An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes �462 .357 and §64.210 of
the Legislative Code, James A. Stolpestad duly petitioned to rezone
Lots 4 and 5, Block 4, together with the south one-half of the
vacated alley accruing thereto, Lexington Park Plat II, located on
the west side of South Lexington Parkway between Watson and D4ontcalm
Hill, from R-2 to RT-1 to permit construction of a two-family
structure, the petition having been certified as having been con-
sented to by at least 67� of the owners of the area of the property
to be rezoned, and further having been consented to by at least two-
thirds of the owners of the property situated within 100 feet of the
total contiguous descriptions of real estate held by the same owner
or any party purchasing any such contiguous property within one year
preceding the date of the petition; and
WHEREAS, The current Zoning Committee on July 7, 1983 conducted
a public hearing for the purpose of considering the rezoning petition,
and pursuant to Section 107. 03 of the Administrative Code, submitted
its recommendation to the Planning Commission that the petition be
granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on July 8, 1983 and recommended that the
City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official
newspaper of the City on July 16 , 1983 and notices were duly mailed
to each owner of affected property and property situated wholly or

Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 35,
as incorporated by reference in Section 60 .301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located on the west side of South
Lexington Parkway between Watson and Montcalm
HiTl, being more particular described as Lots 4
and 5, Block 4, together with the south one-half
of the vacated alley accruing thereto, Lexington
Park Plat II, be and is hereby rezoned from R-2
to RT-1.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Sir:
On July 7, 1983, the Zoning Committee of the Planning Commission held a
public hearing on this rezoning. No correspondence was received on the
matter. Ohe of the owners of the property appeared and explained the
proposal . The architect for the proposed development also appeared.
At the close of the public hearing, the Zoning Committee voted 6-0 to
recommend approval of the rezoning to RT-1 .
On July 8, 1983, the P9anning Commission upheld the Zoni�ng Committee's
recormnendation on a vote of 12-0. This rezoning is scheduled to be
heard by the City Council on July 28, 1983. Please notify me by
July 27 if any member of the City Council wishes to have slides of the
site presented at the hearing.

IN CITY COUNCIL CHAMBERS, ST. PAUL, MINNESOTA ON JULY 7, 1983
PRESENT: Mme. Karns; Messrs. Armstead, Bryan, Lanegran, Levy, and
Pangal of the Zoning Comnittee; Mr. Segal , Assistant City
Attorney; Ms. Lane of the Division of Housing & Building Code
Enforcement; Ms. Beseman, Mr. Ford and Ms. James of the
Planning Division Staff.
ABSENT: Mme. Summers.
The meeting was chaired by James Bryan, Chairman.
JAMES A. STOLPESTAD (#9347) : Rezone property from R-2 to RT-1 to permit
construction of two-fami y structure.
The applicant was represented. There was no opposition present at the
hearing.
Ms. James showed slides of the site and reviewed the staff report with a
recommendation for approval . No correspondence was received on the matter.
Jim Kelley, 286 N. Prior, stated that he bought the land from the applicant
� James Stolpestad. He proposes to construct 2 units which would be presold;
one he would live in himself. By constructing the 2 homes together, they
would not have to remove many of the mature trees.
Craig Rafferty, 352 Wacouta, architect, reported that he reviewed the site
conditions and the proposed location of the building is the only area really
buildable on the site. They discussed the proposal with the neighbors,
responded to their concerns, and received their approval .
Hearing no further testimony, Mr. Bryan closed the public hearing portion
of the meeting.
Mr. Levy moved approval based on findings 1 through 5 of the staff report.
Mr. Pangal seconded the motion, which passed on a roll call vote of 6 to 0.

2. Minimum lot size for the R-2 zoning district is 60 feet of width and 7,200 square
feet of area. The existing lots are therefore legally non-conforming.
3. Land Use Plan policy 4.4-1 states: "On scattered vacant sites in existing neigh-

densities somewhat higher than the existing zoning but compatible with the general

4. Since the lots are legally non-conforming, two single-family structures could be
built on the lots. The density would therefore not be increased by the rezoning.
5. Rezoning to RT-1 is required because the petitioners want to use commonwall
construction techniques; the Zoning Code does not permit zero lot line develop-
ment techniques in single-family districts.
6. By permitting duplex construction, the development can be more sensitive to the
steep slopes on the site. This is in conformance with Comprehensive Plan goals
of careful developm�nt on environmentally sensitive lands.
� 7. The proposed house will need site plan approval from the City because it is located
on slopes over 12%.
H. STAFF RECOMMENDATION: Based on findings 1 through 7, staff recommends approval of the

I have talked to Jim Stolpestad, who has assured me that access to the
property will be from Lexington Avenue. It is my understanding that access
from above the property on Montcalm Hill was considered but abandoned
as not feasible from a cost standpoint. So long as there remains no further
plans to gain access from Montcalm Hill (I would find this very objectionable),
I have no objection to the proposed duplex.
