Council Resol�tion Presented By Referred To Committee: Date Out of Committee By Date -4- WHEREAS, Continental has made extensive use of local resources in its plan for cable co�miunications services; and WHEREAS, Continental has made substantial comQnitments to local origination and access progr�rnning in tenns of facilities, staffing and ongoing operating support; and WI-IEREAS, Continental has proposed innovative mw�.icipal and institutional applications of cable technology and to provide substantial research and development and financial support for such activities; and WHIItF,AS, Continental's proposed system best matches the needs of the City and people of St. Paul; and WHEREAS, the City Cowicil has reviewed and considered all of the above information; Now, Therefore, Be It RESOLVED, that contingent upon negotiation of a final agreement with Continental leading to the enactment of the franchise ordinance, subject to the final approval by Continental, the City Council and the Mayor and further contingent upon the issuance to Continental of a Certificate of Confirmation by the Minnesota Cable Com�n�ications Board, a fifteen year non-exclusive franchise to operate a cable corrnnunications system is hereby awarded to Continental and that the proper City officers are hereby authorized to negotiate a final agreement with Continental subject to the above-named contingencies; AND BE IT FURTT�t RESOLVED, that any expenditures of ftu�.ds and/or formalization of third party contracts by Continental in anticipation of final approval by Continental, the City Council, the Mayor and the Minnesota Cable Corrnnwzications Board are made expressly at Continental's own risk until the aforementioned approvals are obtained.
