WHEREAS, Hill Plaza Associates has requested permission to construct the sidewalk on
the southerly side of Selby Avenue, from the corner of Arundel Street to approximately
432 feet easterly, in a manner in conflict with the City of Saint Paul, Minnesota,
Department of Public Works, Standard Detail Plates, specifically by having exposed
aggregate surfacing; naow, therefore, be it
RESOLVED, that pursuant to the provisions of Chapters 121 and 123 of the Saint Paul
Legislative Code, the Director of Public Works is hereby authorized to issue to
Hill Plaza Associates a permit to construct sidewalk within Selby Avenue right-of-way,
adjacent Lots 13 through 20, Cochran's Subdivision of and Addition to Block 11,
Woodland Park Addition and vacated alley accruing thereto, using an exposed aggregate
surfacing; and be it
FU1tTHER RESOLVED, that the above permission is granted and made expressly subject to
the following terms, provisions and conditions:
l. That said permittee and/or its successors in interest shall, at its own cost
and expense, and in accordance with all applicable ordinances of the City of
Saint Paul construct, operate, and maintain said sidewalk to include repair,
replacement or reconstruction where necessary to protect the public safety;
2. That said sidewalk construction and installation shall be in strict conformance
with plans approved by the Department of Public Works;
3. That said permittee shall pay Public Works' costs of inspection of said work
and the cost of publication of this resolution;
4. That said sidewalk shall be removed by and at the sole cost of said permittee
and/or its successors in interest, whenever the Council of the City of Saint
Paul shall by resolution determine such removal necessary in the public
i.nterest and accordingly order its removal;

5. That said permittee and/or its successors in interest expressly agrees
and undertakes to fully indemnify, hold harmless and defend the City of
Saint Paul, its agents, officers and employees from any and all damages,
claims, losses, judgments, suits or expenses arising out of or connected
with the construction, repair, reconstruction, maintenance or operation
of the exposed aggregate sidewalk;
6. That said permittee shall within thirty (30) days after the effective
date of this resolution file with the City Clerk its written acceptance
of the terms, provisions and conditions of this resolution.
