An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes �462. 357 and �64.210
of the Legislative Code, Eugene H. and Evelyn E. Bohn duly petition-
ed to rezone Lots 11, 12 and 13, Block 2, Leonard' s Subdivision,
located on the east side of Ocean, north of East Seventh Street,
from RT-1 to I-1 for the purpose of constructing a storage building,
the petition having been certified as having been consented to by
at least 67� of the owners of the area of the property to be re-
zoned, and further having been consented to by at least two-thirds
of the owners of the property situated within 100 feet of the total
contiguous descriptions of real estate held by the same owner or
any party purchasing any such contiguous property within one year
preceding the date of the petition; and
WHEREAS, The current Zoning Committee on June 16 , 1983 con-
ducted a public hearing for the purpose of considering the rezoning
petition, and pursuant to Section 107.03 of the Administrative
Code, submitted its recommendation to the Planning Commission
that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on June 24, 1983 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

Legislative Code, as amended, is hereby further amended as follows:
That property located on the east side of Ocean,
north of East Seventh Street, being more particu-

from RT-1 to I-1.
Section 2 .
This ordinance shall take effect and be in force thirty (30)

Dear Sir:
On June 16, 1983, the Zoning Committee of the Planning Commission held a
public hearing on this rezoning. At that time, the Commitee asked the
petitioner if an I-1 rezoning was acceptable to him. The petitioner stated
that he was unaware of the difference between the I-1 district and I-2
district and that if he could build his building in the I-1 district
that would be acceptable to him. There was no other tes•timony.
At the close of the public hearing, the Committee voted 3 to 1 to
approve the I-1 zoning.
On June 24, 1983, the Planning Commission upheld the Zoning Committee's
recommendation on a vote of 14 to 0. This rezoning is scheduled to be
heard by the City Council on July 21 , 1983. Please notify me by July 20
if any member of the City Council wishes to have slides of the site
presented at the public hearing.

PRESENT: Mme. Karns; Messrs. Armstead and Bryan of the Zoning
Corrmittee Pangal of the Zoning Committee; Mr. Segal , Assistant
City Attorney; Ms. Lane of the Division of Housing & Building
Code Enforcement; Ms. Beseman, Mr. Ford and Ms. James of the
Planning Division Staff.
ABSENT: None
The meeting was chaired by James Bryan, Chairman.
EUGENE & EVELYN BOHN (#9394) : Rezone from RT-1 to I-2 to canstruct
storage uil ing on t e east side of Ocean, north of E. 7th Street.
' The applicant was present. There was no opposition present at the hearing.
Ms. James showed slides of the site and reviewed the staff report with a
recommendation for denial of the I-2 rezoning. Staff indicated support of
an I-1 rezoning which would meet the petitioner's nee er was
received in support. \
Eugene Bohn stated that he would agr e to an I-1 rezoning.
Hearing no further testimony, Mr. B an closed the publ ' earing portion
of the meeting.
Mr. Armstead recorrmended denial of the I-2 rezoning but approval of an I-1
zoning based on findings 1 , 3, 8 and staff analysis. Ms. Karns seconded
the motion, which passed on a roll call vote of 3 to 0.

B. SUFFICIENCY: Petition found sufficient by Planning Division on May 25, 1983. Parcels

C. PARCEL SIZE: 118.5' (Ocean) x 136.5 ' = 16,175 square feet.
D. EXISTING LAND USE: Vacant, level lots used for open storage and gardening.
E. SURROUNDING LAND USES:

F. ZONING HISTORY: Prior to 1975, the area was zoned Heavy Industry, and the north side
of Seventh Street was zoned Light Industry.
G. FINDINGS:
l . Petitioner wishes to construct a pole building on the northern lot to store
materials left over from his contracting business . These materials are presently
stored in the open on this lot. Petitioner states that he is no longer in the
contracting business and that there will be no truck traffic associated with the
building. The southern two �ots will continue to be used for gardening.
2. The Land Use Plan recommends that labor-intensive light industry be encouraged in
St. Paul .
3. The District 4 plan recomnends removing bliqhting influences of vacant land.
4. The intent of the I-2 district is to provide space for manuf acturing compounding
and processing semi -finished products from raw material and prepared material .
5. Given a maximum heiqht in the I-2 district of 75' , the setback required from the
residential district to the south and east would be 112.5' from the district
boundary, making it impossible to construct a building of that height on this parcel .
6. Section 62. 105(2.) prohibits off-street loading in any yard adjacent to a residential
� use or district. This would limit the location of off-street loading to the north
or east of the parcel , further limiting development potential .
7. One of the required conditions of the I-2 district is that there be no outside
storage within 300' of a residential district. This would, unless modified by the
Planning Commission, effectively prohibit outdoor storage on the parcel .
8. Warehousing is first permitted in the I-1 zoning district. Buildable area for
buildings of 10' , 20' , and 50` high are shown in figure 1 . ?he same restrictions
regarding off-street loading and outside storage apply to the I-1 district as v�ell
as to I-2.

H. STAFF ANALYSIS: The I-2 zoning seems c�learly inappropriate for this site, because
the intent of this district is to provide space for heavy manufacturing. This parcel
is too small and too close to residential property to ever be developed for many I-2
uses without substantial variances.
I-1 zoning would meet petitioner's needs as well . The use petitioner proposes could
be constructed without variances. Off-street loading and outside storage would not
be needed.
Reuse of the site could create problems if the site were sold at a later date or if
petitioner wished to re-establish his contracting business. It might be difficult
to use the structure for an otherwise conforming use without variance. At that time,
problems of setback and buffering adjacent residential property would arise.
I . �TAFF RECOMMEfVDATION: Based on findings 2, 4, 5, 6, 7, and the staff analysis, staff
recommends denial of the rezoning to I-2 of Lots 11 , 12, and 13, Block• 2, Leonard's
Subdivision.
