PROCEEDINGS: Linda Carver, representing Western State Bank, ex- plained that the bank took this property back about three weeks ago and they were not aware of the deficiencies until they saw the code violations' letter which was sent to the former owner. She stated her client is appealing two items cited in the regort, the first floor sleeping room (need to access from one bedroom into another) and the window in the other sleeping room which is 7. 6o size. Ms. Carver explained th at at the present time the occupants are a mother and one child. She feels the difference in the window size and the suggested 8% is so small that a variance should be granted. She further stated as there are only two occupants of the apartment, no problem is cre ated with access from one room to the other. Alice Bijjani pointed out that the bedroom access is illegal according to city code because you must go through one bedroom to get into the other. She did not see a problem, however, unless there are several children and a couple occupying the rooms. Alice felt it would be appropriate to permit occupancy of the bedrooms if the number of people would be limited to no more than three. She also felt the window size of 7.6% would not be a problem. BOARD ACTION: Mrs. Bostrom moved that the permanent variance be granted of Section 34. 13 permitting continued occupancy of e�.isting bedrooms with present access, providing that the nuinber of occupants be limited to no more than three people, and for continued use of the other first floor sleeping room with the window space of 7. 6�. APPEARANCE: wiiliam G. Dunkel PROCEEDINGS: Mr. Dunkel explained that this is a basement efficiency apartment and has been occupied by the same tenant for 6--1/2 years now. He said because of the ground level it would be hard to put a window in as the walls of the foundation are poured and are very thick, making it difficult to cut through. He explained there is a window in the door to the apartment and in the bathroom which both provide some light. There is ventilation attached to the north end of the building. Alice Bijjani felt because of the way the basement door is tucked in under the entry, and the .fact that the bathroom window is under ground level and often covered with snow, it is fairly dark before you get into the apartment. She would have difficulty with gran ting a variance here. The area should have approximately 20 sq. ft. window space and should be 8$. He said all six units have refrigerators , �5 has a stove and sink, #6 is strictly a sleeping room and #7 has a re- frigerator sink and no cooking utilities. Mr. Glassman asked Mr. Wi.ttenberg what had transpired since the September 14, 1982 hearing and inquired if he was appealing anything that was acted on at that time. Mr. Wittenberg explained that he was only requesting a varian ce to have six occupants share a bathroom in- .stead of the usual five in the code. Alice Bijjani reminded the board that there is a difficult zoning problem with this building. She stated Don Miller, Health Department, is aware of it and spoke with her as he was unable to attend today; however, he will be enforcing the items listed in the inspection report. . Biern at � PROCEEDINGS: Ms. Biernat stated she is requesting a variance to leave the kitchen ceiling as it is (under 7' ) due to the original way it was constructed.� Alice Bijjani explained that rooms #l, 2 , 3, 4, and 5 are now combined into one apartment & #7 is a laundry room. The problem is in an area between the living room and the kitchen where the ceiling goes from 7' to approximately 6 ' 1" . This creates a hazard as the difference comes up in accessing from one room to another which. could lead to bumping ones head. Also, the hair of the occupant is brushing on the ceiling. This problem should be corrected by either a step up at the edge of the living room or a little further back. The area is now being dug out for other expansion and re- modelling work so it would be a good time to correct it.
