THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1 . That permission and authority are hereby granted to Sherman Investment Corporation and/or its successors in interest to construct, operate and maintain ornamental street lights and conduit in the right-of-way of Grand Avenue and Chatsworth Street adjacent lots 15 and 16, except the north 40 feet thereof, Block 27, Summit Park Addition. Section 2. That the Director of Public Works is hereby authorized to issue a permit to Sherman investment Corporation and/or its successors in interest for the construction, operation and maintenance of said ornamental street lights and conduit upon and subject to the following terms and conditions: a. That said permittee shall construct said ornamental street lights and conduit entirely at its own expense and to the satisfaction of the Director of Public Works in accordance with the approved plans and specifications on file in the Department of Public Works; b. That said permittee and/or its successors in inte�est shall provide electrical power supply for said lights entirely at their own expense; c. That said permittee shall pay the cost of publication of this ordinance; e. That said permittee shall notify the Engineer in charge of street lighting within the Department of Public Works before and when construction starts and notify the same said Engineer when construction has been completed to allow for a final inspection. � , f. That said permittee and/or its successors in interest shall remove said ornamental street lights and conduit or any part thereof in such manner as is satisfactory to the Department of Public Works whenever the City Council by resolution shall so order; g. That said permittee and/or its successors in interest shall, during the term of this permit restore and repair all property, whether public or private, damaged or which may be damaged due to the construction, operation maintenance and removal or presence of said ornamental street lights and conduit provided for herein; h. That said permittee and/or its successors in interest shall furnish a bond to the City of Saint Paul in the sum of $5,000.00 conditioned to comply with all the terms of this ordinance and to indemnify said City from all liability, cost and expense that may accrue, occasioned by the making of the i.mprovement or arising out of the same; i. That said permittee and/or its successors in interest shall fully indemnify, hold harmless and defend the City of Saint Paul, its agents, officers and employees from any and all damages, claims, losses, judgments, suits, or expenses and on account of all claims,of whatever nature for injury to person(s) and/or property arising out of or connected with the construction, erection, maintenance, operation, and/or removal of said ornamental street lights or conduit; and that supplemental to all other obligations, on their part, jointly and/or severally, hereunder, said permittee and/or its successors in interest shall furnish and maintain and �ay all premiums and other expenses therefor, Casualty Insurance Coverage, with a duly licensed Casualty Insurance Company, naming the permittee and City as jointly insured to the extent of $500,000.00 for injury to any person and/or persons in any single incident and to the extent of $200,000.00 for damage to property in any single accident and insuring the City of Saint Paul against liability on account of all claims of third persons for injury to person(s) and/or property arising from or connected with the construction, erection, maintenance, operation and/or removal of said ornamental street lights and conduit here- under at all times. The permittee shall furnish a certificate of this insurance policy, from time to time, to the City of Saint Paul as described in paragraph j below; j. That said permittee and/or its successors in interest shall submit the necessary insurance and bond documents to the Office Engineer of the Department of Public Works.
