n August 1�1, 1995, at about 8:56 am., James Berger, a tree worker in the forestry division of the
St. Paui Department of Parks and Recreation, was driving a City-owned truck northbound on Earl
Street in the City of St. Paul when he entered the intersection of Eazl and Third Streets against a red
light and collided with the plaintiff, Jerome W. Anderson, who was driving a U.S. Postal Service Jeep
westbound on Third street. The plaintiff was injured as a result of the accident.
On January 15, 1999, the plaintiff brought this action to recover monetary damages for injuries
suffered to his head, neck, shoulder, right arm and right leg, as well as damages for fuhue loss of
wage, earning capacity, and physical and mental pain and suffering.

The matter has progessed through prehial discovery. The evidence adduced to this date includes the
plaintifPs medical and employment records, witness statements and deposirions_ The plaintiffls
shoulder. An obj ecrive review of this and the balance of the evidence has led our office to enter into
a provosed settlement a¢eement which contemplates the pavment of $14,000.00 to the rolaintiff and

employer's right to seek and obtain subrogarion for workers' compensarion paid as a result of the
