An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes � 462.357 and � 64.210
of the Legislative Code, Richard Glatch duly petitioned to rezone
the South 60 feet of Lots l, 2 and 3 , Block 18, Summit Park Addition,
located at 808 Summit Avenue, from R-2 to RT-1 to permit conversion
of a carriage house to a duplex, the getition having been certified
by the Department of Finance and Management Services on March 23, ��
1983 as having been consented to by at least 67� of the owners of ���
the area of the property to be rezoned, and further having been
consented to by at least two-thirds of the owners of the property
situated within 100 feet of the total contiguous descriptions of
real estate held by the same owner or any party purchasing any such
contiguous property within one year preceding the date of the
petition; and
WHEREAS, The current Zoning Committee on April 21, 1983 con-
ducted a public hearing for the purpose of considering the rezoning
petition, and pursuant to Section 107. 03 of the Administrative Code,
submitted its recommendation to the Planning Commission that the
petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on April 22, 1983 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

heard, and the Council having considered all the facts and recom-
mendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 19,
as incorporated by reference in Section 60 . 301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located at 808 Summit Avenue,
being more particularly described as the South
60 feet of Lots 1, 2 and 3, Block 18, Summit
Park Addition, be and is hereby rezoned from
R-2 to RT-1.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Sir:
On April 21 , 1983, the Zoning Committee of the Planning Commission held a
public hearing on the rezoning. The petitioner testified and a representative
from District 16 also testified in support. There was no opposition. At
the close of the public hearing, the Zoning Committee voted 4-1 to approve
the rezoning, with one abstention.
On April 22, 1983, the Planning Commission upheld the Zoning Committee
recommendation on a vote of 13-3. '
This rezoning is scheduled to be heard by the City Council on May 19, 1983.
Please notify me by May 18 if any member of the City Council wishes to have
slides of the site presented at the public hearing.

supports the rezoning. .
Hearing no further testimony, Mr. Bryan closed the public hearing portion of
the meeting.
Ms. Summers moved approval based on findings 1 through 7 of the staff report.
Ms. Karns seconded the motion, which passed on a roll call vote of 4 to 1
with Mr. Pangal voting against the motion. (Mr. Levy abstained from voting. )

F. ZONING HISTORY: The site was zoned "A" residence prior ta 1975, when it was rezoned
R-2. In 98 the main house was rezoned to RT-1 to nerr��it conversion to 2 units . The
carriage house remained in the R-2 district, with one living unit.
In 1982, the Board of Zoning Appeals approved a variance to permit construction of
a 4-car garage in a required side yard of the duplex. This request was based on
the premise that the existing carriage house would be sold.
On April 14, 1983, the City Council approved a lot split, creating separate parcels
for the carriage house and the main structure.
G. FINDINGS:
1 . Applicant proposes selling the carriage house and g��sq . ft. of land. The
purchaser then wishes to convert the carriage house to two units .
2. Land Use Plan policy 4.1-5 states: "The city will establish criteria to allow
sensitive reuse and conversion of existing housing structures. , The criteria will
address density, lot characteristics, structural characteristics, parking, open
space and neighborhood impact. "
3. The lot exceeds the minimum requirements for the RT-1 zoning district. The
existing structure would be nonconforming since it is not set back from #he alley.
4. The carriage house is 40' x 60' on the first floor and 30'x 60' on the second
floor. The structure will be split through the middle� creating two units each
with 900 sq. ft. of space on the second floor (30'x 30�' ) and a family room and
2-car garage on the first floor.
5. A new 4-car garage is planned for the existing duplex. It wi�l be attached to
the main structure with access from Avon. Off-street parking required for new
duplexes is three spaces.
6. The carriage house has a duplex to the north and multiple-family buildings. to
the .south. It would not appear that converting the structure to two units would
have a negative neighborhood impact. The structure will not be enlarged to
accommodate the conversion.

7. The rezoning and conversion would meet the intent of the RT-1 district by
extending the economic life of this structure and justifying expenditures for
� repairs and�modernization. '
