WHEREAS, the Housing and Redevelopment Authority has submitted the
attached proposed lot split for City Council approval; and
WHEREAS, the Departments of Planning and Economic Development and Public
Works have reviewed the attached lot split at the northwest corner of
Laf ayette Road and Otsego Street being part of Lots 1, 2, 13, 14, 15 and
16, Block 7, and part of Lots 1, 2, 3, 4, 5, 32, 33, 34 and 35, Block 9,
all in Warren and Winslow's Addition and part of vacated Rivoli Street as
described in the attached survey; and
WHEREAS, the proposed lot split meets the requirements of Section 67.304 of
the Zoning Code; and
WHEREAS, the vacation of the portion of Rivoli Street within the described
parcel was approved by the City Council on September 20, 1983; and
WHEREAS, the recording process of said vacation has not been completed;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves
this lot split.

WHEREAS, Harvey Investment Company applied to the Board of
Zoning Appeals for a variance from the strict application of the
provisions of Section 61. 103(e) , the scheduled regulations of the
Saint Paul Legislative Code, for property located on the northwest
corner of Ford Parkway and Finn, being legally described as Lots 25
through 30, inclusive, Block 8, St. Catherine Park Addition to the
City of Saint Paul for the purpose of obtaining a variance of the
maximum height of the structure for the purpose of building a com-
mercial and office building, together with a parking ramp; and
WHEREAS, Following a public hearing, the Board of Zoning Appeals
by its Resolution No. 9409 adopted July 26, 19�3 varied the provisions
of Section 61 . 103(e) so as to allow the commercial building with
parking ramp to be constructed at the said northwest corner of Ford
Parkway and Finn Avenues with zero foot front , rear and side yard
setbacks , together with a 46 foot average building height on the
condition that ingress and egress is in accordance with the traffic
engineer' s recommendation, that the developer continue to involve
the District 15 Zoning and Environment Committee in establishing
the aesthetic profile of the building exterior and providing privacy
for neighboring property abutting the site on the north, and that
the developer guarantee that the parking in the ramp will be free;
and
WHEREAS, Pursuant to the provisions of Section 64.206, Duane
Kocil�, 2124 Pinehurst, St. Paul, Minnesota, duly filed his appeal
f?°om the said determination made by the Board of Zoning Appeals
reruesting that a hearing be held before the City Council for the
purpose of considering the actions taken by said Board; and
WI3EREAS, Acting pursuant to Sections 64.205 through 64. 20a
and upon notice to appellant, property owner, and other affected

property owners, a public hearing was duly conducted by the City
Council on Tuesday, September 20, 1983 where all interested parties
were given an opportunity to be heard and further considered by the
City Council at its regular meeting held on Thursday, September 22,
1983 ; and
WHEREAS, The Council having heard the statements made and
having considered the variance application, the report of staff,
the minutes and findings of the Board of Zoning Appeals , and the
developer and adjacent resident property owners having agreed to
a compromise solution for the development of the said property,
the Council does hereby
RESOLVE, That the Council of the City of Saint Paul does
hereby concur in the findings ma.de and determined by said Board,
and does hereby find and determine that the Board of Zoning Appeals
did not commit an error in any fact , procedure or finding made by
said Board; and, be it
FURTHER RESOLVED, That the appeal of Duane Kocik be and is
hereby denied; and, be it
FURTHER RESOLVED, That the variances granted by the Board of
Zoning Appeals be and are hereby affirmed and that the maximum
building height for the buildings to be constructed at the subject
property be as shown on the attached plan dated September 21, 1983 ,
which plan is incorporated herein by reference, subject to the
conditions as contained in the Board of Zoning Appeals ' Resolution
No. 9409 as follows, together with the additional conditions here-
by imposed by the City Council, which conditions have been agreed
to by the property owner and adjacent property owners :
(1) Ingress and egress to the structure shall be in accord-
ance with the traffic engineer' s recommendations with the objective
being to minimize traffic, emissions , noise, and maximize safety
on the adjacent residential streets ;

(2) That the developer shall continue to involve the District
15 Zoning and Environment Committee in establishing the aesthetic
profile of the building exterior and in providing privacy for
neighboring property abutting the site on the north;
(3) All parking in the ramp will be free for so long as the
ramp shall exist, provided, however, that the developer shall have
the right to restrict the length of time that each vehicle may be
parked in the ramp and which restrictions shall be uniformly
applied. Developer shall, prior to being issued a building permit ,
execute a covenant or restriction in a form approved by the city
attorney setting forth that parking shall be free for so long as
a parking ramp shall exist at said location.
(4) That the developer and neighboring abutting property
owners shall work together with the traffic engineer so as to
minimize the impact of deliveries to the proposed building.
(5) That the developer and neighboring abutting property
owners shall be consulted by the planning administrator during the
process of the review and approval of the site plan for this
development.
(6) All waste containers shall be maintained entirely within
the subject building and not stored in the alley, and arrangements
for removal of waste shall be made so as to occur at such times as
will not inconvenience the abutting residential property owners .
(7) The developers shall cooperate with the abutting neighbor-
ing property owners in the design and the construction of the ramp
so as to minimize noise, emissions of all sorts , to provide privacy
and preserve aesthetic integrities to the abutting neighboring
property, and the developer shall consistently use state of the
art technology to accomplish the intent of this ordinance. The
northerly wall of the office building and parking ramp shall be
constructed of a solid wall and where requirements for lighting
purposes exist , translucent bricks may be used.
(8) Alley lights shall be installed by the developer and
shall be included in the site plan review process.
