RESOLVED, tha.t upon execution and delivery of a release
in full to the City of Saint Paul, the proper City officers
are hereby authorized and directed to pay out of the Tort
Liability Fund 09070-511-000 to June Gilats the sum of $375.00
in full settlement of her claim for damages sustained September
30, 1981, as a result of a fall on the boulevard in front of
2080 St. Clair Avenue, Saint Paul, Minnesota.

RE: Claim against the City of Saint Paul
by June Gilats
On September 30, 1981, plaintiff June Gilats went to visit her
sister Edith Greengard at 2080 St. Clair in the City of Saint Paul.
It was about 3:00 p.m. and pouring rain. As she walked on the
service walk which was located on the boulevard a�.d connected the
street to the main sidewalk she fell on loose pavement. She
claimed to be looking right at the sidewalk at the time of the
fall. She stated she was aware of the condition of the sidewalk
as she ha.s walked on that stretch once a week for the last 10
to 12 years� Nonetheless, she fell and broke her little right
f inger.
Ms. Gilats sued the City and the landowner. While the City did
not install the sidewalk and does not maintain the carriage walks ,
the law in other jurisdictions is that the entire boulevard
must be kept reasonably safe for pedestrians who use it. There
is no Minnesota law regarding these sidewalks .
Therefore, due to the minima.l injuries and the possibility of
some exposure, we have settled the case for $375. The homeowners
will also contribute an additiona.l $375 to settle this case.
