An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes � 462.357 and � 64.210
of the Legislative�Code, Ted Golla duly petitioned to rezone Lot 6,
Block 21, Arlington Hills Addition, located at 794 Case, from RT-1
to RM-2 to permit continuance of a triplex, the petition having been
certified by the Department of Finance and Management Services on
March 23, 1983 as having been consented to by at least 67� of the
owners of the area of the property to be rezoned, and further having
been consented to by at least two-thirds of the owners of the pro-
perty situated within 100 feet of the total contiguous descriptions
of real estate held by the same owner or any party purchasing any
such contiguous property within one year preceding the date of the
petition; and
WHEREAS, The current Zoning Committee on April 21, 1983
conducted a public hearing for the purpose of considering the re-
zoning petition, and pursuant to Section 107.03 of the Administra-
tive Code, submitted its recommendation to the Planning Commission;
and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on April 22, 1983; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the o.fficial
newspaper of the City on April 30, 1983 and notices were duly
mailed to each owner of affected property and property situated
wholly or partly within 350 feet of the propert� sought to be
rezoned; and

B. SUFFICIENCY: Petition found sufficient by Planning Division on March 23, 1983. Parcels

C. PARCEL SIZE: 40' (Case) x 125' = 5,000 square feet. �
D. EXISTING LAND USE: 22 story frame structure with 3 units . The lot has alley access
with space for off-street parking in the rear. The lot slopes toward the east and south;
so there is a walk-out basement in the rear.
E. SURROUNDING LAND USE:
North: 1 - and 2-family dwellings (RT-1 )
East: 1- and 2-family dwellings; commercial (RT-1 ; 6-3) '
South : 1- and 2-family dwellings (RT-1 )
West: 1- and 2-family dwellings (RT-1 )
F. ZONING HISTORY: The site was zoned "6" Residence prior to 1975 when it was rezoned
to RT- .
G. FINDINGS:
l . Petitioner must rezone this property to RM-2 and obtain a lot area variance in
order to obtain a Certificate of Occupancy.
2. According to the applicant, the building contains a one-bedroom unit in the
basement, a two-bedroom unit on first floor, and a two-bedroom unit on the second
floor, for a total of 8 rooms .
3. According to tax assessor's records, the building was moved onto this lot in
1964 and was converted to a triplex in 1965.
4. Land Use Plan policy 4.1-5 states: The city will establish criteria to allow
sensitive reuse and conversion of existing housing struct.ures . The criteria
will address density, lot characteristics, structural characteristics, parkina,
open space and neighborhood impact. "
5. Petitioner needs the RM-2 zoning to comply with density requirements . Nine rooms
would be permitted, and there are currently eight rooms in the structure.
6. The lot width and area conform to R-4 standards . The lot does not have the
minimum area required for the RM-2 district. Including 2 the alley, the lot
has 5,400 sq. ft. , 4,600 sq. ft. less than the minimum.
7. The building is 1 ,152 sq. ft. at ground level . It appears to be sufficient for
three units. �
8. Four off-street parking spaces would be required, for a newly constructed tr.iplex. .
Petitioner proposes four off-street spaces, but will need variances to establish
them:
9. The lot is in an area of single family and duplex dwellings, one-half block away
from Arcade, a commercial street and a bus route.

10. The character of the neighbor_hood does not appear to be changing from low to
medium density. There is no -indication that there was a mistake in the zoning,
since thi:s use would have been illegal under previous zoning as weil .
� 11 . The intent of the RM-2 district is to provide for more extensive areas of �
multiple family development. In this case only one lot would be rezoned.
' This would appear to benefit the owner of this lot rather than the area as a
- whole.
12. The structure will not be enlarged to create the third unit. The proposed use
would not appear t� be detrimental to the surrounding area, nor would it be
substantially different from the duplexes that are permitted in the current
zoning district.
H. STAFF ANALYSIS: This structure was illegally converted, and now must be rezoned and
obtain variances in order to obtain a certificate of occupancy. The lot is too small
to meet RM-2 standards, and approving the rezoning would create a substandard parcel
� for multiple family residential uses. This appears to be a spot rezoning.
I . STAFF RECOMMENDATION: Based on findings 1 through 6, 10, 11 , and the staff analysis,
staff recommends denial of the rezoning to RM-2.
