An ordinance revising the effective certification
date for persons who hold the title of Substitute
Library Specialist.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
RESOLVED, That this ordinance shall supersede the Civil Service Rules as a
result of the settlement out-of-court between the representatiive of the City
of St. Paul and Kay C. Rindal, et al, Plaintiffs filed in District Court, County
of Ramsey, District ��'453192.
Section 2.
This agreement provides that those persons employed in the title 'Substitute
Library Specialist' prior to June 6, 148Q and who have since beea certified as the
result of a competitive examination shall he retroactively certified to the date on
which they coannenced work for the city in said classification (without regard to
interruptions in service, except resignation) for purposes of all employment-related
city policies and practices.
Section 3.
The attached document has been prepared by the Personnel Office of the City of
Saint Paul and has been certified hy both parties as correct and accurate as to
original employment date.
Section 4.
This ordinance shall take effect and he in force thirty (30) days from and after
passage, approval, and publication.

Plaintif£s filed their Complaint on August 26 , 1981
alleging that defendants had engaged in employment practices
which violated the Minnesota Public Employees Labor Relations
Act (Minn. Stat. § 179 .G1 et se .) , the Minnesota Human
Rights Act (Minn. Stat. § 363 .01 et se . ) , the Uniform
Declaratory Judgment Act (Minn. Stat. § 555 .01 et se . ) and
the City' s Employment Contract represented in its civil
service rules . On March 11, 1982, the Court established a
class consisting of all persons who have worked , are
currently working or may work as substitute library
specialist employees (hereinafter "SLS") from September l ,
1975 to the present and have been certified at any time as a
result of a competitive examination. Pursuant to this

of the class was sent to aIl class members .
This settlement shall not be construed as an admission by
the City of St. Paul or other named defendants of any
violation of law or any other wrongful conduct or practices.

Agreement all issues raised by the Complaint.
NO4d THEREFORE, it is agreed by and between Kay C. Rindal,
Karen E. Kolb and Patricia Gerlach, anc3 the class they
represent, ("Plaintiffs") and the City of St. Paul and its
agents and employees named as defendants ("City") as follows:
1. The City will pay Plaintiffs $30 ,000 as and for
damages allegedly suffered as a result of the City' s
actions. From this amount, costs and attorneys' fees
incurred on plaintiffs behalf shall be paid. After costs and
fees are paid , the remainder of the award shall be divided
into three equal portions and shall be distributed ��. C C_

August 26 , 1979 , the applicabZe limitations period, as
follows:
A. Hours lost from September 2 , 1980 to
February 27 , 1981. One-third of the award shall be

. distributed to SLS employees who have been certified as a ���'X�
result of a competitive examination and lost assigned
hours of work during the period September 2, 1980 through
February 27 , 1981. Payment sh�ll be distributed among
persons so qualified in proportion to the number of hours
of work which they lost during the period , calculated by
determining their average hours worked during the period
January through May, 1980 or , if that is not possible,
then determining their average hours worked during the
period tsarch through Diay 1981 and comparing it to average
hours worked during the period September 1980 through
February 1981. Kay Rindal , who left the City' s
employment because of the reduction in hours and was
subsequently unemployed will receive an amount calculated
as if she had continued as an SLS employee for 14 hours
per week throught the period.
B. Pro-rata fringe benefits from August 23 , 1979
to January 26 , 1982 . One-third of the award shall be
distributed to all persons who worked as SLS employees
during the period August 26 , 1979 to January 26 , 1982 and
who have been certified at any time as a result of a
competitive examination. Payment shall be distributed in
proportion to the total hours worked during that period
by each class member so qualified.
C. Failure to provicle stepped-up scale from
August 23 , 1979 to April 29 , 1983 . One-third of the
award shall be distributed to persons who have worked as

SLS employees from August 26 , 1979 to April 29 , 1983 and
have been certified at any time as a result of a
competitive examination . Payment shall be distributed
based on total hours worked during the period.
2 . The City shall revise applicable civil service

rules, city ordinances , compensation plans and provisions,
and any other city policies and practices to provide , on
behalf of all persons employeed as SLS employees now and ?n
the future the following:
A. Persons employed in the SLS classification
prior to June 6 , 1980 and who have been certified at any
time as a result of a competitive examination, shall be
considered certified employees as of the date they
commenced work for the City in the ��SLS classification

B. A stepped-up wage scale will be established for
SLS employees similar to that received by other

from the list of special employment. The City will
conduct a study of the position for purposes of grading

grading , the SLS job position shall be evaluated on the
