RESOLVED, tha.t upon execution and delivery of a release
in full to the City of Saint Paul, the proper City officers
are hereby authorized and directed to pay out of the Tort
Liability Fund 09070-511-000 to Marcella Krensing the sum of
$500.00 in full settlement of her claim for damages and injuries
sustained August 5, 1981, as a result of a fall on the sidewalk
in front of 2127 Bayard Avenue, Saint Paul, Minnesota.

This lawsuit involves a sidewalk falldown case in which an elderly
woma.n, Marcella Krensing, tripped over a section of a public
sidewalk which she alleged created a dangerous condition. Ms .
Krensing was injured and sustained dama.ges .
The sidewalk was raised in certain areas but no notice had ever
been given the City. Thus the City never ha.d a reasonable
opportunity to perform any repair work to the sidewalk.
This case is set for an October 3, 1983 jury trial date.
Negotiations have been conducted to settle this case so as
to avoid the uncertainty of a jury verdict. These negotiations
resulted in settlement offer of $500.00 which we approved
considering all factors involved in this case.
