An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes §462 . 357 and §64.210
of the Legislative Code, Delores and Milton Elliott duly petitioned
to rezone Lots 19, 20 and 21, Block 12, W. St. Paul Real Estate and
Improvement Syndicate #1, located on the northeast corner of
Belvidere and Oakdale, from R-4 to RT-2 to permit construction of
three four-plexes, the petition having been certified as having
been consented to by at least 67� of the owners of the area of the
property to be rezoned, and further having been consented to by at
least two-thirds of the owners of the property situated within 100
feet of the total contiguous descriptions of real estate held by
the same owner or any party purchasing any such contiguous property
within one year preceding the date of the petition; and
WHEREAS, The current Zoning Committee on Ju].y 7, 1983 conducted
a public hearing for the purpose of considering the rezoning
petition, and pursuant to Section 107.03 of the Administrative
Code, submitted its recommendation to the Planning Commission that
the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on July 8, 1983 and recommended that
the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official
newspaper of the City on July 16, 1983 and notices were duly
mailed to each owner of affected property and property situated

least two-thirds of the owners of the property situated within 100
feet of the total contiguous descriptions of real estate held by
the same owner or any party purchasing any such contiguous property
within one year preceding the date of the petition; and
WHEREAS, The current Zoning Committee on Ju}.y 7, 1983 conducted
a public hearing for the purpose of considering the rezoning
petition, and pursuant to Section 107. 03 of the Administrative
Code, submitted its recommendation to the Planning Commissian that
the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on July 8, 1983 and recommended that
the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
- on the said rezoning petition was duly published in the official
newspaper of the City on July 16, 1983 and notices were duly
mailed to each owner of affected property and property situated

PURPOSE: Rezone property at the northeast corner of Belvidere
and Oakdale from R-4 to RM-2 to permit construction of 3
four-plexes.
PLANNING COMMISSION DECISION: Approve RT-2 (13-0)
ZONING COMMITTEE DECISION: Approve RT-2 (4-0)
STAFF RECOMMENDATION: Deny RM-2 Approve RT-2
SUPPORT: 1 person testified
OPPOSITION: 4 people testified; 4 letters received in opposition
Dear Sir:
On May 19, 1983, the Zoning Committee of the Planning Commission held a
public hearing on this proposed rezoning. The developer was present and
explained his proposal . Four people spoke in opposition stating that the
property was too small ; there would not be enough parking and that they pre-
ferred single family development on that parcel . At the close of the meeting,
the Zoning Committee voted to continue the public hearing on June 16, 1983 so
that more information could be provided.
On June 16, 1983, the Zoning Committee again considered this proposal . Four
people again appeared in opposition. The developer was not present. At the
close of the public hearing, the Zoning Committee voted to lay the matter
over to the July 7, 1983 meeting to give the petitioner time to respond to
the proposed rezoning to RT-2. At the July 7, 1983 Zoning Committee meeting,
a letter was received from the developer indicating that the RT-2 rezoning
would be acceptable. At the close of that meeting, the Zoning Committee voted
4-0 to approve the rezoning to RT-2. On July 8, 1983, the Planning Commission
upheld the Zoning Committee's recommendation for rezoning to RT-2 on the vote
of 13-0.
This rezoning is scheduled to be heard by the City Council on July 28, 1983.

of the Zoning Committee; Mr. Segal , Assistant City Attorney;
Ms. Lane of the Division of Housing & Building Code Enforcement;
Ms. Beseman, Ms. James and Ms. McNeally of the Planning Division
Staff.

The meeting was chaired by James Bryan, Chairman.

Mr. Bryan reported that the applicant submitted a letter stating that he

which passed on a roll call vote ot 4 to 0.

The meeting was chaired by James Bryan, Chairman.
DELORES & MILTON ELLIOTT #9376) : Rezone from R-4 to RM-2 to permit
construction of three 4-p exes on property located on the northeast corner
of Belvidere and Oakdale.
The applicant was not present. There was opposition present at the hearing.
Ms. James showed slides of the site and presented a revised staff report
recomnending denial of the RM-2 but supporting a rezoning to RT-2.
One additional letter was received in opposition since the meeting of
May 19. ,
Raymond Mishler, 200 Belvidere, stated that he would not object to
putting 3 single family homes on the site but would oppose three 4-plexes
or two 4-plexes; it would overcrowd the site and lower his property value.
Martin Seidl , 235 Belvidere, spoke in opposition because of the parking •
situation and the problems that currently exist with vehicles on Belvidere.
He stated that he would not object to a couple of nice apartments or
2-family homes.
Louis Shields, 245 Belvidere, stated that his only objection was the parking
problem and indicated that h� would not be in opposition to the
construction of two duplexes.
Theresa Bock, 212 Belvidere, testified in opposition because of the con-
stant traffic on Belvidere, the narrowness of the street in the winter, and
the f act that there is not enough room on the lot to accomnodate three
4-plexes and parking.
Hearing no further testimony, Mr. Bryan closed the public hearing portion
of the meeting.
Mr. Armstead made a motion to lay the matter over to July 7, 1983, to allow
time for the developer to respond to the staff recommendation. Ms. Karns
seconded the motion, which passed on a unanimous voice vote.

construction of three 4-plexes for property located on the northeast corner
of Belvidere and Oakdale.
The applicant was present. There was opposition present at the hearing.
Ms. James showed slides of the site and reviewed the staff report with a
recommendation to lay the matter over to enable petitioners to provide
additional information. Two letters were received in opposition.
John McQuillan, 415 Selby, developer, reported that the architect is
working on the plans. Their proposal is to construct 1-bedroom homes for
single people or young couples that will sell for under $40,000.
Raymond Mishler, 200 E. Belvidere, spoke in opposition stating that the
lots are too small to build three 4-plexes and there would not be enough
space to provide off-street parking.
Ruth Seidl, 235 E. Belvidere, stated opposition because of the parking
situation and the size of the lots.
Pat Bruhn, 169 E. Belvidere, stated that her main opposition was parking;
there isn't enough on-street parking. She was also concerned about
vandalism and the fact that rental property would lower property values in
the neighborhood.
Mrs. Bock, 212 E. Belvidere, testified in opposition to rental property
because of past experiences in the neighborhood. She also stated that
parking was a problem.
The Committee unanimously voted to continue the public hearing to June 16,
1983.

D. EXISTING LAND USE: Most of the site is vacant. There is a single family house 4n
Lot 21 . The alley is umimproved. The site has irregular terrain, sloping down to the
north and below grade along Belvidere.

F. ZONING HISTORY: The site was zoned "B" residence prior to 1975, when it was rezoned R-4.
G. FINDINGS:
l . Applicants propose vacation of the adjacent alley and consolidation of three lots
to create one developable parcel .
2. The development will consist of 12 one-bedroom ownership units in three buildings
of 4 units each, for a total of 24 rooms.
3. The RM-2 zoning would permit 28 rooms (14 units) . .
4. Four-plexes are first permitted in the RT-2 district. Fifteen rooms (7 units) would
be permitted under RT-2 zoning. With a density variance of 1 room, 8 units would
be permitted on the site.
5. Land Use Plan policy 4.1-4 states : "On ,scattered vacant sites in existing neighbor-
hoods, the city will establish criteria which willallow new housing development
at densities somewhat higher than the existing zoning but compatible with the
� general existing pattern of development. "
6. The Housing Policy Plan supports construction of alternatives to single family
detached dwellings (1-1 ) , and smaller l , 2, and 3 bedroom ownership housing units
(1-2) .
7. Housing Policy Plan policy 1-4 states: Every new development will be planned
and designed to enhance and complement existing neighborhood character. New
development should not simply add to, but should improve and strengthen what exists."
8. Housing Policy Plan policy 1-5A encourages duplexes and sometimes triplexes suitable
for owner occupancy on lower density residential infill sites.

9. Housing Policy Plan objective 2A states: ". . .provide that a major portaon of new owner-
ship units will be affordable to moderate income households."
10. The Street & Highway Plan classifies Oakdale as a collector and Belvidere as a local
street.
11 . According to the Transit Plan, the nearest bus is on Robert Street, two blocks away.
12. The intent of the RM-2 district is to provide more extensive multiple-family areas and
to establish a balance of population concentration as related to major thoroughfares and
transit.
13. The intent of the RT-2 district is to provide space for 2-, 3-, and 4-family and townhouse
structures and provide for housing that "has many of the amenities of single family
dwellings arranged in a low density, multiple-family pattern. "
14. The site's uneven topography may make it advisable to develop this largely vacant site
in some other way than individual single family detached lots.
15. The site plan submitted by petitioner shows that three four-plexes could not be built
on this site without substantial variances, including parking, mini.mum distance
between buildings, and yards.
H. STAFF ANALYSIS: This proposal would conform to a number of comprehensive plan
housing policies. However, the site plan submitted by the petitioner does not meet
zoning code standards in many areas. The proposal appears to overcrowd this site and
would not seem to "enhance and complement existing neighborhood character." Two
structures of four units each could probably be constructed on this site without such
substantial variances.
I. STAFF RECOI�IENDATION: Based on findings 1 through 5, 7, 8, 10, 11, 12, 15 and the
staff analysis, staff recommends denial of the rezoning to RM-2. Based on findings
1, 2, 4-7, 9, 13, 14 and the staft analysis, staff would support a rezoning to RT-2.

NIy wife and I own the property at 194 E . Curtice . Our property
borders in part the lots 19, 20 & 21, Block 12 W. St . Paul Real
Estate and Improvement Synd. #1, which is purposed for rezoning
from R-4 to RM-2 .
My wife and I would like to voice our opposition to this rezoning
for the following reasons !
l . The rezoning would allow the construction of 3 four-plex,es
for a total of 12 units . This is far too many units for
this srnall of an area.
2. In the plans I have seen, there is nb allotment for off-
street parking . Nor in my opinion, would there be room
for such on these small lots .
This poses a major problem in that in these times it is fair to
assume that there will be a mimimum of one car per unit and even
two cars for some of the units . So it is a fair assumption that
there will be 16 or 18 cars to be parked. With Oakdale being a
snow emergency route and a very busy street , this conjestion of
parked cars could be hazerdouse as well as being a nuisance and
eyesore.
3. The neighborhood is a family oriented neighborhood now. I feel
that the proposed building will have a detrimental effect on that
family orientation. I base that feeling on the size of the units .
The plans I saw showed only one bedroom units which is not very
conductive with a family environment .
4. The present looks of the home now on one of the lots is in my
opinion not very good and because of the looks of this present
property I question the management abilities with 12 units .
5. Based on the above mentioned, I believe that construction of
these four-plexes will have an adverse affect on the value 's
of surrounding property .
My wife and I also have unanswered questions that should b� brought
up at your hearing :

Sold as Condo 's? Sold as a whole to other investors?
3. If they keep and rent the units, how long will they own them?
4 . What assurances do we have that they aren't just in this for
a fast buck and that they even care about the neighborhood?
My wife and I urge you all to deny this rezoning proposal ! Keep
the neighborhood as it is ! ! !
We also urge these investors to build single family homes on the
lots. I am sure there are profits to Ue made in single family
homes .
If these investors do build single family homes :
1 . They would make a profit (perhaps not as much as they are
counting on with their four-plexes, but a profit just the
same) .
2 . The neighborhood would remain unchanged, a nice family
oriented neighborhood,
Out of state business obligations keep me from attending this
meeting in person. I hope this letter will be heard by all per-
sons concerned.
If there are any further meetings on this matter, I will make
every effort to attend.

I as a home owner strongly object to the development of four-plexes
in this neighborhood particularly in front of my own home . I have
completely remodeled my own home and increased my own property
value and the building of these proposed four-plexes on this
particular plot would decrease the property value on surrounding
properties, add increased traffic levels on moderately quiet
residential streets. Increased traffic would also increase noise
levels and would be an invitation for vandalism and o ther vises.
Having been a home owner here for 10 years, I am strongly going to
protest this proposal by letters and petitions, if needed.

I am writing this concerning about the duplexes they
want to build on our corner. First of all is there
gonna be a back yard. Next, what will the people
do to get the kids to school2 Haw can they came up
our street if it is slippery. If the cars back up
like they do, a lot of people will get hurt and back
up in the duplexes. Why do they want duplexes on
the corner, because taxes will go up. We do not
want any more trouble as we have had enough. Our
neighborhood is quiet now. Anybody with common
sense would'nt build on a corner because cars turn
on a corner and is bad in winter. Cars don't stop
for anybody. A car crashes in a duplex an_the
insurance will not pay for anything.
Nobody wants duplexes on a corner as it is a bad place.
