An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes § 462 . 357 and § 64 .210
of the Legislative Code, John Wess duly petitioned to rezone Lots 5
and 6, Block 2, Thomas Subdivision of Lot 1, Bass Acre Lots,
located at 405 and 409 Maryland, from P-1 to B-3 for the purpose
of permitting sale of inerchandise on parking lot and for future
expansion, the petition having been certified by the Department of
Finance and Management Services on April 21, 1983 as having been
consented to by at least 67� of the owners of the area of the
property to be rezoned, and further having been consented to by at
least two-thirds of the owners of the property situated within 100
feet of the total contiguous descriptions of real estate held by
the same owner or any party purchasing any such contiguous property
within one year preceding the date of the petition; and
WHEREAS, The current Zoning Committee on May 19 , 1983 conducted
a public hearing for the purpose of considering the rezoning petition,
and pursuant to Section 107.03 of the Administrative Code, submitted
its recommendation to the Planning Commission that the petition be
granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on May 27, 1983 and recommended that
the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

WHEREAS, A public hearing before the City Council, having been
conducted on July 7, 1983 where all interested persons were heard,
and the Council having considered all the facts and recommendations
concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the zoning map of the City of Saint Paul, Sheet No. 5,
as incorporated by reference in Section 60. 301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located at 405 and 409 Maryland,
being more particularly described as Lots 5 and
6, Block 2, Thomas Subdivision of Lot 1, Bass
Acre Lots, be and is hereby rezoned from P-1
to B-3.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Sir:
On May 19, 1983, the Zoning Com�nittee of the Planning Commission held a
public hearing on this rezoning. The petitioner and his attorney were
present and testified. A letter from District 5 was received supporting
the rezoning. At the close of the hearing, the Committee voted 5-1 to
approve the rezoning based on finding 4 of the staff report, the fact that
the property was zoned commercial prior to 1975, and the lack of
neighborhood opposition.
On May 27, 1983, the Planning Commission upheld the Zoning Co�nittee's
recommendation on a vote of 16-2.
This rezoning is scheduled to be heard by the City Council on June 16,
1983. Please notify me by June 15 if any member of the City Council wishes
to have slides of the site presented at the public hearing.

He plans to retain the house at 405 Maryland and use the rear of both lots for

2. Petitioner has submitted a site plan for a parking lot based on P-1 standards.
If the property is rezoned, a new site plan meeting B-3 standards will be needed.

4. The intended location of B-3 zoning districts is along major traffic arteries or

level B, which meets the zoning code definition of major thoroughfare.

Dear Mr. Bryan:
. The Land Use/Zoning Committee of the Pistrict 5
Planning Council reviewed the request o.f John I�Jess to
rezone 405 and 409 Maryland from P-1 to B-3. Mr. i�less
explained his plans to sell flowers and Christmas trees
� on the lots , and also talke�l about possible expansion
in the future. He related the history of ' the zoning on
this property and the fact that it was zoned B-3 previous
to 1975. Apparently Mr Wess was one of several property
owners who was unaware of the 1975 citywide rezonings ,
and his primary interest is to restore the B-3 status. ��
. Additionally he was somewhat mystifiec? as to why the
houses in the northwest corner of the street were still
zoned B-3.
, The committee considered the various options avail-
able to allow the outdoor sale of plants and the fact that
� the comprehensive plan has been written to address com-
mercial encroachment into a residential neighborhood. De-
spite some skeptisism about B-3 zoning on a residential
Q block - the entire corner is primarily commercial and this
apparently is the only legal option to accommodate o»tdoor
sales . There was no neighborhood opposition expressed, so
the committee recommended that the rezoning be g_�anted to
restore the B-3 status prior to 1975. The District 5
Planning Council supported the committee's recommendation
� at the May 17 board� meeting. .
