C.F. 279981 adopted March 15, 1983, at the request of Dac�otah Investn�nts, did
vacate a portion of public alley as specifically described in said resolution; and
W.E�REA.S, at the request of Dacotah Invest�nexits, the tiure period. for cc�npliance
with the ternis and oonditions of said resolution have been e��t�ended on three
different occasions with the most reoent ext�exLSion changing the date for c�liance
to October 15� 1983 in Council Resolution C.F. 280865; and
WHEREA,S, Dac�otah Investments now requests it be granted an extension of tim�
to cc�rply with condition #6 of the original Resolution C.F. 279981; specifically
that they be grant�ed an exten�ion of time for payment of the required c�pensation
of $22,500.00 to lae paid as follaws:
$11,250.00 tA be paid by October 15, 1983 and the remaining $11,250.00
to be paid by October 15, 1984.
NpW TI�REPiORE BE IT RESOLVED that the amended Council Resolution C.F. 279981
originally adapted March 15, 1983 is amerrded in regards to coridition #6, in that
the $22,500.00 aonpensation will be paid as follaas:
$11,250.00 tr� be paid by October 15, 1983 and the remaining $11r250.00
to be paid by Octobex 15, 1984.
BE IT FU�R RESOLVED that in all other respects including the date for
compliance for all other conditions of amended Council Resolution C.F. 279981
originally acbpted March 15, 1983 shall reznain in full force and effect.

catch basin at the easterly end of said alley.
4 . That the prime petitioner must bulk-head said
sewer at the Cedar Street outlet at his cost and
expense, at such time as tne alley is no longer
needed to carry storm drainage, all to the satis-
faction of the Sewer Engineer of the Department
of Public Works .
5 . That access to the a11ey be not denied to any of
the abutting property owners without their written
approval.
6 . That the petitioner pay to the City as market value
the sum of $22, 500 .00 as compensation for the
vacation.
7 . That the petitioner furnish the City with a bond in
the amount of $2, 000.00, and by acceptance of the
terms and conditions of this vacation agrees to
indemnify, defend and save harmless the City of
Saint Paul, its officers and employees from all
suits, actions, or claims of any character, includ-
ing but not limited to, a claim brought because of
� any injuries, or damages received or sustained by
any person, persons or property, on account of this
vacation; or because of any act or omission, neglect
or mi.sconduct of said petitioner; or because of any
claim or liability arising from or based on any
violation of any law or regulation made in accordance
with the law, whether by the petitioner or any of
its agents or employees .
