An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes � 462. 357 and § 64.210
of the Legislative Code, Ethel Boudah, Paul Wolleat and Darlene
Murray duly petitioned to rezone the W 1/2 of Lat 2, and all of
Lot 3, Syndicate #3 Addition, located at 750 Blair, from RT-1 to
RM-2 to permit continuance of a triplex, the petition having been
certified by the Department of Finance and Management Services on
April 1, 1983 as having been consented to by at least 670 of the
owners of the area of the property to be rezoned, and further having
been consented to by at least two-thirds of the owners of the pro-
« perty situated within 100 feet of the total cQntiguous descriptions
of real estate held by the same owner or any party purchasing any
such contiguous property within one year preceding the date of the
petition; and
WHEREAS, The current Zoning Committee on April 21, 1983 con-
ducted a public hearing for the purpose of considering the rezoning
petition, and pursuant to Section 107.03 of the Administrative Code
submitted its recommendation to the Planning Commission; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on April 22, 1983; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official
newspaper of the City on May 7, 1983 and notices were duly mailed
to each owner of affected property and property situated wholly or
partly within 350 feet of the property sought to be rezoned; and

and the Council having considered all the facts and recommendations
concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 11,
as incorporated by reference in Section 60. 301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located at 750 Blair, being more
particularly described as the W 1/2 of Lot 2,
and all of Lot 3, Syndicate #3 Addition, be and
is hereby rezoned from RT-1 to RM-2.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Sir:
On April 21 , 1983, the Zoning Committee of the Planning Commission held
a public hearing on this rezoning. The petitioners testified that they
had purchased the property 32 years ago as a three-plex and had been
assured zoning would not be a problem. There was no other testimony.
At the close of the public hearing the Committee voted 4-2 to deny the
rezoning. .
On April 22, 1983, the Planning Commission upheld that recommendation on
a vote of 13-3. This rezoning is scheduled to be heard by the City Council
on P1ay 19, 1983. Please notify me by May 18 if any member of the City
Council wishes to have slides of the site presented at the public hearing.

Pangal of the Zoning Corrmittee; Mr. Segal , Assistant City Attorney;

Ms. Beseman, Mr. Ford, and Ms. James of the Planning Division

The meeting was chaired by James Bryan, Chairman.
ETFiEL BOUDAH PAUL WOLLEAT DARLENE MURRAY (#9360) : Rezone from RT-1 to
RM-2 to permit continuance o a 3-plex at 50 B a�r Avenue.
The applicant was present. There was no opposition present at the hearing.
Ms. James showed slides of the site and reviewed the staff report with a
recommendation for denial . No correspondence was received on the matter.
Paul Wolleat, 3228 N. Victoria, stated that when they bought the property
32 years ago, it was alxeady converted to a 3-plex. They were told by the
previous owner that the property had never been properly zoned and assured
them that would not present any problem. He stated that many of the neighbors
are very much in support of continuing the use as a 3-plex which they have
known it to be for a long time. The property is well maintained and they
do meet most of the requirements for the rezoning. If the rezoning is denied,
it will create a great financial problem for the owners and some problem
for the people that are living in the building because rents will have to
be increased and one family will have to .move out. The building would have
to be remodeled to comply with the zoning. .
Ethel Bouoah, one-third owner of the property, reported that the previous
owner had purchased one-half of the lot next door to the 3-plex.
There was discussion regarding whether the 3-plex was a legal nonconforming
use. Ms. Lane stated that there is nothing in the Building Department
records to indicate that they have applied for a continuation of a noncon-
forming use. The applicant would have to provide evidence that it has been
a 3-unit building since 1956.
Ms. James stated that it appears from the tax records that the structure was
converted in the 1960s .
Mr. Wolleat reported that they did check the occupancy records going back
several years and found that it was not in fact a 3-plex prior to 1956.
He stated that they were not the people responsible for illegally converting
the property.
Hearing no further testimony, Mr. Bryan closed the public hearing portion of
the meeting.

Mr. Armstead moved denial based on findings 1 through 1, 10, ll , and the

A. PURPOSE: Rezone to RM-2 to permit continuance of a three-plex.
6. SUFFICIENCY: Petition found sufficient by Planning Division on April 1 , 1983. Parcels
e igi e: 15; parcels needed: 10; parcels signed: 13.
C. PARCEL SIZE: 60' (Blair) x 124.5 ' = 7,470 square feet.
D. EXISTING LAND qSE: 22 story brick dwelling with single car garage and space for
three additiona cars in back. There is alley access .
E. SURROUNDING LAND USE: Low density residential (RT-1 ) .
F. ZONING HISTORY: The site was zoned "B" residence in 1922. In 1975 it was rezoned
to RT-1 .
G. FINDINGS:
1 . Petitioners must rezone their property to RM-2 and receive a lot area variance
from the Board of Zoning Appeals to obtain a Certificate of Occupancy.
2. The structure contains a two-bedroom unit on the first floor, a three-bedroom unit on
the second floor, and a 2-bedroom unit on the third floor, for a total of 10 rooms .
. 3. The structure appears to have been converted illegally in the late 1960 's .
4. The Redevelopment Plan for this area recommends single family or duplex uses
as the preferred choice, with two-family or rowhouse structures as a second choice.
5. Land Use Plan Policy 4.1-5 states: "The city will establish criteria to allow
sensitive reuse and conversion of existing housing structures . The criteria will
� address density, lot characteristics, structural characteristics, parking, open
space and neighborhood impact. "
6. Petitioners need RM-2 zoning in order to meet density requirements . Thirteen
rooms would be permitted on the lot, and ten rooms are existina. Theoretically,
an additional one-bedroom unit could be added to the site if the RM-2 zoning were
approved.
7. The lot does not have the minimum area required for a multiple-family district.
10,000 sq. ft. are required; the lot (including z the alley) has 7,920 sq. ft. ,
for a shortage of 2,080 square feet.
8. The structure is 1 ,660 sq. ft. at qround level . It appears to be large enough
to nold three units.
9. Four off-street parking spaces would be required for new construction. There are
four off-street spaces in the rear.
10. This lot is in the middle of a large low density residential area. There do not
appear to be any conditions that are changing the character of the neiqhborhood
to multiple family. The original zoning was not a mistake, but is consistent
with comprehensive plans .
11 . The intent of the RNi-2 district is to provide for more extensive areas of
multiple-f amily residential development. Only one lot would be affected by this
rezoning, and it wo�uld appear to benefit the owners of this lot rather than the
area as a whole.

12. The proposed use (triplex) would not be substantially different from the
surrounding uses. No building additions were required for this conversion,
and it does not appear to be detrimental to �he neighborhood.
H. STAFF ANALYSIS: This property was illegally converted, and now must be rezoned to
comp y wit certificate of occupancy requirements. The lot does not meet the
minimum are�a standards of the RM-2 district, so approving the rezoning would create
a substandard lot for multiple-family uses. This appears to .be a spot rezoning.
I . STAFF RECOhiMENDATION: Based on findings 1 through 7, 10, 11 , and the staff analysis,
staff recommends denial of the rezoning to RM-2.
