An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes §462. 357 and §64. 210
of the Legislative Code, Floyd Klein duly petitioned to rezone
Lot 12, Block 8, Terry' s Addition, located at 806 Earl Street,
from RT-1 ,to RM-2 to permit conversion of a duplex to a multi-
family structure, the petition having been certified as having
been consented to by at least 67% of the owners of the area of the
property to be rezoned, and further having been consented to by at
least two-thirds of the owners of the property situated within 100
feet of the total contiguous descriptions of real estate held by
the same owner or any party purchasing any such contiguous property
within one year preceding the date of the petition; and
WHEREAS, The current Zoning Committee on August 4, 1983,
conducted a public hearing for the purpose of considering the
rezoning petition, and pursuant to Section 107 . 03 of the Admini-
strative Code, submitted its recommendation to the Planning Com-
mission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on August 12, 1983 and recommended
that the City Council approve the petition; and
WHEP.EAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official
newspaper of the City on August 20, 1983 and notices were duly
mailed to each owner of affected property and property situated �
wholly or partly within 350 feet of the property sought to be
rezoned; and

WHEREAS, A public hearing before the City Council, having
been conducted on September 1, 1983 where all interested persons
were heard, and the Council having considered all the facts and
recommendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1 .
That the zoning map of the City of Saint Paul, Sheet No. 14,
as incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows :
That property located at 806 Earl Street,
being more particularly described as Lot 12,
Block 8, Terry' s Addition, be and is hereby
rezoned from RT-1 to RM-2 .
Section 2 .
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

PURPOSE: Rezone property at 806 Ear1 Street from RT-1 to RM-2 to
permit conversion of a duplex to multi-unit dwelling.
PLANNING COMMISSION DECISION: Approve (14-0)
ZONING COMMITTEE DECISION: Approve (6-0)
STAFF RECOMMENDATION: Approve

Dear Sir:
On August 4, 1983 the Zoning Committee of the Planning Commission held a
public hearing on this rezoning. The developer was present and presented
his plans for the structure. He proposes converting the building to 4 units:
three with 2-bedrooms and one with l-bedroom. There was no other testimony.
At the close of the public hearing, the Corixnittee voted 6-0 to recommend
approval of the rezoning. Qn August 12, 1983 the Planning Commission upheld
the Zoning Committee's recommendation on a vote of 14-0.
This rezoning is scheduled to be heard by the City Council on September l , 1983.
Please notify me by August 31 , if any member of the City Council wishes to
have slides of the site presented at the pu6lic hearing.

D. EXISTING LAND USE: Level lot with large 2-story structure. The site has alley

F. ZONING HISTORY: Prior to 1975 the site was zoned "B" residence. It has since
e�6 en zon�e RT-1 .
G. FINDINGS:
1 . Petitioner proposes rezoning to RM-2 so he can convert this structure to
multifamily use.
2. According to Taxation Department records, the structure was built in 1887 and
is 1 ,764 sq. ft. at ground level .
3. The property is located in the Margaret-Sibley Identified Treatment Area.
4. Land Use Plan policy 4.1-5 states: "The city will establish reuse and
conversion of existing housing structures. The criteria will address
density, lot characteristics, structural characteristics, parking, open space
and neighborhood impact." •
5. Petitioner's lot, including one-half the alley, is 6,750 square feet. At RM-
2 density, 11 rooms are permitted, for a total of four or five units.
6. The minimum lot size for multiple family structures is 10,000 square feet.
The petitioner would therefore need a lot area variance of 3,250 square feet
if the rezoning were granted.
?. The ctructure is two stories high and 1 ,764 square feet at ground level . The
structure appears large enough ��or �aur or i�v2 u^;*s.
8. Applicant states that he will provide parking in the rear yard for 8 to 10
cars. New construction would require 6 to 7 spaces. Off-street parking for
multi-family uses must go through the site plan review process.
9. Very little public open space is provided in this area. It seems likely that
parking will take up most of the rear yard.
10. Earl is a collector street, with 6,175 average daily trips at this location.
Directly across the street i:; a used car lot and a parking lot. If adequate off-
street parking is provided, the conversion of this structure would not appear

to have a negative impact on the neighborhood.
11 . The District 4 land use map calls for low density residential in this area.
12. The intent of the RM-2 district is to provide for more extensive areas of
multiple family residences near major thoroughfares, transit and related
facilities.
13. This site would not provide an extensive area of multiple-family development.
Earl Street and E. 7th Street are collectors, not major thoroughf ares;
although E. 7th is a bus route. '
H. STAFF RECOMMENDATION: Based on findings 4, 5, 7, 8 and 10, staff recomnends
approva of t e rezoning to RM-2.
