Hayes, Jr. ��1� - Assistant City Attorney DATE: June 6, 1983 RE: Claim against the City of Saint Paul by Gary Landucci The City of Saint Paul was sued in re gard to an accident occurring on March 12, 1979, in which a St. Paul police officer was in pursuit of a vehicle driven by a Craig Schepers because of traffic violations. Schepers , who was speeding at approxima.tely 70 mph, ran a stop sign at Jefferson and Cretin and collided with a car driven by Mr. Landucci. Landucci sued the City based on alleged negligent conduct on the part of Officer Quinlan in his pursuit of Schepers. Landucci suffered permanent partial injuries to his spine and upper left extremity of 15% and 10% respectively, according to our doctor. Plaintiff's doctors said he ha.d a 25% permanent partial disability of his whole body. Landucci's medical expenses were approxima.tely $40,000. Under the existing law, if the City were to have been found even 1% negligent (as opposed to no negligence for plaintiff) , it would have had to pay the entire amount of any verdict, since Mr. Schepers was uninsured. In my estima.tion, a finding of at least some negligence on the part of Officer Quinlan was possible, exposing the City to potential damages in the area of $100,000 to $200,000. I offered $20,000 to plaintiff which he agreed to accept in full settlement of this case. This disposition was approved by District Court Judge Schumaker.
