RESOLVED, That the appeal of Stephen Markoe from the decision

and that the City Council does hereby vary the provisions of Section

be installed over the rafters of the accessory structure and that
stairs to the storage area may be located outside the accessory

Dear Sir:
� On July 26, 1983, the Board of Zoning Appeals held a public hearing on the
application of Stephen Markoe to consider a variance of _code provisions that
limit garage structures to one story. Staff recorrrnended approval of a 2-story
structure on the condition that no heating, plumbing or electrical systems be
installed over the rafters (within the second story) except that one light
opening be allowed to illuminate the storage area; and that stairs to the
storage area be inside the accessory structure.
The Board reviewed the correspondence on the matter and heard public
• testimony. The applicant asked that the conditions regarding lighting the
� second story and relocating the stairs not be required. There was discussion
of the special conditions recorrdnended. The Board decided to not restrict the
number of lights in the second story but to impose the other conditions
�including requiring relocating the stairs.
On August 24, 1983, Mr. Stephen Markoe filed an appeal of the Board's
decision. Mr. Markoe bases his appeal upon the contention that the Board
erred in their determination that the stairway would endanger public safety,
or alter the aesthetics of the site.
The St. Paul Legislative Code, Section 64.206(2) states in part: "In granting
a variance, the city council or board of appeals may attach thereto such
conditions regarding the location, character, and other features of the
proposed uses as it deem reasonable in furtherance of the purpose of this
code and to protect adjacent properties" . The City Council must determine if
the Board of Zoning Appeals erred in imposing conditions .outlined in the
resolution.

A. PURPOSE: To consider a variance to permit construction of garage stairs and
servi e door to utilize a second story for storage purposes.
B. PARCEL SIZE: 40' frontage on Selby by 150' for 6,000 square feet of total lot
area.
SITE & AREA CONDITIONS: The site is occupied by a single family residential
uil ing with a new y constructed detached 2-story garage. The surrounmding area
is primarily single family dwellings interspersed by duplexes �•and multi-family
residences. ��
D. ZONING CODE CITATION: Section 62.106(3) states accessory buildings shall not
excee one story or 14 feet in height, provided however, that such buildings used
for the housing of passenger motor vehicles may exceed 14 feet in height but
shall not exceed 18 feet in height. �
E. FINDINGS: '
1 . The applicant proposes to utilize present space above rafters of a garage
structure for storage.
2. The request for variance is based on the physical conctition of the parcel ,
and the design and condition of existing development on the site.
3. Strict application of code provisions would result in undue hardship as
distinguished from mere inconvenience by reason of the physical condition of
the property. Applicant would not be able to utilize storage space above
rafters without variance.
� 4. The request for variance can be granted without substantial detriment to the
community or intent of the code only if conditions are attached. One intent
of the code is to maintain the use of the accessory structure as clearly
� incidental to the principal structure. This intent is met if the use of the
� second 1eve1 of the garage is limited to storage. �
5. The request for variance can be granted without substantial detriment to the
neighbors ' supply of light and air, health, safety or property values only if
conditions are attached. One purpose of the code is to maintain open space
and the character of the immediate neighborhood. This purpose is met if the
exterior stairway were relocated to the inside of the garage structure.
6. The request for variance does not appear to be based primarily on a desire
� for economic gain.
F. STAFF RECOMMENDATION: Based on findings 2 through 6, staff recorrrnends that the

WHEREAS, Stephen A. Markoe has applied for a variance from the strict
application of the provisions of Section 62.106(3) of the Saint Paul
Legislative Code that limit the height of accessory to one story in an R-3
zoning di.strict; and
WHEREAS, the Saint Pau1 Board of Zoning Appeals conducted a public f�ar�ng
on July 26, 1983, pursuant to said appeal in accordance with the
requirements of Section 64.204 of the Legislative Code; and
WHEREAS, the Saint Paul Board of Zoning Appeals based uporr evidence
presented at the public hearing, as substantially reflected in the minutes, �
made the following findings of fact:
1 . The applicant proposes to utilize present space above rafters of a
garage structure for storage.
2. The request for variance is based on the physical condition of t�e �
parcel , and the design and condition of existing development on the
site.
3. Strict application of code provisions would result in undue hardship as
� distinguished from mere inconvenience by reason of the�'physical ;
condition of the property. Applicant would not be able to utilize
storage space above the rafters without variance.
4. The request for variance can he granted without substantial detriment
� to the community or intent of the code only if conditions are attached. .
� One intent of the cod? is to maintain the use of the accessory
structure as clearly incidental to the principal structure, This
intent is met if the use of the second level of the garage is limited
to storage.
5. The request for variance can be granted without substantial detriment
to the neighbors ' supply of light and air, health, ,safety or property
values only if conditions are attached. One purpose of the code is to
maintain open space and the character of the immediate neighborhood.
This purpose is met if the exterior stairway were relocated to the
inside of the garage structure.
6. The request for variance does not appear to be based primarily on a
desire for economic gain.
NDW, THEREFO�E, BE IT RESOLVED, by the Saint Paul Board of Zoning Appeals
that the provisions of Section 62.106(3) be hereby waived to allow
construction of a storage area above rafters of a garage located at 1937
Selby .on the condition that no heating or plumbing be installed over the
rafters of the accessory structure, and that stairs to the storage area be
inside the accessory structure only with all other construction in
accordance with the application for variance and the site plan on file with
the St. Pau1 Planning Division.

The meeting was chaired by Sam Grais, Vice-Chairman.
STEPHEN A. MARKOE (#9415) : Variance request to permit construction of
garage sta�rs an service door to utilize a second story for storage
purposes at 1937 Selby Avenue.
The applicant was present. There was no opposition present at the hearing.
Mr. Haider showed slides of the site and reviewed the staff report �with a •,
recomnendation for approval on the condition that no heating, plumbing or
electrical systems be installed over the rafters of the accessory '
structure except that one light opening be allowed to illuminate the storage
area; and that stairs to the storage area be inside the accessory
structure. Three letters were received in support, one was from Merriam .
Park Community Council .
Stephen Markoe, 1937 Selby, explained that he was involved with the Boy �
Scouts and one of the functions of this space is going to be storage of
their equipment. If the stairway is located inside as recomnended by
staff, they will have to alter the truss structure cutting through at least
one of the trusses to install the stairway. They will ;�ose a car storage
area within the lower part of the building and at least 30 to 40 sq. ft. in
the upper part of the building. They would have to install inside the
upper portion some kind of safety railing to comply with safety requirments
which would make it difficult to move canoes up and down the stairway into
the storage area. The interior stairway would also present a natural fire
access if there were a fire in the lower garage portion. He stated that he
would like to have more than one electrical opening in the storage area and
.' that he had no intention of putting in a housing unit.
Dennis Grogan, owner of Grogan Construction, reported that the garage is
6'7" from the east property line. They are proposing to put on a 3' wide
.�stairway_reducing the side yard setback to 3'7" from the Applicant's
board-on-board p�rivacy fence. The original drawing showed a 4' side yard
setback with the stairway located on the west end of the building. Because
of the fact that the side yard setback to his westerly neighbor's fence is
still wide enough that he could access the back yard with a motor vehicle,
they decided not to close off that vehicle access so they moved the garage
further to the west in order to facilitate putting the stairway on the
easterly end of the building and still have a 3'7" setback to the property
line. -

Hearing no further testimony, Mr. Grais closed the public hearing portion �
of the meeting. -
Mr. Woods moved approval of the variance based on findings 2 through� 6,
� subject to the conditions recommended by staff. Mr. Kirk seconded the
motion.
Mr. Osborn then moved to amend the original motion to include that lighting
be allowed to illuminate the storage area. Mr. Woods and Mr. Kirk accepted
the amended motion, which passed on a roll call vote of 6 to 0.

. The Merriam Park Community Council 's Housing Committee has reviet•aed
the variance request of Mr. Markoe, 1937 Selby Avenue, to allow a �
two story garage.
The Housi�ng Committee voted to support the variance, as it would
allow the present garage space to be converted into a walk-up storage
attic. Committee members viewed the project as a desirabte use which
would add to the value of the property.
