� A study of the Arlington-Wheelock Slopes prepared by the P�innesota
._ Soil and Water Conservation District in 1981 indicates tnat said
- property has a slope steepness in the 25/ - 30;� range. ine
minimum slope steepness within the vicinity of said property is '
in t�e 19/ range. �

- Uniform Bilding Code: Chapter 70, Excavation and Grading, adopted
� � 1976 requires the city to issue Excavation and Fill Perrnits. A
Site Plan Review by the City oi St. .Paul is required on any slope
steepness greater than 12%. Therefore, I believe the Land Use
� . Task Force would feel comfortable supportin� the Site Plan Review
Process providing the com�ittee would be involved utilizing the
existing channels of cor,imunication.
� It is important that City Council understand that the Site Plan
Review Process may reiterate the infeasibility of new construction
to said property and/or enforce redevelopment restrictions that
may constitute an economically infeasible redevelopment project.

. Whi1.e deveiopment ad�acent to the three streets discussed above, may be most
likely, development of the steep slope areas is not excluded. The disturbed
portions of the slopes, due to their extreme slope, would r�quire extensive
regrading to provide any type ofi conventional building sites . A siynificant
engineering effort would undoubtably be needed to construct structures on or
in these slopes.
Develop��;" of the undisturbed portion of the slopes w911 also requir�e
extensive regrading to provide s�reets, utilities and build�:,� si�es. This
process will liable the area to severe ero�ion problems , 7he potential
sediment damage.to ad�acent storm sewers fniets and properties is great.
The choice may be made to limit development in this zone ta those portions
that are out of the steep slope area . If so, then a plan for reclamation
of the disturbed areas should be developed and carried out. The portion of
the report on existing slope conditions may serve as a first phase planning
tool in determtning which probiems should receive a higher priority.
� B) Bluff Zone II
, _ As can_be seen on map 8, one-thirc� to one-half of this area is in c�ty owner-
sfifp. The slope sections that remain eligible for development are ii , iii ,
part of iv, and vi . These are discussed b�low in terms o� their limitations '
to development. They are listed in their order of erosion potential with
the area of highest potential first:

� of the ditch, Erosion control during construction is essential . Any
proposed plat should be accompanied by an erosior� control pian. The
, plat should be evaluated in terms of ho+� sto �� a�er runoff wi11 be
.handled after development to ensure a long ter�n erosion problem
does not develop.
i1i) Although slopes are shorter here• than in some o` the other areas,
they are also steeper. In addition, any sedimen�t caused by er°osfon
during development will result in sediment damage to the properties
at the base of the hill , The part of the area draining to the
Arlington storm servers may also cause sedfinent clogging of these if
erosion during development is not controlled. Again, any plat plan
should be accompanied by an erosion control plan. The h�ndling of
storniwater runoff after development should also be evaluated prior
to plat approval .

existing channels of communication.
� It is important that City Council understand that the Site Plan
Review Process may reiterate the infeasibility of new construction
to said property and/or enforce redevelopment restrictions that
may constitute an economically infeasible redevelopment project.

the cemetery over the disturbed slope face is needed.
, Whil.e deveiopment ad�acent to the three streets discussed above, may be most
likely, development of the steep slope areas is not excluded. The disturbed
portions of the slopes, due to their extreme slope, woutd require extensive
regrading to provide any type of canventional building sites . A siynificant
engineering effort would undoubtably be needed to construct structures on or
in these slopes.
Developm-;" of the undisturbed portion of the slopes wiil also require
extensive regr�ading to provide streets, utilities and buildi��g sites. This
process wi11 liable the area to severe era�?on prablems, 7he potential
sediment damage,to ad3acent storm sewers iniets and proaerties is great.
The choice may be made to limit developcnent in this zane ta those portions
that are out of the steep slope area. If so, then a plan for reclamation
of the disturbed areas shouid be developed and carried out. The portion of
the report ort existing slope conditions may serve as a first phase planning
tool in determining which problems should receive a higher priority.
• B) Bluff Zone II
, As can be seen on map 8, one-thir� to one-�alf of this ar�a is 1n city owner-
ship. The slope sections that remain eligible for development are ii , iii ,
part of iv, and vi . These are discussed below in terms of their ljmitations '
to development. They are listed in their order of erosion potentiai with
the area of highest potential first:

� • vi)� Slope length and slope steepness renders this ar�a r�ost prc�e to
. erosion. Sediment from this site would be delivered to the railroad
=�' =s�. ,,�;�-,__�; ditch. Uncontrolled erosion during development could cause blockage
• of the ditch. Erosion control during construction is essential . Any
proposed plat should be accompanied by an erosion control plan. The
. plat should be evaluated in terms of hoN storrrrwater runoff wi11 be
.handted after development to ensure a long term eros9on problem
does not develop.
iii) Although slopes are shorter here� than in some of the ott�er areas,
they are also steeper. In addition, any sediment caused by e�osion
during development Nili result in sediment damage to th� prop2rties
at the base of the hill , The part of the area draining to the
Artington storm sexers may also cause sediment clogging of these if
erosion during development is not controlled. Again, any plat plan
should be accompanied by an erosion control plan. The h�ndling of
storniwater runoff after development should also be evaluated prior
to plat approval .

RE: APPRAISAL OF GEORGE OSTRAND'S PROPERTY
You are considering a council resolution to authorize
an appraiser for the subject property. Because the property
in question has no public use, and would nat be acquired
by any of the City departments for their use, I question
the need for an appraisal. It seems to me that an appraisal
would simply render a valuable service to a private in-
dividual at taxpayer ' s expense . The service in question,
independent appraisal of private property, is not normally
considered a public service and is not one afforded by the
City to individual property owners.
Also, the Valuation Engineer has made an appraisal of this
property. This appraisal was done by the Valuation Engineer
in response to Council ' s interest in this matter . Mr . Donovan
reported those results in August, 1982 .
